HomeMy WebLinkAboutOrdinance 17878-11-2007Ordinance No. 17878-11-2007 AN .ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE STORM WATER CAPITAL PROJECTS FUND IN THE AMOUNT OF $117,745.90 FROM AVAILABLE FUNDS FOR THE PURPOSE OF EXECUTING A CONTRACT WITH A&M CONSTRUCTION AND UTILITIES INC., FOR FLAXSEED DRAINAGE IMPROVEMENTS; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1 That in addition to those amounts allocated to the various City departments for Fiscal Year 2007- 2008 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Storm Water Capital Projects Fund in the amount of $117,745.90 from available funds for the purpose of executing a contract with A&M Construction and Utilities Inc., for Flaxseed Drainage Improvements. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 17749 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. D LEGALITY: ADOPTED AND EFFECTIVE: November 27, 2007 This ordinance shall take effect upon adoption. Authorize the City Manager to execute a contract with A & M Construction and Utilities, Inc., in the amount of $94,259.90 for Flaxseed Drainage Improvements; 2. Authorize the transfer of $117,745.90 from the Storm Water Utility Fund to the Storm Water Capital Projects Fund; and 3. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Storm Water Capital Projects Fund in the amount of $117,745.90. DISCUSSION: The Storm Water Management Program was established to reduce flooding in Fort Worth, preserve streams, and minimize water pollution and to operate the storm water system in a more effective manner to fully comply with state and federal regulatory requirements. This will be accomplished by infrastructure reconstruction and system maintenance, master planning, enhanced development review, and increased public education and outreach. On April 23, 2007, the City Manager executed an engineering agreement with DeOtte, Inc., for Flaxseed Drainage Improvements. This project was advertised on August 30, 2007, and September 6, 2007. The following bids were received on October 4, 2007: BIDDERS AMOUNT A&M Construction and Utilities, Inc. $94,259.90 Humphrey & Morton Construction Company, Inc. $125,535.00 BurnsCo Construction, Inc. $139,447.00 Conatser Construction, Texas, LP $165,854.00 Klutz Construction, LLC $177,880.00 TIME OF COMPLETION: 60 Working Days Specified Funding in the amount of $17,486 is required for construction survey, project management, pre- construction, material testing, inspection and project close. The contingency fund for possible change Logname: 30FLAXSEED00701 Page 1 of 2 orders for drainage improvements is $6,000. A & M Construction and Utilities, Inc., is in compliance with the City's M/WBE Ordinance by committing to 18 percent M/WBE participation. The City's goal on this project is 16 percent. The project is located in COUNCIL DISTRICT 7, Mapsco 58-Y. FISCAL INFORMATION/CERTIFICATION: The Finance Director certifies that upon approval of the above recommendations, and adoption of the attached appropriation ordinance, funds will be available in the current capital budget, as appropriated, of the Storm Water Capital Projects Fund.
