SECOND AMENDMENT TO CITY SECRETARY CONTRACT NO. 44523
WHEREAS the City of Fort Worth ("City") and Western Economic Services Limited
Liability Company ("Consultant"), made and entered into City Secretary Contract No. 44523
("Contract") for Consultant to prepare an Analysis of Impediments to Fair Housing Choice
("AI") as part of the City's preparation of its 2012-2018 Consolidated Plan;
WHEREAS, the Contract as amended provided that all services provided by Consultant
were to be completed by December 30, 2013 but City and Consultant wish to further extend the
time for performance to January 30, 2014 in order to have additional time for citizen
participation including public hearings and other public comment;
WHEREAS, City and Consultant agree to revise the Fee Schedule to allow for additional
costs of the Consultant's presentation to the Fort Worth City Council, and to match the extended
time for performance; and
WHEREAS, it is the mutual desire of City and Consultant to amend the Contract to meet
Contract objectives.
NOW, THEREFORE, City and Consultant hereby agree to further amend the Contract as
follows:
I.
Attachment "A" - Scope of Services attached to the Contract is replaced with the
attached Attachment "A" — Scope of Services Revised 12/2013 and Attachment "B" Fee
Schedule attached to the Contract is replaced with the attached Attachment "B" Fee and
Payment Schedule Revised 12/2013.
II.
AI completion is extended from September 30, 2013 to January 30, 2014.
III.
All other terms and conditions of the Contract not amended herein remain unaffected and
in full force and effect, are binding on the Parties and are hereby ratified by the Parties.
Capitalized terms not defined herein shall have meanings assigned to them in the Contract.

FEE AND PAYMENT SCHEDULE REVISED 12/2013
AMOUNT TASK DUE DATE DELIVERABLE
$12,462.50 Phase 1 July 15, 2013 Phase 1 deliverables include the survey instrument, orientation
meeting agenda, collection and submittal of progress review
materials associated with the economic and demographic data.
Note: The City would create the email list and distribute the
survey announcement, which would have the suivey linlc
embedded in the email.
$12,462.50 Phase 2 August 30, 2013 Phase 2 deliverables include continuing data collection efforts,
Facilitation of Three Focus Groups, and submission of
progress review memos about collection and analysis of
economic and demographic data, HMDA and CRA data, and
the results of the progress review telephone conference.
$ 6,231.25 Phase 3 September 30, 2013 Phase 3 deliverables include conclusion of base data collection
and preliminary analysis of this data, preliminary analysis of
online survey results, preparation of a summary report of the
results of the Fair Housing Focus Groups, and preparation of a
draft power point of initial findings for City review and
approval prior to final presentation, and final presentation for
the two or three Housing Forums.
$ 6,231.25 Phase 4 October 30, 2013 Phase III deliverables include finai analysis of the oniine
survey responses, complete analysis of all Census data, with
corresponding geographic maps, hold a debriefing/strategy
meeting/telephone conference and submit a progress review
memo summarizing the preliminary impediments and actions
to consider.
$ 6,231.25 Phase 5 November 30, 2013 Phase IV deliverabies include the preliminary draft Analysis of
Impediments report for City review, with additional telephone
conference as necessary; Prepare draft and final presentation
for City review and approval; malce final presentation of
findings to venue selected by City (proposed for second
Wednesday of November)
$ 6,231.25 Phase 6 January 30, 2014 Prepare and submit the final draft Analysis of Impediments
report for public comment period, malce presentation to the
City Council, receive and incorporate comments from the City
and the public, finalize the report, submit the final report to
City, and the final billing.
Total Cost $53,475.00
City Responsibilities to Support the Consultant's Efforts:
- Organize 3 Focus Groups, for Rental Housing, Homebuyer Housing, and Development Issues — Recruit
group members
- Organize and do community outreach for at least 2 and no more than 3 Housing Forums;
- Act as a resource for local resources and information, identifying contact points for interviews or data
collection as needed to help ensure complete and appropriate information is obtained
- Collect and transmit public comment regarding published draft report, for inclusion in final report.

Authorize Amendment No. 2 to the Consultant Agreement with Western Economic
Services LLC, City Secretary Contract No. 44523, to Extend the Term and Add $4,225.00
for a Total Contract in the Amount of $54,075.00 to Prepare an Analysis of Impediments i
Fair Housing Choice as Required by Federal Regulations (ALL COUNCIL DISTRICTS)
RECOMMENDATION:
It is recommended that the City Council authorize the execution of Amendment No. 2 to the Consultan
Agreement with Western Economic Services LLC, City Secretary Contract No. 44523, to extend the te
performance and add additional payment in the amount of $4,225.00 for a total contract in the amount
$54,075.00 to prepare an Analysis of Impediments to Fair Housing Choice as Required by the United
States Department of Housing and Urban Development as a condition of receiving federal grant funds
DISCUSSION:
The City is required to certify to the United States Department of Housing and Urban Development (HI
the annual grant Agreement with HUD that it is affirmatively furthering fair housing. It also must includ
certification in its submission of the City's Consolidated Plan and Annual Action Plan to HUD. This
certification includes a requirement that the City prepare a research and planning document called an
Analysis of Impediments to Fair Housing Choice (AI). The AI summarizes conditions in the local hous
market that may affect fair housing choice and outlines specific actions that the City may take to addre
these impediments.
The City conducted a Request for Proposals (RFP) process in March 2013 and selected Western Eco
Services, LLC (WES) to prepare the AI, based on the consultant's extensive experience in the field. A
consultant Agreement for $49,850.00 was executed with WES in June 2013. The Agreement was
amended in July 2013 to extend the term through December 2013 to allow additional time for public in
via an on-line survey and two public forums before the Human Relations Commission and the Commu
Development Council.
The Draft Analysis of Impediments to Fair Housing Choice is scheduled to be completed and made
available for public review on December 9, 2013 and a presentation on this draft document will be ma�
the Community Development Council at its regular meeting on December 11, 2013. Further public
comment on the draft document is being solicited by notices of a 30-day public comment period in loc
newspapers. The draft document will also be on the City's website.
Staff recommends an Amendment to extend the consultant Agreement to January 30, 2014 and to inc
funding in order to pay for the additional cost of the consultant making a presentation of the findings oi
fair housing study to the City Council on January 7, 2014. The contents of the presentation relate dirE
to information which City Council has requested regarding housing needs in the City.
