A RESOLUTION AUTHORIZING EXECUTION OF AN
ADVANCE FUNDING AGREEMENT WITH THE TEXAS
DEPARTMENT OF TRANSPORTATION IN THE APPROXIMATE
AMOUNT OF $8,514,451.00, OF WHICH CITY
PARTICIPATION IS APPROXIMATELY $1,616,719.00
PROVIDED BY TRANSPORTATION DEVELOPMENT CREDITS,
FOR THE UNIVERSITY DRIVE FROM TRAIL DRIVE TO WEST
ROSEDALE STREET PROJECT
WHEREAS, federal law establishes federally funded programs for transportation improvements
to implement its public purposes, and
WHEREAS, the Texas Transportation Code, Section 201.103 establishes that the State shall
design, construct and operate a system of highways in cooperation with local governments, and Section
222.052 authorizes the Texas Transportation Commission to accept contributions from political
subdivisions for development and construction of public roads and the state highway system within the
political subdivision, and
WHEREAS, federal and state laws require local governments to meet certain contract standards
relating to the management and administration of State and federal funds, and
WHEREAS, the Texas Transportation Commission has codified 43 TAC, Rules 15.50-15.56
that describe federal, state, and local responsibilities for cost participation in highway improvement and
other transportation projects, and
WHEREAS, the Texas Transportation Commission passed Minute Order Number 115291
authorizing the State to undertake and complete a highway improvement or other transportation project
generally described as pedestrian improvements including new and widened sidewalks, crosswalks,
wayfinding signage, traffic signals and landscaped medians; and
WHEREAS, the City of Fort Worth and Texas Department of Transportation have
negotiated terms of an Advance Funding Agreement for Local Government Contributions
for the University Drive from Trail Drive to West Rosedale Street Project, to include
traffic signal and pedestrian infrastructure improvements in the approximate amount of
$8,514,451.00, of which, federal participation is $8,083,595, state participation is
$430,856 and City of Fort Worth participation is approximately $1,616,719.00 to be
provided by Transportation Development Credits.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF FORT WORTH, TEXAS, THAT:
The City Manager is hereby authorized to execute an Advance Funding Agreement
for Local Government Contributions with the Texas Department of Transportation (CSJ:
0902-90-169) in the approximate amount of $8,514,451.00, of which City participation is
approximately $1,616,719.00 provided by Transportation Development Credits, for the
University Drive from Trail Drive to West Rosedale Street Project, to include traffic
signal and pedestrian infrastructure improvements.
Adopted this 81h day of June 2021 .

RECOMMENDATION:
It is recommended that the City Council:
1. Authorize the acceptance of federal funds from the Texas Department of Transportation in the amount up to$7,699,108.00 contributing to the
University Drive from Trail Drive to West Rosedale Street project;
2. Adopt the attached resolution authorizing the execution of an advance funding agreement with the Texas Department of Transportation for
University Drive from Trail Drive to West Rosedale Street project in the amount of$8,514,451.00 with Federal participation in the amount up
to$8,083,595.00 which includes$384,487.00 of State direct costs,additional State participation in the amount of$430,856.00 and City
participation through the use of available transportation development credits in the amount of$1,616,719.00;and
3. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Grants Capital Projects Federal Fund,
subject to receipt of the grant, in an amount up to$8,083,595.00 for the University Drive from Trail Drive to West Rosedale Street project
(City Project No. 102497).
DISCUSSION: ,
The purpose of this Mayor and Council Communication(M&C)is to adopt a resolution authorizing the execution of an advance funding agreement
(AFA)with the Texas Department of Transportation(TxDOT).The AFA details the responsibilities of both the City of Fort Worth and TxDOT in the
execution and implementation of the project.
This project uses transportation development credits(TDCs)for the City participation costs.The scope of work for the project consists of
pedestrian improvements including new and widened sidewalk,wayfinding signage,traffic signals and illumination improvements.The University
Drive project will connect pedestrians between the Museum District,Botanical Garden and Trinity Park.The project limits span just under a mile
along University Drive from Trail Drive to West Rosedale Street.The project will include a five-foot wide sidewalk along the west side of University
Drive,a median with landscaping, irrigation and appropriate turn breaks and American Disabilities Act(ADA)accessible bus stops from Trail
Drive to Rock Springs Road.There will also be landscape and irrigation improvements between Rock Springs Road and Interstate Highway(IH)
30.The project will include crosswalk and traffic signal improvements at the intersection of University Drive and Trail Drive, Botanic Garden
Boulevard,and Rock Springs Road.The illumination improvements will be under the three bridges associated with the IH 30 and Chisholm Trail
interchanges.This AFA approves funding for design,construction,local government project management and state direct costs for the project.The
anticipated bid date of the project is July 2024.
The City will be responsible for 100%of project overruns.The initial payment to TxDOT for the City participation is$0.00. TxDOT will be
reimbursing the City$8,083,595.00 for engineering,construction and state direct costs for the project.

FISCAL INFORMATION/CERTIFICATION:
The Director of Finance certifies that upon approval of the above recommendations,adoption of the attached appropriation ordinance and award
of the grant,funds will be available in the current capital budget,as appropriated, in the Grants Cap Projects Federal Fund for the University Dr
Ph2 Trail Dr-130 project. The Transportation & Public Works Department (and Financial Management Services)will be responsible for the
collection and deposit of funds due to the City. Prior to expenditure being incurred,the Transportation & Public Works Department has the
responsibility to validate the availability of funds.This is a reimbursement grant.
