3.1. Rent uncler Initial Term.
Lessee shall pay Lessor as iiionthly rent for tlie Premises the suui of Oue Hundred

Lessor's published Schedule of Rates and Char�es in effect as of the Effeetive

Lessee ��xees and coveriants that it has inspected the Preinises anci is fiilly advised

coticei7iing the conctition of the Pretnises. Lessee �ccepts the Preriuses in its
presetit condition as satisfactoi�y for all puiposes set forth in this Lease.

Lessee shall ha�re the right to use the desimlated ��ublic parking areas to tlie e�teirt
available ai�d in accordance ��rith policies establisiied b�� the �iiport S�Tsteuis Director or
autliorized representative.
8. L?SE E�F PREMISES.
L.essee a��ees to use tl�e Preiuises e�clusi��el_y for aviation or aviation-related
can�iiercial acti�Tities. It is specificallu a�reecl alid stipulated that the follo��Tui�
concessions are prohit�ited tuider tlus Lease, unless specificall�� a��proved b�� the A.iiport
SS�steuis Director or atrtliorized re�resentative: (i) �ound i�ansportation for hi��e; (ii}
illotor ��elucle rental, ii�chid'uig ta�i �id luiiousine se1-�Fice; (iii) foocl sales; (i�F) barber aud
valet sei-��ices; (z�) alcoholic beverage sales; and (��i) aviatiorl-r�lated sales of pilot
sup��lies.

Lessee �iay, at its o«�n e�pense and ��tith the prior ���i7tten a��roval of the �iiport S��sterus
Director or autliorized re��resentative, create, iristall and rllauitaiu sig-�is in the Teriuinal
indicatiug Lessee's busii�ess. Such sigYis, hoiuever, i�ust be in keeping with tl�e size,
color, location aud inaiuler of dis��lay of other signs tlu-ou�hout the TezYiiinaL In additiou,
I,essee may, at its o��� e�pelise, nlake, install and maintaiu a si�l outside the Tez�ii�ial an
Lessor's pro�erty subject to prior t�Fritten a�praval by tlie �upoi-t SS�steins Directoi� or
autliarized representati�re as to the si�'s �laceliient, appearaiice, conshliction, and
canfoi7i�it�- ���ith applicable City Code restrictians.

or other st�l�chire ��rhicli. iu tlie opinion of Lessor, tivould Iiuiit the usefiilness of
tlie Aiiport, constihite a hazard to aircraft or dimi�iisll the capability of existin� or
fiihire avi�ational or navigational aids used at the .�ii�ort.
10.3. Lessor resei-��es the night ta close teuiporai7ly tlie Aii�ort or any of its facilities
for maiiitenance, iiupro��ements, safen� ar securit�� of eitlier the Ai�port or the
public, or for any other cause deemed i�ecess�y l��r Lessor. I�i tliis e��ent, Lessor
shall ui no i�Tay t�e liable for any da�iages asserted t�y Lessee, includiu�, I�ut �ot
Iuruted to, dama�es fi�a�i aii alleged dislliptio� of Lessee's busiiiess operations.
10.4. Tlus Lease shall be subordivate to the pro�Tisions of an_y e�isti�i� or fimire
agree�iient l�eh��eeti Lessor and tlie Ui�ited States Govenuilent ��Fl�ich relates to tlie
operation or iliaintenance of the Au�ort and is requi�ed as a conditioii for the
e�I�endihue of federal fiuids for the de�=elo�ment, inaintenance or repair of
Aii�ort iilfrasttlicttue.
10.5. Dt�i7ng any ���ar or u�tional einergency°, Lessor sliall llave tlie iuglit to lease an�-
part of tlie �4iiport, includi�ig its landiria area, to the Uruted States Govei7�zent.
In tlus e��ent, aiiy pro�Fisioils of this i�istilui�ent ��=lucli are inconsistent v�£ith the
pro�Tisions of tlie lease to ttie Govel7uiient shall be suspendec�. Lessor shall iiot be
liable for ariy loss or dazua�es alleaed U�� Lessee as a result of this action.
Hou�e��er, nothing i�i tl�is Lease sliall prevent Lessee fionl pursuitig airy rights it
iiia�� ha��e for reimburseinent fi-oli� tlie Uliited States Govei7unent.
10.6. L�SSOT covenants and aaees that during the terin of tlus Lease it will o��erate
aiid uiaintai�i tlie �iiport anci its facilities as a�ublic aiiport colisistei�t «Fith ai�cl
ptusuant to the Sponsor's Assurances gi�Ten vy Lessor to t�ie Uiuted States

additional insured and co�ret�ig all �ublic risks related to the leasing, use.
occupanc��, nZainteiiance, e�istence or laca�ion of fhe Premises. Lessee sliall
obtain the required insluance in accordance ���ith E�hibit "B", the "Cit�T of Fort
��Torth ,���iation I�isurance Reqtiireineiits" attached liereto azid inade part of this
Lease for all �t�poses.
In addition, Lessee silall be respoiisible for all insurance to aiiy- �pprotrecl
constiliction. iznpro��eiuents, riiodifications or reiiovatioris on or to t11e Preliuse5
and for persoiial properry of Lessee or in Lessee`s care, custad�' QI' COI1tT01.
41.2. �cliustments to Reetuirec� Covera�e anc� Limits.
I�isuralice requu�ements, inchiding additiorlal n��es and limits of coverage and
increased limits on e�isting coverages, are subject to chan�e at Lessor's o��tiou,
and Lessee will �ccordingly coinply ��7ith sucli ne��� reqt�ireinel�ts ��rithin tlii�-t�- (30)
da��s follo��Tui� iiotice to Lessee.
11.3. Cet�ificates.
As a coiidition precedeiit to the effectivei�ess of t�iis L,ease, Lessee sl�all fiii7ush
Lessor ��ritli a certificate of instua�ce si�ecl b5� the t�ncien�c�riter as proof tliat it has
abtained tlie ty�es and amounts of iiisurance co��era�e rec�uired herein. Lessee
llereby coveilallts and a��ees that not less than thirty- (34) d����s prior to the
e��iratioii of any insurance polic}- required liereunder, it silall provide Lessor ��ritli
a ne��� or rene�val cei-tificate of i�stuaiice. I�i additiol�, Lessee shall, on clein�nd>
provide Lessor �rith e`�icieiice that it has niaintained stzch c��yerage izi fiill force
and effect.

conh�actor as to all i�ights and piYvile�es �rautecl herein, aud not as ail agent, re�resentative

a�eratiarls and activities ou tlie Pi�eiiuses and sliall Ue sc�lel�� res��onsiUle for the acts aud
omis�ions of its officers, agents, sei-��auts, ei�ployees, canhactors_ subcor�hactors,
patrons, licensees and iiivitees. Lessee acl�lowledaes that the doch�ue of
�•espo�ic�ent su�e.rior� shall liot a�ply as bensTeen Lessor and Lessee, its ofiicers, ageuts,
