AN�NDMENT No . 2
TO CITY SECRETARY CONTRACT No. 43361
WAEREAS, the City of Fort Worth (CITY) and URS Corporation,
(ENGINEER) made and entered into City Secretary Contract No. 43361, (the
CONTRACT) which was authorized by M&C No. C-25611 on the 15th day of May,
2012 in the amount of $ 485,932.58; and
WHEREAS, the CONTRACT was subsequently revised by: Amendment Number
1 in the amount of $28,660.00 which was administratively authorized on
7tn day of January, 2013.
WHEREAS, the CONTRACT involves engineering services for the
following project:
GARDEN ACRES BRIDGE PHASE II; and
WHEREAS, it has become necessary to execute Amendment No. 2 to the
CONTRACT to include an increased scope of work and revised fee.
NOW THEREFORE, CITY and ENGINEER, acting herein by and through their
duly authorized representatives, enter into the following agreement,
which amends the CONTRACT:

Article I of the CONTRACT is amended to include the additional
engineering services specified in a proposal dated August 20, 2013, a
copy of which is attached hereto and incorporated herein. The cost to
City for the additional design services to be performed by Engineer
totals $74,500.00. (See Attached Funding Breakdown Sheet, Page -3-)
2.
Article II of the CONTRACT is amended to provide for an increase in
the fee to be paid to Engineer for all work and services performed under
the Contract, as amended, so that the total fee paid by the City for all
work and services shall be an amount of $589,092.58.
3.
All other provisions of the Contract, which are not expressly
amended herein, shall remain in full force and effect.

Dear Mrs. Smith:
URS is pleased to present our scope of work and fee for the above referenced project.
The supplemental scope of work and proposed supplemental fee is as follows:
Perform a detailed Level of Service (LOS) traffic analysis using the traffic data and projections
approved by the State's Transportation Planning and Programming Division
Prepare the design schematic for the locally preferred alternative. The horizontal and vertical
alignments will be at a scale of 1"=100' (horizontal) and 1"=10' or 1"=20' (vertical). All geometric
designs will be in conformance with the State's Roadway Design Manual except where variances
are permitted in writing by the State. The schematic layout will include the information necessary
for proper review and evaluation.
Perform additional survey, prepare additional sheets and modify plans for 90% submittal, as
necessary, to include TxDOT requested deceleration right turn lane for southbound frontage road
of IH 35 W to McPherson Boulevard to be included in the Phase II set of Plans, Specifications
and Estimates (PS&E).
Formalize the Categorical Exclusion (CE) documents required to meet all TxDOT and NEPA
requirements; including additional documentation for funding/planning consistency, existing &
proposed facility descriptions, socioeconomics/census evaluation, and indirect & cumulative
impacts analysis. Provide CE document updates throughout the process regarding; funding
documentation and STIP/DCIS consistency, ROW activities documentation, public involvement
activities documentation, design changes/additions.
The plans will be designed according to City of Fort Worth and TxDOT Fort Worth District
standards and construction specifications.
For more detailed information regarding these services please see Attachment A. The
supplemental fee for this scope of services is $74,500.00.

Scope for Engineerinq Desiqn Related Services for Street Improvements
The scope set forth herein defines the work to be performed by the ENGINEER in
completing the project. Both the CITY and ENGINEER have attempted to clearly define the
work to be performed and address the needs of the Project.
OBJECTIVE
Prepare Level of Service (LOS) traffic analysis and design schematic for the Garden Acres
Drive and bridge over IH 35 W. Add a deceleration right turn lane for southbound frontage
road of IH 345W to McPherson Boulevard to be included in the Phase II set of Plans,
Specifications and Estimates (PS&E). The plans will be designed according to City of Fort
Worth and TxDOT Fort Worth District standards and construction specifications. TxDOT
District standards and specifications will govern for the final PS&E submittal since the
project will ultimately be bid and constructed by TxDOT. Formalize the Categorical
Exclusion (CE) documents required to meet all TxDOT and NEPA requirements.

TASK 1. DESIGN MANAGEMENT.
ENGINEER will manage the work outlined in this scope to ensure efficient and effective use
of ENGINEER's and CITY's time and resources. ENGINEER will manage change,
communicate effectively, coordinate internally and externally as needed, and proactively
address issues with the CITY's Project Manager and others as necessary to make progress
on the work.
1.1. Managing the Team
• Prior to the LOS, Schematic 100 percent submittals, the ENGINEER shall complete
QA/QC reviews in accordance with established standards and requirements.
ASSUMPTIONS
• CADD drawings shall be completed in MicroStation and shall follow CADD
standards supplied by the City

TASK 2. LOS TRAFFIC ANALYSIS.
Based on discussions with the Client, we understand TxDOT has required that a schematic
and level of service study be prepared for the proposed work at the IH-35W and Garden
Acres interchange ("Project"). This scope of services will provide the Client with the level of
service study required by TxDOT.
2.1. Data Collection shall include the following:
• Per discussions with TxDOT staff, traffic counts collected in 2011 at the interchange
will be utilized for this study.
• ENGINEER will gather available historical traffic count data from the City of Fort
Worth (City), TxDOT, and NCTCOG to be used to determine an annual growth
factor.
• ENGINEER will obtain proposed paving, striping, and signing plans for the Project
from the Client.
2.2. Level of Service Analysis shall include the following:
• Per discussions with TxDOT, two scenarios will be evaluated: Build Out (2014) and
Future (2036).
• ENGINEER will apply a growth factor to the 2011 traffic counts to estimate traffic
counts for the 2014 and 2036 scenarios.
• ENGINEER will develop SynchroT"' models of the Project based on the proposed
geometry, lane uses, and traffic signal information.
• ENGINEER will use the SynchroT"' model to obtain the LOS results for AM and PM
peaks for the 2014 and 2036 scenarios.
• ENGINEER will prepare line diagram exhibits showing the 2014 and 2036 turning
movement counts and a table showing the LOS results for the Client to add to the
schematic.
• ENGINEER will attend one (1) meeting with the Client, City, and/or TxDOT to
discuss the LOS results.
TASK 3. SCHEMATIC DESIGN.
ENGINEER will develop the schematic design of the infrastructure as follows.
3.1. Development of Schematic Design shall include the following:
• The Engineer shall conduct route location and alignment studies and develop one
locally preferred alternative for the City and TxDOT's review and use in approving
the transportation planning and environmental documentation for the project.
• The Engineer shall perform a detailed Level of Service (LOS) traffic analysis using
the traffic data and projections approved by the State's Transportation Planning and
Programming Division. Based on approved traffic data and the evaluation of the
locally preferred alternative, the Engineer shall develop the design schematic.

• The Engineer shall prepare the design schematic for the locally preferred alternative.

• The Engineer shall prepare preliminary cost estimates and determine preliminary
Right-of-Way requirements.
• Preliminary drainage analysis and management of traffic during construction shall be
a consideration in the development of the design schematic.
ASSUMPTIONS
• Approval of the Schematic does not significantly change the current 60°/o design.
• Two (2) roll plots will be delivered for the schematic design.

TASK 4. DECELERATION RIGHT TURN LANE
ENGINEER will perform additional survey, modify 60% plans, add additional sheets, if
necessary, and update quantities to include a deceleration right turn lane for southbound
frontage road of IH 35 W to McPherson Boulevard as follows.
4.1. Incorporated into 90% plans shall include the following:
• The Engineer shall update the Index of Sheets, Project Layout, Typical Sections,
Removal Plan, Traffic Control Plan, Roadway Plan & Profile, Drainage, Signing &
Striping, Traffic Signal and Intersection Layout Sheets.
4.2. Update Quantities using the TXDOT standard bid items and format.
4.3. Perform additional survey shall include the following:
• Provide a topographic/design survey of the existing Southbound Frontage Road of 1-
35W beginning approximately 150 linear feet north of McPherson Boulevard and
extending 600 linear feet north with cross-sections at 50' intervals. The limits of the
survey shall be from the existing west right-of-way line of 1-35W to the existing east
curbline of the Southbound Frontage Road (approximately 60 feet). The topographic
survey shall include locating all visible existing features including, but not limited to,
buildings, water valves, water vaults, top and toe of slopes, drainage ditches, fences,
trees larger than 4" in diameter, concrete pads, electrical features, asphalt paving,
concrete paving, manholes and drainage structures.
• Establish one (1) additional horizontal control point and one (1) additional temporary
benchmark for the project area, extending existing control utilized in Phase I and II.

DELIVERABLES
Deliverables shall include additional survey in a digital file in Microstation format
of all features located in the survey, digital tin and one foot interval contours,
copies of field notes and field drawings and an ascii point file.
TASK 5. CATEGORICAL EXCLUSION (CE) DOCUMENTS.
5.1. Formalize the CE document to meet all TxDOT / NEPA Requirements
• ENGINEER to perForm additional documentation effort for categories:
funding/pianning consistency, existing & proposed facility descriptions,
socioeconomics/census evaluation, and indirect & cumulative impacts analysis.
5.2. CE document updates
• ENGINEER will update the CE document when additional design is complete and
additional information is available, including funding, STIP/DCIS consistency, ROW
activities, and public involvement activities.
5.3. Assist with TxDOT forms

Additional Services not included in the existinq Scope of Services — CITY and
ENGINEER agrees that the following services are beyond the Scope of Services
described in the tasks above. However, ENGINEER can provide these services, if
needed, upon the CITY's written request. Any additional amounts paid to the
ENGINEER as a result of any material change to the Scope of the Project shall be
agreed upon in writing by both parties before the services are performed. These
additional services include the following:
• Negotiation of easements or property acquisition.
• Services related to development of the CITY's project financing and/or budget.
• Services related to disputes over pre-qualification, bid protests, bid rejection
and re-bidding of the contract for construction.
• Construction management and inspection services
• Performance of materials testing or specialty testing services.
• Services necessary due to the default of the Contractor.
• Services related to damages caused by fire, flood, earthquake or other acts of
God.
• Services related to warranty claims, enforcement and inspection after final
completion.
• Services to support, prepare, document, bring, defend, or assist in litigation
undertaken or defended by the CITY.
• Performance of miscellaneous and supplemental services related to the project
as requested by the CITY.

• USACE consultation or coordination; formal Wetland Delineation and/or
Preliminary Jurisdictional Determination; Pre-Construction Notice to USACE for
a NWP; or, an Individual Permit application in accordance with Section 404 of
the CWA.
• Consultation or coordination with the local floodplain administrator; or, a
revised CLOMR/LOMR; and/or, floodplain permit application.
• Formal presence/absence survey for threatened and endangered species;
and/or other TPWD or USFWS consultation/coordination or permitting.
• City of Fort Worth Urban Forestry Permit application.
• Historic-age resources research design and/or reconnaissance survey.
• Archeological resources background study and/or field survey.
• Consultation, coordination or permitting with agency or tribal representatives for
historical and/or archeological resources.
• Air quality monitoring and/or modeling.
• Noise or vibration monitoring and/or modeling.
• ASTM E1527 Phase I Environmental Site Assessment; and/or, Phase II
environmental sampling/coordination; and/or, Phase III remediation/
coordination.
"Notwithstanding any other term or condition in this Agreement, the City and the
Engineer agree that the terms "ensure," "best," and/or "assure" shall only require
Engineer to perform the Services in accordance with the same degree of care and
skill ordinarily exercised by members of Engineer's profession practicing at the same
time and in the same general location; and that the use of such terms shall in no way
alter or enlarge the standard of care applicable to Engineer."

Authorize Execution of Amendment No. 2 to City Secretary Contract No. 43361, an
Engineering Agreement with URS Corporation, in the Amount of $74,500.00 for the Design
of Garden Acres Bridge Over Interstate Highway 35W Phase 2, Thereby Increasing the
Total Contract in the Amount of $589,092.58 (COUNCIL DISTRICT 6)
RECOMMENDATION:
It is recommended that the City Council authorize the execution of Amendment No. 2 to City
Secretary Contract No. 43361, an Engineering Agreement with URS Corporation, in the amount of
$74,500.00 for the design of Garden Acres Bridge over Interstate Highway 35W Phase 2, thereby
increasing the total contract in the amount of $589,092.58.
DISCUSSION:
This Agreernent is for the design of a three-lane bridge section at Garden Acres Drive and
McPherson Boulevard over Interstate Highway 35W to ultimately provide a six-lane divided principal
arterial. Phase 1 of the Project has been completed. This Amendment applies to the design of
Phase 2.
This contract Amendment is for additional engineering services required to perform a detailed Level
of Service (LOS) traffic analysis using the traffic data and projections approved by the Texas
Department of Transportation's (TxDOT) Transportation Planning and Programming Division and
preparation of the design schematic for the locally preferred alternative. Under this proposed
Amendment, URS Corporation will perform additional survey, prepare additional sheets and modify
plans, as necessary, to include TxDOT's requested deceleration right turn lane for the southbound
frontage road of Interstate Highway 35W to McPherson Boulevard. Funds for this Amendment will be
provided from the 2008 Capital Improvements Program Fund.

URS Corporation proposes to complete Amendment No. 2 for a fee not to exceed the amount of
$74,500.00. Staff considers this fee to be fair and reasonable for the scope of services proposed to
be performed.
M/WBE Office - URS Corporation is in compliance with the City's M/WBE Ordinance by committing to
an additional four percent M/WBE participation on this Amendment No. 2. The City's goal on this
Amendment is four percent.
This project is located in COUNCIL DISTRICT 6, Mapsco 119A and 119B.
FISCAL INFORMATION/CERTIFICATION:
The Financial Management Services Director certifies that funds are available in the current capital
budget, as appropriated, of the Street Improvements 2008 Fund.
