This AMENDMENT NO. 2("Amendment") to City Secretary Contract (CSC) No. 54648
(Agreement) is made and entered into by and between the CITY OF FORT WORTH ("City"), a home
rule municipal corparation organized under the laws of the State of Texas, acting by and through Fernando
Costa, its duly authorized Assistant City Manager, and Jacobs Engineering Group Inc. ("Engineer"),
acting by and through Scott Bussell, its duly authorized Vice President.
RECITALS
WHEREAS, On April 15 and April 22, 2020, a Request for Qualifications (RFQ) was advertised
for, among other services, Noise Mitigation Engineering Services at Fort Worth Alliance Airport
("Airport"), and on May 8, 2020, Engineer was selected;
WHEREAS, On September 15, 2020, City and Engineer entered into City Secretary Contract
("CSC") No. 54648 ("Agreement"), for Engineering and Other Noise Mitigation services for City Project
No. 102901, "Noise Mitigation Measures at Fort Worth Alliance Airport" ("Project");
WHEREAS, On May 4, 2021, City and Engineer agreed to Amendment No. 1 of the Agreement
for the creation of a website that would allow for the Project to continue while at the same time
preventing any potential spread of the novel Coronavirus which would (i) allow homeowners to obtain
more information about the program through virtual public meetings; (ii) provided homeowners a forum
to ask questions, and (iii) gave homeowners the ability to volunteer their homes to be tested;
WHEREAS, due to the results of the homes tested under the Agreement, and based on written
approval given by the Federal Aviation Administration ("FAA") on May 14, 2021, an additional 64
homes in the Rivers Edge Subdivision ("Rivers Edge") require acoustical testing;
WHEREAS, the costs to incorporate the Additional Services to the Agreement will be
$100,950.45 which includes the cost of the acoustical testing in the additiona164 homes; and
WHEREAS, City and Engineer have both agreed to (i) add the Additional Services to the Scope
of Services under the Agreement; (ii) update the compensation section of the Agreement to include the
additional $100,950.45 cost required for the Additional Services, bringing the total not to exceed amount
to $3,466,394.52; and (iii) incorporate the additional costs into the compensation schedule under
Attachment B of the Agreement.
NOW, THEREFORE, for good and valuable consideration, the receipt and adequacy of which are
hereby acknowledged, Lessor and Lessee hereby agree as follows:

The Agreement is hereby amended by deleting Article II, "Compensation and Term of
Agreement," in its entirety and replacing it with the following:
Article II
Compensation and Term of Agreement
A. The ENGINEER's compensation shall be in an amount not to exceed
$3,466,394.52 as set forth in Attachment B.
B. Unless otherwise terminated pursuant to Article VI. D. herein, this
Agreement shall be for a term beginning upon the effective date, as
described below, and shall continue until the expiration of the funds
or completion of the subject matter contemplated herein, whichever
occurs first.

Attachment A, "Scope of Services" of the Agreement is hereby amended by adding the
Additional Services listed in Exhibit A of this Amendment.
3.
Attachment B, "Compensation" of the Agreement is hereby amended by adding the additional
labor hours and cost breakdowns for the Additional Services in Exhibit B of this Amendment.

Except as expressly modified in this Amendment, all other terms and conditions of the
Agreement shall remain in full force and effect.

The statements set forth in the recitals above are true and correct and form the basis upon which
City and Engineer have entered into this Amendment.

All other provisions and conditions of the Agreement that are not expressly amended herein or
directly in conflict with the provisions and conditions of this Amendment shall remain in full force and
effect.

During the project mentioned above, there has arisen a need for an amendment to the scope
of work regarding Section 3.0 TESTING OF NON-COMPATIBLE STRUCTURES — RIVERS EDGE
SUBDIVISION. Per the approved FAA Acoustical Test Plan, the representative 10% sampling of
homes within five building styles tested has resulted in the need to test a total of 64 additional
homes within three building categories. This testing will need to be added to the scope of
work, which was not part of the original scope and fee for the project. The additional fee
associated with this testing is $100,950.45, which includes outreach to homeowners,
scheduling and testing of the 64 homes.
Please advise if anything further is required for this change order.

Testing of Additional Non -Compatible Structures Fee Proposal
TESTING OF ADDITIONAL NON-COMPATIBLE STRUCTURES - RIVERS EDGE SUBDIVISION
Acoustical testing, modeling, and support is undertaken by Landrum and Brown (L&B), as a
subcontractor to Jacobs. As part of the determination of eligibility, an additional 64 homes were
identified for individual acoustical testing to determine if the properties would be eligible for sound
insulation mitigation measures. Per the require�nents outlined in the AIP Handbook, the Federal Aviation
Administration (FAA) APP-400 provided written approval for this additional testing.
Additional Eligibility Testing
A total of 64 homes are eligible for the additional acoustical testing to determine if they qualify for the
sound insulation mitigation measures. The additional testing is scheduled for two (2) separate phases.
Phase 1 will take place the weeks of June 7 and June 14 and will test as many of the 64 properties . In
addition, homes that did not qualify from the initial Februarytesting will also be offered an opportunity
for a retest. Phase 2 will take place at a later date, either later this summer or early fall to accommodate
all the remaining properties. Testing of all 64 properties is anticipated to be completed by the end of
September.
L&B staff under a subcontract to Jacobs will perform the acoustical testing and assist with the public
outreach meetings. Eric Seavey, P.E., L&B Senior Consultant, will travel to AFW to undertake the
additional acoustical testing for Phase 1 and 2. Alan Hass, P.E., L&B Associate Vice President, will
travel to AFW to assist in the testing on June 8 and 9. The majority of the retests are being undertaken
on these days and the local FAA ADO staff are also anticipated to be present to observe some of the
testing. In addition, Alan Hass will be available the evenings of June 9 and 10 to participate in the public
outreach meetings to explain the eligibility requirements and to answer any questions that homeowners
may have regarding the testing procedures or their individual testing results.
The testing will be done in accordance with the provisions identified in Section 3.0 of the original scope of
work.
It is anticipated that the results of the acoustical testing from the weeks of June 7 and June 14 would be
available around July 1. A Property Eligibility Report (PER) will be prepared for the additional homes
tested.

54648, a Standard Agreement for Engineering Related Professional Services with Jacobs
Engineering Group Inc, to Increase the Contract Amount by $100,950.45 for the Noise
Mitigation Project at Fort Worth Alliance Airport
RECOMMENDATION:
It is recommended that the City Council authorize the execution of Amendment No. 2 to City Secretary
Contract No. 54648, a standard agreement for engineering related professional services with Jacobs
Engineering Group Inc., to increase the contract amount by $100,950.45 for the Noise
Mitigation project (City Project No. 102901) at Fort Worth Alliance Airport.
DISCUSSION:
On September 15, 2020, Mayor and Council Communication (M&C 20-0667), the City Council authorized
the execution of an engineering services agreement with Jacobs Engineering Group Inc. (Jacobs) in the
amount of $3,340,573.00 for the Noise Mitigation project (Project) at Fort Worth Alliance Airport (Airport).
On February 4, 2021, Amendment No. 1 to City Secretary Contract No. 54648 was executed in the amount
of $24,871.15 with Jacobs for additional services to the original agreement for software and website
development services to allow for virtual public meetings and the creation of a new website for the Project.
Amendment No. 2, if approved, will be for acoustical testing of additional homes in the Rivers Edge
subdivision (Rivers Edge). Rivers Edge is located approximately two miles north of the Airport and contains
a total of 264 properties. Of the total 264 properties, the homes were separated into five
different categories based on the number of stories and building styles. Thirty-seven properties have been
tested as part of the original agreement scope, which included a sampling of each category of homes. Of
the thirty-seven properties, twenty-four are located within the 65 day-night average sound level
(DNL) contour and thirteen were located outside the 65 DNL contour (see attached map). All twenty-four
homes that were tested within the 65 DNL contour resulted in being eligible for noise mitigation treatments.
Because of this, all 171 properties located within the 65 DNL contour are eligible for noise mitigation
treatments.
Of the thirteen properties tested outside the 65 DNL contour, 33\% of the sampled homes in Building
Category A and Category B tested eligible for treatment, while 0\% of the sampled homes in Category D
tested eligible for treatment. According to the Federal Aviation Administration (FAA), when less than 50\% of
the buildings in each sample category test below the required threshold for noise mitigation treatments, all
the remaining properties in each category must be tested. Because of this, sixty-four additional properties in
Rivers Edge require acoustical testing. Over 50\% of the sampled homes in Building Categories C and E
tested eligible for treatment; therefore, all remaining homes in those categories are eligible for noise
mitigation treatments and no further testing is required in those categories.
Since no City salaries will be charged to this grant, indirect cost recovery does not apply.
A waiver of the goal for Business Equity subcontracting requirements was requested, and approved by the
DVIN, in accordance with the applicable ordinance, because the purchase of goods or services is from
sources where subcontracting or supplier opportunities are negligible.
Fort Worth Alliance Airport is located in Council District 7.
FISCAL INFORMATION/CERTIFICATION:
The Director of Finance certifies that funds are available in the current capital budget, as previously
appropriated, in the Muni Airport Grants Federal Fund for the AFW Noise Mitigation Grant 201 project to
support the approval of the above recommendation and execution of the amendment. Prior to an
expenditure being incurred, the Aviation Department has the responsibility to validate the availability of
funds. This is a reimbursement grant.
