WHEREAS, the City of Fort Worth (CITY)
(ENGINEER) made and entered into City Secretary
CONTRACT) which was authorized by M&C No. C-25611
2012 in the amount of $485,932.58; and

GARDEN ACRES BRIDGE PHASE II; and
WHEREAS, it has become necessary to execute Amendment No. 1 to the
CONTRACT to include an increased scope of work and revised fee.
NOW THEREFORE, CITY and ENGINEER, acting herein by and through their
duly authorized representatives, enter into the following agreement, which
amends the CONTRACT:

Article I of the CONTRACT is amended to include the additional
engineering services specified in a proposal dated December 13, 2012 a
copy of which is attached hereto and incorporated herein. The cost to CITY
for the additional design services to be performed by ENGINEER totals
$28,660.00. (See Attached Funding Breakdown Sheet, Page -3-).

Dear Mr. Ingram:
URS is pleased to present our scope of work and fee for the above referenced project.
The supplemental scope of work and proposed supplemental fee is as follows:
Prepare details for the retrofit of a sidewalk along the eastbound lanes of the existing Garden
Acres bridge over IH 35 W between the southbound and northbound frontage road to be included
in the Phase II set of Plans, Specifications and Estimates (PS&E).
The plans will be designed according to City of Fort Worth and TxDOT Fort Worth District
standards and construction specifications.
The supplemental fee for this scope of services is $28,660.00.
This supplemental fee and scope is necessary as the fee and scope previously executed for URS to
provide Phase II Engineering Services on Garden Acres included only the new bridge design for the
proposed westbound lanes and did not include any rehabilitation of the existing IH 35 W overpass.

Scope for Enpineerin.c�Desiqn Related Services for Street Im�rovements
The scope set forth herein defines the work to be performed by the ENGINEER in
completing the project. Both the CITY and ENGINEER have attempted to clearly define the
work to be performed and address the needs of the Project.
OBJECTIVE
Prepare details for the retrofit of a sidewalk along the existing eastbound lanes of Garden
Acres and bridge over IH 35 W between the southbound and northbound frontage road to
be included in the Phase II set of Plans, Specifications and Estimates (PS&E).The plans will
be designed according to City of Fort Worth and TxDOT Fort Worth District standards and
construction specifications. TxDOT District standards and specifications will govern for the
final PS&E submittal since the project will ultimately be bid and constructed by TxDOT.

TASK 1. DESIGN MANAGEMENT.
ENGINEER will manage the work outlined in this scope to ensure efficient and effective use
of ENGINEER's and CITY's time and resources. ENGINEER will manage change,
communicate effectively, coordinate internally and externally as needed, and proactively
address issues with the CITY's Project Manager and others as necessary to make progress
on the work.
1.1. Managing the Team
� Prior to the 60 and 100 percent submittals, the ENGINEER shall complete QA/QC
reviews in accordance with established standards and requirements.

• No impact to Phase I design schedule.
� CADD drawings shall be completed in MicroStation and shall follow CADD
standards supplied by the City
• Roadway and bridge detail plans shall be developed according to City of Fort
Worth and TxDOT standards with the following assumptions (moving from west
to east):

bridge taking into account the "TRAFFIC SIGNAL DESIGN AND
ROADWAY MODIFICATIONS IH 35W AT GARDEN
ACRES/MCPHERSON PLANS" (K-H Plans)

TASK 2. CONCEPTUAL DESIGN (30 PERCENT).
The Conceptual Design for Phase II shall be submitted to CITY and TxDOT District staff per
the approved Project Schedule.
The purpose of the conceptual design is for the ENGINEER to identify, develop,
communicate through the defined deliverables, and recommend the design concept that
successfully addresses the design problem, and to obtain the CITY's endorsement of this
concept.
2.1. The Conceptual Design Package shall include the following:
• Preliminary roadway and removals plan details, existing and proposed typical
sections.
• Bridge Study: For the purposes of determining the most feasible option for
providing a sidewalk over the bridge. The two (2) options to be investigated will
be a.) Provide a rail over the existing bridge slab to separate vehicular and
pedestrian traffic and utilize the existing bridge slab surface as the sidewalk
surface. b.) Provide an elevated sidewalk surface six inches above the existing
surface.
• The ENGINEER will make it study findings available to the CITY and TxDOT and
provide a recommendation based on a cost benefits analysis.
• Upon concurrence from the City and TxDOT, the ENGINEER will provide
conceptual plan details of the preferred option.
• Perform a drainage analysis based on the preferred recommendation for required
modifications to the existing drainage pattern.
TASK 3. PRELIMINARY AND FINAL DESIGN (60 & y00 PERCENT).
Preliminary and final plans and specifications shall be submitted to CITY per the approved
Project Schedule.
ENGINEER shall use the latest version of the CITY's Project Review Checklist available
from Buzzsaw.
ENGINEER will develop the preliminary design of the infrastructure as follows.

3.1. Development of Preliminary and Final Design Drawings and Specifications for 60%
and 100% PS&E shall include the following:
• Traffic Control Plan to reflect bridge and approach roadway construction.
Construction signage and temporary pavement markings will be in accordance
with the latest edition of the Texas Manual on Uniform Traffic Control Devices.
• Provide roadway and removal plan sheets displaying station and coordinate data
for all horizontal sidewalk alignments. Provide existing and proposed typical
section.
• Preliminary roadway details to include curbs, curb expansion joints, and sidewalk
details.
• Provide existing and proposed typical section sheets.
• Miscellaneous design drawings to account for any modifications required to
properly address change in surface drainage due to inclusion of sidewalk, railing
and/or curbs.
• Final bridge details for the retrofit of a sidewalk on the bridge.
• Provide exterior bridge traffic rail details, regardless of option selected.
3.2 Project Decision Log
• ENGINEER shall document and provide to CITY a record of key design decisions
made during this stage of the project delivery.
ASSUMPTIONS
• Plan details outlined above will become part of Phase II plans and not an
independent set.
• Eight (8) sets of half size plans will be delivered for the 60% design.

ASSUMPTIONS
• Ten (10) sets of half size drawings, one (1) set of full size drawings and two (2) sets of
specifications will be delivered for the 90% Design package.
• Two (2) sets of full size drawings and two (2) sets of specifications will be delivered for
the 100% Design package.

• A DWF file for the 90% Design will be created from design CAD drawings and will be
uploaded to the project folder in Buzzsaw.
• A DWF file for the 100 % Design will be created from design CAD drawings and will be
uploaded to the project folder in Buzzsaw.
DELIVERABLES
A. 90% construction plans and associated specifications.
B. 100% construction plans and associated specifications.
C. Detailed estimates of probable construction costs including summaries of bid items and
quantities using the CITY's standard bid items and format.
D. Mylar Drawings
The ENGINEER shall submit a set of sealed conformed Mylar drawings for TxDOT
bid letting purposes.
ADDITIONAL SERVICES NOT INCLUDED IN THE EXISTING SCOPE OF SERVICES
Additional Services not included in the existinq Scope of Services — CITY and
ENGINEER agree that the following services are beyond the Scope of Services
described in the tasks above. However, ENGINEER can provide these services, if
needed, upon the CITY's written request. Any additional amounts paid to the
ENGINEER as a result of any material change to the Scope of the Project shall be
agreed upon in writing by both parties before the services are perFormed. These
additional services include the following:
• Negotiation of easements or property acquisition.
• Services related to development of the CITY's project financing and/or budget.
• Services related to disputes over pre-qualification, bid protests, bid rejection
and re-bidding of the contract for construction.
• Construction management and inspection services
• Performance of materials testing or specialty testing services.
• Services necessary due to the default of the Contractor.
• Services related to damages caused by fire, flood, earthquake or other acts of
God.
• Services related to warranty claims, enforcement and inspection after final
completion.
• Services to support, prepare, document, bring, defend, or assist in litigation
undertaken or defended by the CITY.
• Performance of miscellaneous and supplemental services related to the project
as requested by the CITY.
• Any form of Environmental Documentation.
� USACE consultation or coordination; formal Wetland Delineation and/or
Preliminary Jurisdictional Determination; Pre-Construction Notice to USACE for
a NWP; or, an Individual Permit application in accordance with Section 404 of
the CWA.

• Consultation or coordination with the local floodplain administrator; or, a
revised CLOMR/LOMR; and/or, floodplain permit application.
• Formal presence/absence survey for threatened and endangered species;
and/or other TPWD or USFWS consultation/coordination or permitting.
• City of Fort Worth Urban Forestry Permit application.
• Historic-age resources research design and/or reconnaissance survey.
• Archeological resources background study and/or field survey.
• Consultation, coordination or permitting with agency or tribal representatives for
historical and/or archeological resources.
• Air quality monitoring and/or modeling.
• Noise or vibration monitoring and/or modeling.
• ASTM E1527 Phase I Environmental Site Assessment; and/or, Phase II
environmental sampling/coordination; and/or, Phase III remediation/
coordination.
"Notwithstanding any other term or condition in this Agreement, the City and the
Engineer agree that the terms "ensure;' "best;' and/or "assure" shall only require
Engineer to perform the Services in accordance with the same degree of care and
skill ordinarily exercised by members of Engineer s profession practicing at the same
time and in the same general location; and that the use of such terms shall in no way
alter or enlarge the standard of care applicable to Engineer."
