HomeMy WebLinkAboutOrdinance 17882-11-2007Ordinance No. 17882-11-2007 AN ORDINANCE INCREASING APPROPRIATIONS IN THE ENVIRONMENTAL MANAGEMENT OPERATING FUND IN THE AMOUNT OF $81,000 AND DECREASING THE UNRESERVED RETAINED EARNINGS BY THE SAME AMOUNT, FOR THE PURPOSE OF TRANSFERRING SAID FUNDS TO THE ENVIRONMENTAL MANAGEMENT PROJECT FUND; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1 That in addition to those amounts allocated to the various City departments for Fiscal Year 2007- 2008 in the Budget of the City Manager, there shall also be increased appropriations in the Environmental Management Operating Fund in the amount of $81,000 and decreasing the unreserved retained earnings by the same amount, for the purpose of transferring said funds to the Environmental Management Project Fund. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and efFect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 17749 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. ADOPTED AND EFFECTIVE: November 27 2007 This ordinance shall take effect upon adoption. Adopt the attached supplemental appropriation ordinance increasing appropriations in the Environmental Management Operating Fund by $81,000 and decreasing the unreserved retained earnings by the same amount; 2. Approve the transfer of $81,000 in undesignated funds in the Environmental Management Operating Fund to the Environmental Management Project Fund; 3. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Environmental Management Project Fund by $81,000; and 4. Authorize the City Manager to execute a contract with Intercon Environmental, Inc., for asbestos abatement services for the former retail property located at 3616 East Lancaster in the amount of $81,000. DISCUSSION: On July 17, 2007, City Council authorized the City Manager to execute a Contract of Sale for the property located at 3616 East Lancaster which will be used for the relocation of the City of Fort Worth Police Department Crime Lab. The city-owned building has Asbestos-Containing Materials (ACM) that will be impacted during building renovations. The Environmental Management Department is contracting for removal of the ACM including: drywall with wall texture and joint compound; floor file and associated mastic; black mastic behind mirrors; and black mastic on thermal system insulation. A Request for Proposals (RFP) was advertised on August 31 and September 7. The following firms submitted Proposals on September 27: Andrew Joseph Co., Inc. ARC Abatement Empire Environmental Intercon Environmental, Inc. Olmos Abatement, Inc. Logname: 52INTERCONPDCL Page 1 of 2 Project Development Group The proposals were evaluated based on apre-determined combination of qualitative and quantitative (bid point) measures. These measures included but were not limited to the evaluation of previous work experience, qualifications of personnel, contractor capabilities, cost, and subcontractors. Based on the total point distribution of the pre-determined measures, City staff is recommending the contract be awarded to Intercon Environmental, Inc. Intercon Environmental, Inc., is in compliance with the City's M/WBE Ordinance by committing to 10 percent M/UVBE participation. The City's goal on this project is 10 percent. Work on the project is expected to begin on December 1, 2007. The building is located in COUNCIL DISTRICT 8. FISCAL INFORMATION/CERTIFICATION: The Finance Director certifies that funds are available in the current operating budget, as appropriated, in the Environmental Management Project Fund.
