Wetinare Survey, Abstrac� 1649, Tarrant County, Texas accordi�.g ta t�e deed recoxded in'Volurne 388-125, Page 26, Deed Record.s, Tarrant Counf.y, Texas, hereinafter ca]led the "Propex�y". WHEREAS, the Landowner xs pxoceeding to build on and develap �e Prope;rfy ac.cor�.ing to the Si#e P�an/Subdivision Plan knovvn as Lat 3, Block 4-R, Southland Terrace Additzon he;reinafter cailed the "P�an", which is expressly made a part hereof, as appro�ed or to be appro�red by the City and the Landowner provide� for man�.gezxient of Stormwater within the confin.es of the Property; and WHEREAS, the City an�. the Landowner, and their suecessors and assigns, agree that the health, safety and welfare of the re,side�ts of the City af Fort Warth, Texas require that on-site Stormwater Manageme�.t Faci�ities be co��tructed and mainfained on a portion of the Property; and WIIEREAS, the City requires ihat on-site Storinwater Management Faciliti�s ("Facility"} as shown on the Plan be $TORMWATER FACILITY MAINTENANCE AGREEMENT Rev. 11/17/2018 constructed and adequately mainiained �y the OFFICIAL RECORD , CITY SECRETARY FT. WORTH, TX Landowner, its successors and assigns, the location and dimensions Qf which is shown and more particularly described by metes and bounds in the attached Exhibii "A" ("Facility Property"); and NOW, THEREFORE, in cansidera�ion o� the foregaing premises, the mutual covenants contained herein, and tl�e followin� terms and conditions, the parties hereto agree as follows: 1. The Landowner, its successors and assigns, shall ad�quately constnzct and r�ainta.in the on-site Stoarmwater M�,nagement Facility ("Facility") at no expense to the City o�Fort Worth in accordance with �he design speci�cations far the Facility, attached as Exhibit "B", and t�e current sCandards then in force and effect in the �ity of Fort Worth �d with �h� Operation� and Maintena.nce Plan attached to this Agreement as E�ibit "C". Tk�e Stonnwater Facility includes alI pipes, channels or oiher canveyances built to convey Storrmwater #n the facility, as weli as all structures, iinprovements, and vegetation provided #o contt�ol the quantity and quality af the Stormwater. Adequate maintenanee is herein defined as good working condition so that filiese facilities are performing their design func#ions, The Stormwa#er Si�uctural Cantrol Maintenance �haclflists, attached ta th�� Agreement �.s E�hibi� "D", are to be used �o estabiish wha� good working condition is acceptable to the Ciiy. 2. The Landowner, its �uccessors and assigns, shall inspect the Facility and submi� an inspection report to the City annuaily. The pwrpose o�#he inspec�on is to assure safe a.nd prope� functioning of the Facility. The xnspection sha.l� cover the entire Facility, berms, autlet structure, pond areas, access roads, ete. Components of the �acility, which need maintenance or replacement ta p�rforzn t�eir desi�n futict�on, shal� be noted �n the inspection report along with �lie corrective actions to be taken. 3. The Landowner, its successors and assigns, hereby grant permission to the City, its authorized agen�s a�d emp�oyees, to enter upon tiie Property and to inspect the Facility Property whenever the City deerns necessary. The purpase STORMWATER FACI�ITY MAINTENANCE AGREEMENT � Rev. 1 1 11 7120 1 8 nf inspection is to follow-up on reported deficiencies and/or to respond to citizen complaints. Ths Ciiy shall provide ihe Landowner, its succes,sors and �S51g115, copies of the inspection findings and a directive to commence with tk�e repairs if necessary. 4: Tn the e�en� th� L•andown�r, its� s�ccessors and assigns, faiis to maintain the Facility in good working condition as s�ecified herein, the City, iis authorized agents and employees, may enier upon the Facility Property and take whatever steps necessary to correct defczencies identified in the inspection report and to charge the costs of such repairs �o the Landowner, 1�5 SL1CCeSSOI'S aTiCl �SSlg�'1S. It is expressly understoad and agreed that the City is nnder na obliga�ion to routinely maintain or repair said Facility, and in no event shall this .A�greement be eonsta-uec� to i�pose �n� sueh oblig�tiQn an the �'ity; such abii�ation is Landowner's. 5. The Landawner, its successors and assigns, will perform the work necessary to k�ep �he Facility in goad warking o;rder as apprnp�-iate. In the event the City pursuant to this Agreement, perforn�s wark of any nature, ar expends any funds in perfnrmance af said work for labor, �ase af e�uipmen�t, su}�plies, materials, and the 1ike, the Landovvner, its successors and assigns, shall reimbuxse the �ity upon demand, within thirty (30) day5 of receipt th�r�o� �or a�� actual �os�s zncw red by the City hereunder. In the event tnat Landawner or its successars ar assigns fail io pay the Ci�ty for the costs incu�-�red under this section, the City shall impress a lien for the costs of such work upon other Iots owned by the Landowner. Such lien shall i�e perfected hy filing in the office of the Coutity Clerk of Tarrant County, Texas an a�fidavit identifying the properiy to be aharged with such lien, stating the amount thereo�, and making reference to this A�re�ment. 6. This Agreement imposes no liability of any kind whatsoever on the City. THE LANDOWNER AGREES TU HOLD THE CITY HARMLESS FR4M ANY LIABTLITY IN THE EVENT THE FACII�ITY FAILS TO OPERATE PROPERLY.
