AMENDMENT No . 6
TO CITY SECRETARY CONTRACT
�R�iAIS, the City of Fort Worth (CITY) and CDM Smith, Inc.,
(ENGINEER) made and entered into City Secretary Contract No. 49049, (the
CONTRACT) which was authorized by M&C C-28213 on the 2"d day of May, 2017
in the amount of $1,570,965.00; and
WHI:Ti� , the CONTRACT was subsequently revised by: Amendment No.
1 in the amount of $885,755.00 which was authorized by M&C C-28857 on
September 18, 2018, Amendment No. 2 in the amount of $71,993.00
administratively authorized February 7, 2019 and Amendment No. 3 in the
amount of $114,939.00 which was authorized by M&C 20-0159 on April 7, 2020
and Amendment No. 4 in the amount of $705,000.00 which was authorized by
M&C 20-0346 on May 19, 2020 and Amendment No. 5 in the amount of $699,217.00
which was authorized by M&C 20-0700 on September 22, 2020; and
WHI�RI�, the CONTRACT involves engineering services for the
following project:
Village Creek Water Reclamation Facility Grit Facility and South
Influent Pump Station; and
WgI�iTi � , it has become necessary to execute Amendment No . 6 to
the CONTRACT to include an increased scope of work and revised fee.
NOWTH�REFORE, CITY and ENGINEER, acting herein by and through
their duly authorized representatives, enter into the following agreement,
which amends the CONTRACT:
1.
Article I of the CONTRACT is amended to include the additional
engineering services specified in the proposal attached hereto and
incorporated herein. The cost to City for the additional professional
services to be performed by Engineer total $785,500.00.
2.
Article II of the CONTRACT is amended to provide for an increase in
the fee to be paid to Engineer for all work and services performed under
the Contract, as amended, so that the total fee paid by the City for all
work and services shall be an amount of $4,833,369.00.
3.
All other provisions of the Contract, which are not expressly amended
herein, shall remain in full force and effect.

Scope for Enqineerinq Related Services for Wastewater Treatment Plant Improvements
ENGINEERING SERVICES FOR
VILLAGE CREEK WATER RECLAMATION FACILITY
SOUTH FLOW LIFT STATION PROJECT
CONSTRUCTION PHASE SERVICES

The scope set forth herein defines the work to be performed by the ENGINEER in
completing the project. Both the CITY and ENGINEER have attempted to clearly define the
work to be perFormed and address the needs of the Project.
PROJECT DEFINITION AND BACKGROUND
The Fort Worth Water Department's Village Creek Water Reclamation Facility (VCWRF)
South Flow Lift Station Project "the Project" includes proposed improvements to the plant's
existing infrastructure and construction of additional infrastructure to pump the south influent
flow to Box F1 and onto the Headworks Facility. This construction phase services scope is
based upon a 21-months construction period and a 2-month post-construction period.
The following scope of work clarifies and describes the project tasks completed by the
ENGINEER as additional scope of work under Phase II Final Design Phase and tasks to be
performed and completed by the ENGINEER as part of Phase III Construction Phase
Services for the Project.
Upon receipt of notice to proceed, ENGINEER will provide construction administration
services during construction.
WORK TO BE PERFORMED
PHASE II — FINAL DESIGN
ENGINEER has previously provided additional necessary services to support the design
phase of the Project as follows.
2.1 Surveying
ENGINEER's Subconsultant, CP&Y, completed additional scope to prepare an
easement document for Oncor electrical power utility relocation underground for the
Project.
2.2 Geotechnicallnvestigation
ENGINEER's Subconsultant, Alliance Geotechnical Group, completed additional
geotechnical investigation confirm preliminary geotechnical recommendations
previously provided by Alliance Geotechnical. ENGINEER incorporated
recommendations to include exploratory test pits and subgrade conditions into bid
documents.

2.3 Flood Plain Permitting and CDC Modeling
ENGINEER completed additional scope of work to address the City of Arlington's
(CoA) comments on the CDC Exemption filed by the City of Fort Worth for this
Project. ENGINEER revised grading plan design and performed additional steady
state and unsteady modeling to satisfy CoA's no-rise request for the area upstream
of the project site and within the CoA's jurisdictional boundary. ENGINEER also
provided a formal response to the CoA's comments.
PHASE III — CONSTRUCTION PHASE SERVICES

ENGINEER will support the construction phase of the project as follows.
TASK 3.1 PROJECT MANAGEMENT
ENGINEER will perform project management duties throughout the Construction Services
Phase of the Project based on the construction duration stated above.
ENGINEER will manage change, communicate effectively, coordinate internally and
externally as needed, and proactively address issues with the CITY's Project Manager and
others as necessary to make progress on the work.
3.1.1 General Project Management
• Lead, manage and direct ENGINEER'S project team activities.
• Review project budget and schedule weekly and communicate internally among
team members regarding task budget status.
• Review project monthly and assess risk, budget, schedule, out of scope items, on-
time delivery metrics, submittal review and RFI status.
• Task and allocate team resources.
3.1.2 Communications and Reporting
• Prepare and submit invoices and progress reports monthly in the format requested
by the CITY.
• Complete Monthly M/WBE Report Form and Final Summary Payment Report Form
at the end of the project.

TASK 3.2 CONSTRUCTION ADMINISTRATION
3.2.1 Meetings
ENGINEER will attend one pre-construction meeting with the CITY, Resident Project
Representative (RPR), Contractor, and their Subcontractors. ENGINEER's Project
Manager, Construction Coordinator, and one Engineer representing each of the
following design disciplines will be in attendance: process mechanical, geotechnical,
structural, and instrumentation. ENGINEER assumes pre-construction meeting will
be virtual WebEx meeting and 2 hours in duration.
ENGINEER will attend monthly construction progress meetings with the CITY, RPR,
Contractor and their Subcontractors. ENGINEER's Project Manager and
ENGINEER's Construction Coordinator will attend up to 21 monthly progress
meetings. One representative each for civil, process mechanical, geotechnical,
structural, electrical and instrumentation disciplines will attend up to six monthly
progress meetings, with meeting attendance determined by the corresponding work
of the forthcoming month. ENGINEER assumes monthly meetings to be 2 hours in
duration and virtual WebEx meetings.
ENGINEER will attend up to five I&C coordination meetings with PCSS and
Emerson. I&C coordination meetings will generally follow the monthly progress
meetings. ENGINEER's Project Manager and up to two persons from
instrumentation discipline will attend meetings. ENGINEER assumes meetings to be
1 hour in duration and virtual WebEx meetings.
Assumptions: ENGINEER assumes RPR will conduct meetings and prepare meeting
agenda and minutes. ENGINEER will prepare submittal and RFI log. ENGINEER
assumes PCSS and Emerson will conduct I&C coordination meetings and prepare
meeting agenda and minutes.
3.2.2 Site Visits and Inspections
ENGINEER will make up to six site visits, excluding site visits specified in Tasks 3.6,
3.7, and 3.8, to the project site to observe the progress and quality of various
aspects of the construction work for the Project. Site visits shall be up to 2 hours in
duration excluding travel time.
Limits of Responsibility: The purpose of site visits will be to enable ENGINEER to
carry out the duties and responsibilities assigned and undertaken by ENGINEER
during the Construction Phase, and, in addition, by the exercise of ENGINEER's
efforts as an experienced and qualified design professional, to provide the CITY
with a greater degree of confidence that the completed work will conform to the
Contract Documents and that the Contractor and its Subcontractors have
implemented and maintained the integrity of the design concept of the completed
Project as a functioning whole as indicated in the Contract Documents.
ENGINEER will not, during such visits or as a result of such observations of the
contractor's work in progress, supervise, direct, or have control over the
Contractor or its Subcontractor's work, nor shall ENGINEER have authority over
or responsibility for the means, methods, techniques, sequences, or procedures
of construction selected or used by the Contractor, for security or safety on the

site, for safety precautions and programs incident to the Contractor's or its
Subcontractors work, nor for any failure of the Contractor or its Subcontractors to
comply with Laws and Regulations applicable to the Contractor furnishing and
perForming the work.
3.2.3 Shop Drawing Submittal Review
ENGINEER will review shop drawings, related data submittals, product samples, and
0&M submittals. All shop drawing submittal review comments will be uploaded to
City's preferred data management system. ENGINEER will perform technical and
functional review of up to 315 shop drawings and other related submittals, 79
resubmittals, and 25 O&M Manuals. ENGINEER will make every effort to review
shop drawings and return within 14 days, except where review is delayed for
coordination with subsequent submittals. The Contractor's CPM schedule shall
include a review duration of 30 days per section 01 33 00.

Assumption: ENGINEER will receive submittal notifications from BIM360 and
distribute to design team for review. ENGINEER will upload submittal review
comments to web based electronic document control and submittal management
system.

3.2.4 Test Reports
ENGINEER will review construction material test reports submitted by the
CONTRACTOR that are nonconforming with specifications. ENGINEER assumes up
to 50 test reports will be submitted for review.
Assumption: ENGINEER assumes RPR will review all test reports submitted by
CONTRACTOR and will notify ENGINEER nonconforming test reports to review.
RPR or CONTRACTOR will manage web based electronic document control and
submittal management system and will distribute test reports to ENGINEER for
review.
3.2.5 Request for Information (RFIs)
ENGINEER make clarifications and interpretations of the Contract Documents.
ENGINEER will respond to up to 100 RFIs with 3-hr per RFI. All RFI responses will
be uploaded to BIM 360.
Assumption: ENGINEER assumes RPR or CONTRACTOR will manage web based
electronic document control and RFI management system and will distribute RFIs to
ENGINEER for review. ENGINEER will upload RFI responses to web based
electronic document control and submittal management system.
3.2.6 Field Order/Change Orders
ENGINEER will review and comment on up to 25 Field Order/Change Orders
requested by the Contractor. When clarifications or interpretations result in a change
cost or schedule, ENGINEER will review cost estimates and prepare documentation
for change orders. When clarifications or interpretations result in a no-cost change
order, ENGINEER will prepare documentation for field order changes.
Assumption: ENGINEER assumes RPR or CONTRACTOR will manage web based
electronic document control and field order/change order management system.
Providing services to review or evaluate construction contractor(s) claim(s),
supported by causes not within the control of ENGINEER are an Additional Service.
Investigations, analyses, studies or design for substitutions of equipment or
materials, corrections of defective or deficient work of the contractor or other
deviations from the construction contract documents requested by the contractor and
approved by the ENGINEER or CITY are an Additional Service. Substitutions of
materials or equipment or design modifications requested by the CITY are an
Additional Service.
3.2.7 Instrumentation Witness Factory Test and Functional Demonstration Testing
ENGINEER will provide instrumentation and control system coordination and witness
factory and functional demonstration testing during construction. Testing will include
the Witness Factory Tests, Functional Demonstration Tests, and I&C assistance
during construction. It is assumed that up to two, 8-hour days of factory testing and
one 8-hour day of functional testing will be provided, with one lead instrumentation
engineer in attendance.

ENGINEER will review Contractor's commissioning, start-up, and testing plan and
report to CITY.
ENGINEER will provide up to 48 hours of on-site assistance during plant start-up to
ensure the Project is functional and operating as designed.
3.2.9 Performance Testing
ENGINEER will provide up to 48 hours of on-site assistance by lead design engineer
during process performance testing for the lift station.
3.2.10 Substantial and Final Completion Walkthrough
ENGINEER will participate in substantial completion and final completion inspections
with the CITY and Contractor and assist with preparation of final punch list. Each
walkthrough shall be 2-hr duration exclusive of travel time and punch list preparation.
3.2.11 Record Drawings
ENGINEER will prepare Record Drawings from information provided by the
Contractor depicting any changes made to the Final Drawings during construction.
The following information will be provided by the Contractor:
• As-Built Survey
• Red-Line Markups from Contractor in electronic (PDF) format
• Copies of Approved Change Orders and Field Orders, annotated and referenced
into the red-line markups
ENGINEER will modify the Final Drawings electronically and will place a stamp on
the plans indicating that they represent Record Drawings of the project as
constructed.
The following disclaimer will be included with the Record Drawing stamp:
• These Record Drawings were prepared using information provided by others and
represent the as constructed conditions to the extent that documented changes
were provided for recording. The ENGINEER assumes no liability for
undocumented changes and certifies only that the documented changes are
accurately depicted on these drawings.
ENGINEER will submit a set of Final Drawings, modified and stamped as Record
Drawings for record storage. The ENGINEER may keep copies of the information
provided by the CITY for their files, but all original red-lined drawings will be returned
to the CITY.
Record Drawings will also be submitted in Adobe Acrobat PDF (version 6.0 or
higher) format. There will be one (1) PDF file for the Project. Each PDF file will
contain all associated sheets of the particular plan set. Sinqular PDF for each sheet
of a plan set will not be accepted. PDF files will be uploaded to the project's
Record Drawings folder in BIM360.

3.3 COORDINATION WITH RESIDENT PROJECT REPRESENTATIVE
ENGINEER assumes RPR services will be provided by others under separate contract with
City. The CITY's RPR will serve as the project facilitator, coordinating the flow of information
between ENGINEER, CITY, and the CONTRACTOR. ENGINEER shall coordinate with the
RPR on the following items.
- ENGINEER shall make clarifications and interpretations of the Contract Documents
to the RPR.
- ENGINEER shall coordinate with RPR to review the CONTRACTOR's monthly
payment applications.
- ENGINEER shall coordinate with RPR to review the CONTRACTOR's monthly
progress schedule updates.
3.4 STANDARD OPERATING PROCEDURES (SOPS)
ENGINEER shall update existing and prepare new Standard Operating Procedures (SOPs)
as applicable and related to the incorporation of the Project. The following existing SOPs will
be updated to include the improvements from the Project.

TASK 3.5 FLOODPLAIN LOMR
ENGINEER will complete the following to prepare the post-construction Letter of Map
Revision (LOMR) based on the following tasks and assumptions.
3.5.1 Kick-Off Meeting — ENGINEER will conduct kick-off meeting with the CITY for this
task.
3.5.2 As-Built Data Acquisition and Hydraulic Analysis
ENGINEER will complete the following tasks.
- Obtain as-built project data
- Build terrain model for incorporation into VC(A)-1 and WFTR hydraulic models
- Incorporate as-built terrain model changes into VC(A)-1 and WFTR hydraulic models
- Analyze impacts of constructed Project on WFTR and VC(A)-1 floodplains and
Floodways
- Develop floodplain working maps based on as-built models
- Technical review of models and maps
- Revise models and maps based on technical review
3.5.3 LOMR MT-2 Forms and LOMR Narrative Report Development
ENGINEER will complete the following tasks.

Assumptions:
- As-built conditions reflect ENGINEER's predictions of water surface elevations
(WSE's) developed during the design and do not result in a rise in elevations.
- The LOMR addresses the West Fork Trinity River (WFTR) floodway/floodplain only
and two LOMRs are not required, one for WFTR and one for VC(A)-1. VC(A)-1 is
predicted to have a reduction of 0.2-ft. The trigger point according to FEMA guidance
is a reduction of 0.5-ft. If LOMR for VC(A)-1 is required by City of Arlington (CoA), it
will be considered additional services.
- One Set of MT-2 forms will be required. FEMA guidance states that if more than one
drainageway is involved separate forms need to be submitted for each affected
drainageways, although the drainageways are covered by a single LOMR.
- ENGINEER will pay for application fee.
- CoA accepts our CDC Exemption comment responses and has no further concerns.
- The FEMA review cycles are kept to two reviews.
- CITY and CoA provides assistance with public notification. ENGINEER will identify
impacted private landowners, develop the notification letters and newspaper inserts
and the CITY and CoA will mail and distribute letters and pay for newspaper ads.
TASK 3.6 EXPLORATORY TEST PIT COORDINATION
As it pertains to the undocumented obstructions encountered at the site during the
geotechnical investigation program, ENGINEER will provide the following services in
conjunction with the Contractor's required exploratory test pits:
3.6.1 Exploratory Test Pit Site Visits
ENGINEER will make up to 4 site visits to the project site to observe the progress
and condition of various unknown buried obstructions within the construction work
area for the Project. Site visits shall be 2-hr in duration exclusive of travel time.
3.6.2 Evaluation of Conditions and Direction to Contractor
ENGINEER will review the observed conditions exposed in the test pits and evaluate
if changes to the Contract Documents are required.
ENGINEER will provide direction to the Contractor, as required, including what data
will be needed from the Contractor to authorize use of the allocated allowance bid
item.
TASK 3.7 CONFIRMATORY SUBGRADE TEST BORING REVIEW
As it pertains to the specified confirmatory subgrade test borings in Specification 31 20 00,
ENGINEER will provide the following services:

ENGINEER will make up to 3 site visits to the project site to observe the
performance of the test boring program and review Contractor's independent testing
agency's test boring logs and data acquisition procedures. Site visits shall be 2-hr in
duration exclusive of travel time.
Assumption: ENGINEER assumes Contractor will combine boring program such that
only 3 mobilizations are performed for the 5 test borings.
3.7.2 Review of Test Boring Data and Evaluation of Design Impacts
ENGINEER will review the final test boring logs, develop required geotechnical
laboratory test assignments, review the laboratory test results (provided by
Contractor's independent testing agency) and evaluate if changes to the Contract
Documents are required.
ENGINEER will provide direction to the Contractor, as required, including what data
will be needed from the Contractor to authorize use of the allocated allowance bid
item.
Within 1 week of receipt of all assigned laboratory test results per test boring
mobilization, ENGINEER will provide a technical memorandum summarizing the
findings of each testing boring, the laboratory test results and any recommendations
impacting the design of the Project.
Assumption: ENGINEER assumes only 3 technical memoranda will be required
based on the above assumption regarding only 3 test boring mobilizations.
TASK 3.8 LEVEE CERTIFICATION RECORD DATA COLLECTION
ENGINEER will provide the following services in conjunction with gathering data for future
VCWRF levee certification efforts:
3.8.1 Levee Observation Site Visits
For the duration of open excavation within 50 feet of the toe of the levee, ENGINEER
will provide weekly observations, and monthly thereafter, that the designated As-built
levee width has not been penetrated or breached, except as submitted via shop
drawings by the Contractor during performance of the work. Provide observations
during construction that excavation limits, as shown in the applicable approved shop
drawings, have not been exceeded. Provide observations that levee earthen or
structural reinforcing elements that have been submitted via shop drawings are
implemented during construction to prevent levee breach, and that they remain in-
place and are in a visually suitable condition for flood protection.
Assumption: ENGINEER assumes up to 30 levee observation site visits to the site
will be required. Site visits shall be 2-hr in duration exclusive of travel time. Visits to
the site for levee observations in excess of the specified number may be considered
ADDITIONAL SERVICES.
3.8.2 Review of Field Reports
Confirm that field reports documenting construction upon or under the levee
embankment are up to date and of sufficient detail to provide verification of

construction activities near the levee. Coordinate with design and construction team
on observations and develop plan of action as needed.
3.8.3 Final Report
Provide final report summarizing the levee observations collected during
construction, including ground surface surveyed elevations (perFormed by the
Contractor per Specification 31 09 00) that the levee height and slope, if altered
during construction, have been returned to pre-construction elevations. Based on
quality of data provided by the Contractor, any additional topographic survey
required in addition to the data collected and submitted by the Contractor may be
considered ADDITIONAL SERVICES.
Provide certification of levee restoration, including as-builts, construction reports, and
survey documentation outlining the force main crossing of the levee was designed in
accordance with FEMA 44 CFR Part 65.10 and constructed in accordance with the
Contract Documents.

RECOMMENDATION:
It is recommended that the City Council:
1. Authorize execution of Amendment No. 6 to City Secretary Contract No. 49049 in the amount of
$785,500.00, an engineering agreement with CDM Smith, Inc. for construction support services for
Village Creek Water Reclamation Facility South Influent Pump Station project for a revised contract
amount of $4,833,369.00;
2. Authorize execution of a contract with Crescent Constructors, Inc. in the amount of $19,993,000.00
for the Village Creek Water Reclamation Facility Grit Facility & South Influent Pump Station project;
3. Adopt the attached resolution expressing official intent to reimburse expenditures with proceeds
from future debt for the Village Creek Water Reclamation Facility South Influent Pump Station
project; and
4. Adopt the attached appropriation ordinance adjusting appropriations in the Water and Sewer
Commercial Paper Fund by increasing appropriations in the Village Creek Water Reclamation
Facility Grit Facility and South Influent Pump Station project (City Project No. 100075) for the
amount of $21,743,164.00 and by decreasing appropriations in the Unspecified project (City Project
No. UNSPEC) by the same amount.
DISCUSSION:
On May 2, 2017, Mayor and Council Communication (M&C C-28213) authorized an engineering
agreement with CDM Smith, Inc., (City Secretary Contract No. 49049), in the amount of $1,570,965.00 to
evaluate and design the Grit Removal Process at the VCWRF.
The agreement was subsequently revised by Amendment No. 1 authorized September 18, 2018 (M&C C-
28857) in the amount of $885,755.00 for the design of the South Influent Pump Station (PS), associated
sewer, force main and ancillary improvements. Amendment No. 2 was administratively authorized
February 7, 2019 in the amount of $71,993.00 for physical modeling to investigate and grit facility influent
splitter box configuration and the tie-in to the Headworks facility. Amendment No. 3 was authorized April 7,
2020 (M&C 20-0159) in the amount of $114,939.00 for physical modeling for the South Flow Pump
Station, additional odor control design and Grit Influent Splitter Box water jet system modifications.
Amendment No. 4 was authorized May 19, 2020 (M&C 20-0346) in the amount of $705,000.00 for
construction support services for construction of the new grit facility at VCWRF. Amendment No. 5 was
authorized September 22, 2020 (M&C 20-0700) in the amount of $699,217.00 for additional services that
included screen evaluation and design, odor control evaluation, emergency diversion design, structural
rehabilitation design, gate improvements, flood plain permit and geotechnical investigation.
As part of Amendment No. 6, the engineer will perform construction support services for construction of
the lift station that includes shop drawings and submittals reviews, change order review, record drawings,
update plant operational manual, prepare and submit floodplain LOM, prepare and submit levee
certification report.
Construction of the project was advertised for bid on March 4, 2021 and March 11, 2021 in the Fort Worth
Star-Telegram. On April 8, 2021, the following bids were received:

In addition to the contract cost, $564,804.00 is required for project management and inspection and
$399,860.00 is provided for project contingency.
This project will have no impact on the Water Department operating budget when complete.
This project is anticipated to be included in a future revenue bond issue for the Water & Sewer Fund.
Available cash within the Water and Sewer portfolio and the City's portfolio along with the appropriation
authority authorized under the Callable Commercial Paper Program (CP) will be used to provide interim
financing for this project until debt is issued. Once debt associated with this project is sold, bond proceeds
will be used to reimburse the Water and Sewer portfolio and the City's portfolio in accordance with the
attached reimbursement resolution. Under federal law, debt must be issued within approximately three
years in order for these expenses to be reimbursable. Adoption of the attached resolution does not
obligate the City to sell bonds, but preserves the ability of the City to reimburse itself from tax-exempt
bond proceeds.
