Home My WebLink AboutContract 50217-A1AMENDMENT No .1 CSC No. 50217-A1 TO CITY SECRETARY CONTRACT wHEREAS, the City of Fort Worth (CITY) and Kimley-Horn and Associates, Inc., (ENGINEER) made and entered into City Secretary Contract No. 50217, (the CONTRACT) which was authorized by M&C C-28545 on the 23rd day of January, 2018 in the amount of $1,795,070.00; and WHERFAS, the CONTRACT involves engineering services for the following project: Clear Fork Lift Station and Force Main; and WHERP�,S, it has become necessary to execute Amendment No . 1 to the CONTRACT to include an increased scope of work and revised fee. NOWTHEREFORE, CITY and ENGINEER, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the CONTRACT: 1. Article I of the CONTRACT is amended to include the additional engineering services specified in the proposal attached hereto and incorporated herein. The cost to City for the additional design services to be performed by Engineer totals $48,720.00. 2. Article II of the CONTRACT is amended to provide for an increase in the fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall be an amount of $1,843,790.00. 3. ("Engineer" or "Kimley-Horn") and the City of Fort Worth (the City) dated 01-31-2018 referred herein as the "Contract". During a meeting between the City, Kimley-Horn, and Tarrant Regional Water District (TRWD) representatives on 03-05-2021, TRWD indicated that a Section 408 United States Army Corps of Engineers (USACE) permit would be required to be obtained prior to beginning construction on the proposed Clear Fork Force Main within the existing Federal Floodway of the Clear Fork Trinity River. The scope of services in the Contract does not include preparation of the Section 408 permit submittal. The City has requested that Kimley-Horn perform additional services under Amendment Number 1 for the Clear Fork Lift Station and Force Main project. These services include additional permitting tasks related to preparing a Section 408 USACE permit submittal. Service details are further described as follows: CONTRACT TASK 1'� — PERMITTING SERVICES: (Water$0, Sewer$48,720) $ 28,520 Kimley-Horn 20 200 Archeologist Sub $ 48,720 Total ENGINEER will complete the following additional tasks in accordance with the Original Contract: • Prepare 408 permit submittal cover letter • PerForm of an archaeological survey in accordance with USACE and Texas Historical � Commission (THC) requirements of proposed open cut areas along the pipeline alignment • Prepare a Waters of the United States (WOTUS) report and up to four (4) aerial exhibits dictating federal floodway boundary, proposed improvements, and WOTUS boundaries • Preparation of up to six (6) aerial exhibits in addition to those required under Task 12 • Review, respond and address up to two (2) rounds of USACE/TRWD comments • Compile correspondence with USACE on hydrologic and hydraulic analysis study for proposed lift station site kimley-horn.com .
