HomeMy WebLinkAboutOrdinance 17876-11-2007ORDINANCE NO. 17876..-11-2007 AN ORDINANCE INCREASING THE TOTAL NUMBER OF AUTHORIZED CIVIL SERVICE POSITIONS IN TI1:E POLICE DEPARTMENT; ADDING FIVE POLICE OFFICER POSITIONS AN]D REDUCING ONE POLICE OFFICER POSITION; PROVIDING A STATEMENT OF PURPOSE AND INTENT FOR THE ADOPTION AND IMPLEMENTATION OF THIS ORDINANCE; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. BE IT HEREBY KNOWN: WHEREAS, the Police Chief has requested the City Council to increase and thereafter specify the total number of authorized civil service positions at the police officer rank in the Police Department into conformity with the proposed changes as set forth immediately below in order to effect efficient economy of the operations of the Police Department; and WHEREAS, on October 1, 2007, the City Council approved the most recent ordinance concerning the authorized positions for the Police Department. In that Ordinance, the Council adjusted the Police Department's civil service staff ng, effective October 1st, 2007, as follows: Deputy Chief 5 Captain 13 Lieutenant 46 Sergeant 155 Corporai/Detective 181 Police Officer 1,083 Total 1,483 WHEREAS, pursuant to Chapter 143.021 (a), Texas Local Government Code, the City Council may prescribe the authorized number of positions in each classification (rank) and the correct number of civil service positions by ordinance; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That, effective upon the formal adoption of this ordinance, the following positions shall be the only civil service positions in each classification (rank) authorized in the City of Fort Worth Police Department for the remainder of the fiscal year 2007-2008 or until modified by subsequent ordinance: Deputy Chief 5 Captain 13 Lieutenant 46 Sergeant 155 Corporal/Detective 181 Police Officer 1,087 Total 1,487 SECTION 2. The "Mayor and Council Communication" memorandum, which is presented contemporaneously with this ordinance, is hereby expressly incorporated herein by reference for further clarification and explanation of the purpose and intent of the Council in their adoption as well as the Department's implementation of this ordinance. SECTION 3. This ordinance shall be cumulative of all provisions of previous ordinances and of the Code of the City of Fort Worth, Texas (1986), as amended, except where the provisions of this ordinance are in direct conflict with the provisions of prior civil service staffing ordinances for the Police Department and such Code, in which event conflicting provisions of such ordinances and such code provisions are hereby repealed and this ordinance shall be controlling. SECTION 4. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of these ordinances are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. SECTION 5. This ordinance shall take effect and be in full force and effect from and after its passage, and it is so ordained. APPROVED AS TO FORM AND LEGALITY: Assistant City Attorney Date: November 28 2007 ADOPTED: November 27 2007 EFFECTIVE: November 27 2007 C~#y of Fob carttfa, Texas Mayor and Council Communication COUNCIL ACTION: Approved on 11/27/2007 -Ordinance No. # 17876-11-2007 DATE: Tuesday, November 27, 2007 LOG NAME: 35STAFFING REFERENCE NO.: ~~'G-15972 SUBJECT: Adopt Civil Service Staffing Ordinance Increasing Authorized Strength in the Police Department by Five Police Officers and Reducing One Police Officer Position RECOMMENDATION: It is recommended that the City Council adopt the attached Ordinance specifying the authorized positions in the Police Department, thereby effectively increasing the number of authorized positions by three Police Officers in the Grant Fund, two Police Officers in the General Fund and reducing the number of authorized Police Officer positions by one in the Grant Fund. DISCUSSION: On February 20, 2007, the City Council authorized the City Manager to apply for and accept a grant (M&C G-15616) in the amount of $750,000 from the Office of Violence Against Women Grant to Encourage Arrest Policies and Enforcement of Protection Orders Program. This grant was awarded to the City of Fort Worth on September 14, 2007, for the purpose of supporting law enforcement initiatives in implementing a multi-approach plan designed to provide additional personnel to hold offenders accountable for their action through investigation, arrest, and prosecution of domestic violence offenders. This grant allows the City to hire three additional officers in the Police Department Fugitive Unit to immediately follow-up and enforce Emergency Protection Orders during the 24 month grant period. On August 31, 2007, the Criminal Justice Division Computer Crime Fraud Grant which provides grant funds for one civil service position was not extended for the City of Fort Worth. The Police Department's authorized civil service strength should be reduced by one police officer position. Lastly, during the FY2007-08 budget development process two civil service Fire Arms Training positions were authorized in the Police Department General Fund budget. The department is now ready to fill these positions and is increasing its civil service strength by two police officers. The cost for these two positions will be absorbed within the department's budget. The Police Department's authorized civil service strength is 1,483. Upon approval of the attached ordinance, the assignment of civil service positions authorized for the Police Department will result in the addition of three Police Officers for the Violence Against Women Grant, two Police Officers for Fire Arms Training, and a reduction of one Police Officer under the Computer Crime Fraud Grant. The addition of the positions referred to above would result in the following changes in the authorized strength of the Police Department effective October 2, 2007.
