SUBJECT: UPDATE ON MCLELAND TENNIS CENTER

The purpose of this Informal Report is to provide an update on the McLeland Tennis Center and
staff's intent to exercise the first five-year renewal term option effective September 1 , 2021 .
On August 22, 2016 the City Council authorized (M&C C-27791/ CSC No. 48111) a management
contract for McLeland Tennis Center with Lifetime Tennis, Inc. (Lifetime).
The agreement's primary term is five (5) years beginning September 1 , 2016 and ending on
August 31 , 2021 . Unless previously terminated, the City and Lifetime may, by mutual written
consent, elect to extend the agreement for two (2) successive five-year periods. The agreement
states the parties shall make a good faith effort to notify each other of their intent to renew the
agreement at least one year prior to the expiration of the agreement. Lifetime has been notified
the City desires to extend the contract, following a contract compliance review.
The terms of the agreement provided for Lifetime to assume all personnel and operational costs
related to the day-to-day operations at the center and retain all revenues generated at the
center. The rental payment is $25,000.00 annually.
In addition to the annual rental fee, Lifetime pays the City an annual Capital Improvement Fee
(CIF), which was set at $5,000.00 for the first year and increases by $1 ,000.00 each subsequent
year.
The terms of the agreement also require Lifetime to provide the following: 97 hours of weekly
Center operations; creation and maintenance of a website; offer on-line player registrations and
reservations; provide insurance coverage; keep adequate books and records; and provide tennis
lessons, clinics, leagues, summer instructional camps and tournaments. The City is responsible
for utilities, replacement and maintenance of tennis nets and windscreens and daily upkeep of the
external grounds at the Center.
Rent payments from Lifetime over the life of the agreement total $112,500.00, with the last
payment due June 10, 2021 . Lifetime has made all quarterly payments of$6,250.00, with the
exception of one payment that was waived due to COVID-19 closures via the agreement's Force
Majeure clause.
Lifetime has also complied with requirements to make annual CIF payments. Start-up
improvements were made at the expense of Lifetime in lieu of the $5,000.00 initial CIF payment.
The City also approved additional improvements to be made by Lifetime in September 2021 ,
reducing the 2021 payment from $9,000.00 to $4,500.00. All other CIF payments have been
made in accordance with the agreement. As such, the CIF fund has a current balance of
$25,500.00. Upon extension of the agreement, mutually agreed upon improvements will be made
using these funds.

Since 2015, the City and Lifetime have completed, or are in the process of completing, over
$700,000 in improvements at the center. Projects include indoor and outdoor court resurfacing,
post & net replacement, windscreen replacement, pro shop remodel, court drainage repairs, ADA
and parking lot improvements, fence repairs, pickle ball court placement, hitting wall resurfacing,
and many other miscellaneous improvements.
Sources of funds for improvements include 2014 Bond Funds ($544,837); Athletics Operating
Budget ($53,953); Gas Lease Funds ($52,326); Lifetime Tennis Funds ($30,000); Fort Worth
Tennis Association Donations ($18,000); and CIF Funds ($4,000).
Lifetime has maintained a full-service website since the beginning of the agreement. With their
recent rebranding to Impact Activities, their website has also been rebranded. Impact Activities
launched a free mobile app that can be used by patrons to reserve courts.
A full array of tennis programs are offered for all ages and abilities. Junior programs include
beginner classes, U-10 advanced classes, camps, and private lessons. Drop-in drills, clinics,
private lessons, and open court reservations are also available for adults. Impact Activities also
hosts United States Tennis Association tournaments, Universal Tennis Rating tournaments, and
multiple pickle ball tournaments such as the AAU USA National Qualifier.
Community outreach events at McLeland have included Latino Night, Phoenix Sober House
events, Spark Tennis program, weekly use of the courts by City staff coached community center
patrons, and elementary school takeovers, which have included over 10,000 students.
By conducting a contract compliance analysis, City staff has confirmed the agreement between
the City and Impact Activities is mutually beneficial and intends to exercise the option to
administratively extend the agreement an additional five (5) years beginning September 1 , 2021 .
