FY 2013 INTERLOCAL AGREEMENT
CITY OF FORT WORTH
BACKGROUND
Whereas the Tarrant County, Texas ("COUNTY") recognizes a need to reduce the
number of driving while intoxicated cases countywide;
Whereas the COUNTY desii�es to pay for laboratoiy testing of blood sample talcen in
conjunction with the Tarrant County No Refusal Program, and the City of Fort Worth's
("CITY") Crime Laboratoiy desiz•es to perform the laboratory testing of blood samples talcen in
conjunction with the Tarrant County No Refusal Program;
Whereas this agreement is by and between the COUNTY and the CITY and in aid of the
Texas Depai-tment of Transportation Grant Agreement No. 2013-TarrantC-G-1 YG-O l 12, titled:
Tarrant County No Refusal Program; and
Whereas the COUNTY and the CITY find that this agreement serves a public purpose,
find that the consideration is adequate, find that this agreement allows for the efficient pi•ovision
of such services by the CITY, and find that this undertaking is necessary for the benefit of the
public.

1. The term of this agreement is fi•om October l, 2012 through September 30, 2013 with
search warrant blood draws talcen during the dates and times listed below.
Thanksgiving - Wednesday 8:00 p.m. through Sunday 4:OOa.m. 11/21-25/2012
Christmas — Sunday 8:OOp.m. through Tuesday 4:OOa.m. 12/23-25/2012
New Year's Eve — Monday 8:OOp.m. through Tuesday 4:OOa.m. 12/31/12-01/O1/2013
Super Bowl — Sunday 8:OOp.m. through Monday 4:OOa.m. 02/03-04/2013
Memoi•ial Day Weelc-end — Friday 8:OOp.m. through Monday 4:OOa.m. OS/24-28/2013
Independence Day — Wednesday 8:OOp.m. tluough Sunday 4:OOa.m. 07/03-07/2013
Labor Day Weelc-end — Friday 8:OOp.m. through Monday 4:OOa.m. 8/30/13-09/02/2013
2. The CITY will perform laboratory testing for alcohol of blood samples obtained and
submitted in accordance with the Tarrant County No Refusal Program.
3. The COUNTY will pay the CITY within 30 days of receipt of the billing for services
performed pursuant to this agreement. The billing and reporting must be received by the
Business Office of the District Attorney's Office within 30 days of performance of
service during the agreement term. Billings will be for actual expenses only at a rate of
$90.00 per test.

4. The CITY will maintain accurate programmatic and fiscal records regarding the testing
services provided and funds expended, if any, and will render to the COUNTY and the
Business Office of the District Attorney's Office, a detailed report within 30 days after
the end of the month following the performance of the service. Furthermore, the
COUNTY reserves the right to audit those records upon which these funds are expended.
5. The COUNTY may terminate this agreement upon 30 days written notice, with or
without cause, and at no penalty or expense to the COUNTY. CITY will be reimbursed
for any services rendered up to the iinal termination date of the agreement.
6. The CITY and its sub-contractors, if any, agree to comply with all local, state and federal
laws, rules and regulations to include all standard assurances stated in Texas Department
of Transportation Grant Agreement No. 2013-TarrantGG-lYG-0112 to the extent
applicable through the COUNTY as sub-grantee to the CITY as a sub-contractor. Said
compliance includes certification that:
A. The CITY and its sub-contractors, if any, shall not discriminate on the basis of race,
color, national origin, or sex in the performance of this agreement. The parties shall
carry out applicable requirements of 49 CFR Part 26 in the award and administration
of USDOT-assisted contracts. Failure to carry out these requirements is a material
breach of this agreement, which may result in the termination of this agreement or
such other remedy as the recipient deems appropriate.
B. Th� ('I'I'Y and its sub-contractors, if any, are not currently debarred, suspended, or
otherwise excluded from or ineligible for participation in Federal Assistance
Programs under Executive Order 12549.
C. The CITY and its sub-contractars, if any, certify to the best of the signatory's
knowledge and belief that:
1. No federally appropriated funds have been paid or will be paid by or on behalf of
the CITY or its sub-contractors, if any, to any person for influencing or
attempting to influence an officer or employee of any federal agency, a Member
of Congress, an officer or employee of Congress, or an employee of a Member of
Congress in connection with the awarding of any federal contract, the making of
any federal contract, the making of any federal loan, the entering into of any
cooperative agreement, and the extension, continuation, renewal, amendment, or
modification of any federal contract, grant, loan, or cooperative agreement.
2. If any funds other than federal appropriated funds have been paid or will be paid
to any person for influencing or attempting to influence an officer or employee of
any federal agency, a Member of Congress, an officer or employee of Congress,
or an employee of a Member of Congress in connection of this federal contract,
grant, loan, or cooperative agreement, the party to this agreement shall complete
and submit Standard Form - LLL, "Disclosure Form to Report Lobbying," in
accordance with its instructions.

7. County may use additional providers in accomplishing the purposes of this grant.

HEARING:
SUBJECT: Authorize Execution of an Agreement with Tarrant County to PerForm Blood Analysis for
the Fiscal Year 2013 Texas Department of Transportation's Tarrant County No Refusal
Program in the Amount of $14,760.00 and Adopt Appropriation Ordinance (ALL COUNCIL
DISTRICTS)
RECOMMENDATION:
It is recommended that the City Council:
1. Authorize execution of an Agreement with Tarrant County to perform blood analysis for the Fiscal
Year 2013 Texas Department of Transportation's Tarrant County No Refusal Program grant in the
amount of $14,760.00; and
2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in
the Grants Fund in the amount of $14,760.00.
DISCUSSION:
The Texas Department of Transportation (TxDOT) grants have several program areas including
alcohol and other drug countermeasures. The goal of the No Refusal Program is to reduce the
number of alcohol impaired and driving under the influence of alcohol and other drug-related crashes,
fatalities and injuries. Through grant funds, jurisdictions within Tarrant County are able to expand the
No Refusal Program. The No Refusal Program weekends will now include Thanksgiving, Christmas,
New Year's Eve, Super Bowl, Memorial Day, Fourth of July and Labor Day. The City of Fort Worth's
Crime Laboratory may receive funds to process samples for blood-alcohol analyses during the
weekends of the No Refusal program.
FISCAL INFORMATION/CERTIFICATION:
The Financial Management Services Director certifies that upon approval of the above
recommendations, receipt of the grant, and adoption of the attached appropriation ordinance, funds
will be available in the current operating budget, as appropriated, of the Grants Fund.
