AN ORDINANCE ADJUSTING RECEIPTS AND APPROPRIATIONS IN THE
SEWER CAPITAL LEGACY FUND, IN THE AMOUNT OF $96,528.00, BY
INCREASING RECEIPTS AND APPROPRIATIONS IN THE EMERGENCY
SEWER EROSION PROJECT (CITY PROJECT NO. 102939), AND DECREASING
RECEIPTS AND APPROPRIATIONS IN THE UNSPECIFIED PROJECT (CITY
PROJECT NO. UNSPEC) BY THE SAME AMOUNT; PROVIDING FOR A
SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF
PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT
HEREWITH; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That in addition to those amounts allocated to the various City departments for Fiscal Year 2020-2021 in the
Budget of the City Manager, there shall also be adjusted receipts and appropriations in the Sewer Capital
Legacy Fund, in the amount of$96,528.00, by increasing receipts and appropriations in the Emergency Sewer
Erosion project (City Project No.102939), and decreasing receipts and appropriations in the Unspecified
project (City Project No . UNSPEC) by the same amount.
SECTION 2.
That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void
for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair
the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall
be and remain in full force and effect.
SECTION 3.
That this ordinance shall be cumulative of Ordinance 24446-09-2020 and all other ordinances and
appropriations amending the same except in those instances where the provisions of this ordinance are in
direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of
said prior ordinances and appropriations are hereby expressly repealed.
SECTION 4.
This ordinance shall take effect upon adoption.

RECOMMENDATION:
It is recommended that the City Council adopt the attached appropriation ordinance adjusting receipts and appropriations in the Sewer Capital
Legacy Fund by increasing receipts and appropriations in the Emergency Sewer Erosion project (City Project No. 102939) in the amount of
$96 ,528.00 , and by decreasing receipts and appropriations in the Unspecified project (City Project No. UNSPEC) by the same amount.
DISCUSSION:
The purpose of th is Mayor & Council Communication (M&C) is to provide necessary additional funding for increased project costs for the
emergency sewer work for Trinity River stream bank erosion affecting two 90-inch diameter West Fork trunk sewer mains, identified as mains M-
280-B and M-338-B.
On June 27 -June 29 , 2020 , a major rain event flooded the job site for the riverbank erosion emergency repair project resulting in the destruction
of the access ramp to the edge of the river and damaging the sheet pile cutoff wall that provided temporary support for the two sewer mains . In
addition , the 90-inch sewer main closest to the river has shifted northward over time and developed cracks allowing raw sewage to flow into the
river during the rain event. Staff remediated the sewage sp ill as soon as it was discovered . To immediately address this situation , Circle C
Construction was engaged to repair the pipe (City Secretary Contract 54184 : $1 ,600 ,000 .00) and Freese and Nichols were engaged to provide
the necessary design (City Secretary Contract 54186: $200,000 .00). During the course of the design work, it was confirmed that the 90-inch pipe
closest to the river was out of its original alignment, apparently pushed by shifting soils over time. Additional construction and design effort to
extend the pipe repair an additional 300 feet , including installation of a new manhole , is necessary to properly realign and reinforce the sewer main
and place it back in service . Bypass pumping operations continued and remained in place for the duration of the repair.
Due to actual field conditions , it was necessary to extend the pipe repair limit beyond the original scope which necessitated additional bypass
pumping. The additional funding requested will also allow for moving the bypass pumping pipes to the Village Creek Waste Treatment Plant.

This action will have no effect on the Water Department's operating budget when complete.
The project is located in COUNCIL DISTRICT 4.
A Form 1295 is not required because : This M&C does not request approval of a contract with a business entity .
FISCAL INFORMATION/ CERTIFICATION:
The Director of Finance certifies that funds are currently ava ilable in the Unspec project within the Sewer Capital Legacy Fund and upon approval
of the above recommendation and adoption of the attached appropriation ordinance , funds will be available in the Sewer Capital Legacy Fund for
the Emergency Sewer Repair/Erosion project. Prior to an ex penditure being incurred , the Water Department has the responsibility of verifying the
availability of funds .
