WFiEREAS, the City of Fort Worth (CITY) and Freese and Nichols, Inc., (ENGINEER) made and entered into City Secretary Contract No. 44486, City Project No. 01776, (the CONTRACT) which was authorized by M&C No. C-26249 on the 14th day of May, 2013 in the amount of $ 341,607.00; and WHEREAS, the CONTRACT involves following project: CAH - Wes tern Avenue Wa ter, Improvements; and engineering services Sewer, Drainage and for the Pavemen t WHEREAS, it has become necessary to execute Amendment No. 1 to the CONTRACT to include an increased scope of work and revised fee. NOW THEREFORE, CITY and ENGINEER, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the CONTRACT: 1. Article I of the CONTRACT is amended to include the additional engineering services specified in a proposal dated December 1 7, 2013, a copy of which is attached hereto and incorporated herein. The cost to City for the additional design services to be performed by Engineer totals $173,720.00. (See Attached Funding Breakdown Sheet, Page -3-) 2. Article II of the CONTRACT is amended to provide for an increase in the fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall be an amount of $515,327.00. 3. All other provisions of the Contract, which are not e�ressly amended herein, shall remain in full force and effect. Senior Professional Engineer City of Fort Worth, Transportation and Public Works 1000 Throckmorton Fort Worth, Texas 76102 Re: 01776 CAH Western Drainage Improvements Project—Amendment No. 1 Dear Mr. Owen, innovative approaches Practical results Outstanding service Additional services have been requested for the Western Drainage Improvements project (Project No. 01776). The additional scope of work is described below and a detailed fee breakdown is attached. 1. Proiect mana�ement and meetin�s a. Additional project management associated with increased scope items noted below. Submittals will be prepared for the additional scope items at 60%, 90% and 100% in accordance with the original contract. b. The original contract scope included a single design public meeting. That meeting has already been held and an additional design public meeting is planned between 60% and 90% design. In addition, coordination effort with the neighborhood association regarding pond maintenance is included. c. An additional four (4) project meetings are included in this scope. Two (2) of these meetings are associated with the detention design, and two (2) are with the water department. 2. Surface Detention Desi�n —The original design contract included conceptual 30% design of the surface detention basin at the corner of Hulen and Bryce. The property for this detention basin has been acquired, and the City is ready to move forward to final design on this portion of the project. a. Final Civil Design -The City requested that the detention basin have vertical walls on three sides to increase the available detention volume. FNI will prepare final civil and structural design for b. c. the detention pond including the proposed retaining walls, grading plans, overtopping protection, landscaping plans, and inlet and outlet details. If a proprietary wall system (such as living walls or modular block walls) is selected, a performance specification for the final wall design will be developed and incorporated in the contract documents. Renderings - FNI prepared a conceptual rendering of the detention pond for the first public meeting. FNI will update the rendering for the second public meeting. Amenities design - This scope assumes that simple amenities including a walking trail, bench, and fencing is included in the design and will be shown on the landscaping plan. Design of any additional amenities such as a pavilion or shade structure will be considered an additional service. 3. Sewer desi�n - Additional sewer design is required including the following: a. The original scope included design of 1,200 feet of sewer along Western and Bryce. Preparation of plan and profile drawing for existing sewer in Western alley to show service tie-in locations. Services will be shown in plan view only. c. Design of 18 sanitary sewer services relocations from the street side to the alley. d. Prepare 8.5"x11" figures for each of the 18 properties requiring sanitary sewer services relocations. The figures will depict the route of the sewer relocation and the private improvements to be relocated and/or repaired on each property. FNI will prepare 8.5"x11" figures and Temporary Right of Entry forms for each property and provide to the City. The City will mail the forms to the property owners. The 8.5"x11" figures will be included in the project manual. e. Hold a meeting with City and each property to review sanitary sewer relocations. 4. Draina�e desi�n —Additional design effort for the drainage design is required as follows: a. Additional analysis to evaluate drainage detention options in Bryce. b. Revisions to drainage design in Bryce including structural design for additional junction boxes. c. Design of a custom storm drain junction box in Carleton alley at the sanitary sewer conflict. 5. Geotechnical investi�ations and analysis—Additional geotechnical investigations and analyses are required to support the detention design as follows: a. Three (3) 30 ft soil borings will be taken on the site of the detention pond. b. Once the geotechnical study is completed, FNI will review the geotechnical report and develop parameters for use during the analysis of the proposed retaining walls for the proposed basin. c. After a retaining wall system has been selected, FNI will perform a stability analysis for the proposed geometry. This will include an external stability analysis (sliding, bearing and overturning failure) and a global stability analysis (rotational failure). FNI will develop minimum wall geometry requirements during the stability analysis. d. FNI will provide a technical memorandum report summarizing the results ofthe review and analysis (as detailed above). The report will include minimum geometry requirements and material strength requirements for use by the wall designer, as appropriate. 6. Field Survev - Additional field survey is needed to support the additional design scope. The following areas will be surveyed by EBG as a subconsultant to FNI: a. The backyards along Western Avenue where sewer services are being rerouted b. Western Alley to support the tie in of the re-routed services c. Carleton Alley to support the lowered and replaced sewer line d. Walgreens property between the building and the Bryce ROW. This survey is needed to ensure that any improvements along the edge of the ROW do not impact Walgreens. 7. SUE —Additional subsurface utility engineering is needed to support the additional design scope. This work will be done by The Rios Group as a subconsultant to FNI. The following areas are included: a. Level B SUE in Carleton and Western alleys to locate subsurface utilities, especially the gas lines b. 6 level A SUE locations to confirm elevations of existing infrastructure that are critical to the design. 8. Bid and Construction Phase—Additional effort has been included for bid and construction phase associated with the increased scope of work. DISCUSSION: The Amendment recommended by this Mayor and Council Communication will provide additional engineering services not included in the original contract scope. The additional services are primarily needed to design detention near the intersection of Hulen and Bryce streets. Detention at this location did not become a possibility until after the original design Agreement was awarded. Also, the Water Department identified additional sewer revisions after the award of the original Agreement. PROJECT AMOUNT M&C NO.
