HomeMy WebLinkAboutResolution 5400-05-2021 A Resolution NO. 5400-05-2021 Authorizing Employment of Todd Spake and Kelly Hart & Hallman LLP as Outside Legal Counsel for Assistance to the City Attorney's Office Related to the City's Mineral Interests and Gas Leases WHEREAS the City of Fort Worth owns the mineral rights to multiple properties and is a party to various gas leases; WHEREAS on occasion, the ownership of these mineral interests and the leases thereon necessitate legal review of issues, document review or drafting, amendment to the leases, and other legal matters; and WHEREAS it is necessary to hire outside legal counsel with expertise in representing entities in oil and gas law matters to ensure the City's handling of mineral issues complies with the complexities of existing law; and WHEREAS Todd Spake and other attorneys at Kelly Hart & Hallman LLP have extensive expertise in oil and gas legal matters; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: I. That pursuant to Chapter VI, Section 3, of the City Charter, Todd Spake and Kelly Hart & Hallman LLP, are hereby employed to provide legal services to the City related to the City's mineral interests and gas leases. II. That, as far as practicable, the compensation to be paid to Kelly Hart & Hallman LLP for their services is hereby fixed in an amount not to exceed $11,500.00. Adopted this 18th day of May 2021. DISCUSSION: The City of Fort Worth owns the mineral rights to multiple properties and is a party to various gas leases. On occasion,the ownership of these mineral interests and the leases thereon necessitate legal review of issues,document review or drafting,amendment to the leases,and other legal matters. Therefore,it is necessary to hire outside legal counsel with oil and gas law expertise to assist the City Attorney's Office in assuring that the City's handling of mineral issues comply with the complexities of existing law. Pursuant to Chapter VI,Section 3,of the City Charter,the City Council must approve the hiring of outside counsel. Todd Spake and other attorneys at Kelly Hart&Hallman LLP have extensive expertise representing entities in oil and gas law matters,and the City Attorney's Office recommends the City Council approve their hiring in an amount not to exceed$11,500.00. FISCAL INFORMATION/CERTIFICATION: The Director of Finance certifies that upon approval of the recommendations,funds are available in the current operating budget,as appropriated, of the General Fund and that,prior to an expenditure being made,the Property Management Department has the responsibility to validate the availability of funds.
