AN ORDINANCE VACATING AND EXTINGUISHING A 16 FOOT WIDE
ALLEY, LOCATED IN BLOCK 27, POLYTECHNIC HEIGHTS
ADDITION, AN ADDITION TO THE CITY OF FORT WORTH,
TARRANT COUNTY, TEXAS, AS SHOWN IN THE PLAT THEREOF
RECORDED IN VOLUME 63, PAGE 109 OF THE DEED RECORDS OF
TARRANT COUNTY, TEXAS, CONTAINING APPROXIMATELY 6,560
SQUARE FEET OR 0.151 ACRE OF LAND MORE OR LESS; PROVIDING
FOR REVERSION OF FEE IN SAID LAND; PROVIDING THAT THE
CITY SHALL RETAIN ALL EXISTING UTILITIES EASEMENTS;
REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND
PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That a sixteen-foot wide alley, located in Block 27, Polytechnic Heights Addition, an
addition to the City of Fort Worth, Tarrant County, Texas, as shown in the plat thereof recorded
in Volume 63, Page 109 of the Deed Records of Tarrant County, Texas, and containing
6,560square feet or 0.151 of land more or less, and as more specifically described in Exhibits A
and B attached hereto and incorporated herein by reference be and the same is vacated and
extinguished.
SECTION 2.
That the easement to the land in the above-described vacated alley right-of-way is hereby
released and shall revert to the adjacent owner as provided by law.
SECTION 3.
All existing utility easements shall be retained by the City until such time all utilities
located in that easement are relocated at the owner's expense.

SECTION 4.
That all ordinances or parts of ordinances in conflict herewith are hereby repealed.
SECTION 5.
That this ordinance shall take effect upon adoption.

Texas and being all of a 16-foot alley In Block 27,Polytechnic Heights Addition,an addition to the City of Fort Worth,
Tarrant County,Texas as shown on plat recorded in Volume 63,Page 109,Plat Records,Tarrant County,Texas(PRTCT)
and being more particularly described by metes and bounds as follows:(Bearings referenced to US.State Plane Grid 1983

BEGINNING at a found 1/2-inch iron rod for the southwest corner of the said 16-foot alley,same being the northwest
corner of Lot 9 of said Block 27 and being in the east right-of-way line of Vaughan Street(a 50-foot public right-of-way);
THENCE North 00'23'23"West,with the said east right-of-way line,a distance of 16.00 feet to set 5/8-inch capped Iron

(CD 8)Adopt Attached Ordinance Vacating an Alley in Block 27, Polytechnic Heights Addition Between Vaughn Boulevard and Collard Street to
be Replatted with the Adjoining Property for Student Housing and Parking for Texas Wesleyan University
RECOMMENDATION:
It is recommended that the City Council:
1.Adopt the attached ordinance vacating an alley in Block 27, Polytechnic Heights Addition between Vaughn Boulevard and Collard Street to be
replatted with the adjoining property for student housing and parking for Texas Wesleyan University;and
2.Waive any and all purchase fee value of the vacated land in accordance with City policy.
DISCUSSION:
Baird, Hampton and Brown, Inc.on behalf of Texas Wesleyan University,has requested vacation this alley to be replatted with the adjoining
property for student housing and parking.The City Plan Commission recommended approval of this request at its meeting on April 22,2020.An
acceptable final plat(FS-21-071)has been received in accordance with the Subdivision Ordinance.
The City of Fort Worth(City)originally obtained the above mentioned right-of-way through plat dedication.The City does not own any fee interest in
the right-of-way or own any property adjacent to the right-of-way and did not expend any City funds to purchase the right-of-way easement.In
accordance with the City's policy regarding street and alley vacation transactions approved by the City Council on March 6,2007,Mayor and
Council Communication(M&C G-15624),staff recommends waiving the fair market value or any portion thereof of purchase price of this right-of-
way easement for the alley.
This project is located in COUNCIL DISTRICT 8.
A Form 1295 is not required because:This M&C does not request approval of a contract with a business entity.
FISCAL INFORMATION/CERTIFICATION:
The Director of Finance certifies that approval of these recommendations will have no material effect on City funds.
