Authorize Execution of Change Order No. 1 to City Secretary Contract No. 43988 with The Fain Group,

Street from Eighth Avenue to South Main Street, Thereby Increasing the Total Construction in the Amount
of $3,514,159.34 (COUNCIL DISTRICT 9)
RECOMMENDATION:
It is recommended that the City Council authorize the execution of Change Order No. 1 to City Secretary
Contract No. 43988 with The Fain Group, Inc., in the amount of $269,811.49 for Traffic Management
Communication Conduits along West Rosedale Street from Eighth Avenue to South Main Street, thereby
increasing the total construction in the amount of $3,514,159.34.
DISCUSSION:
The West Rosedale Streetscape Improvements Project is a streetscape improvement project that will
significantly alter the appearance of the roadway by providing landscape and pedestrian enhancements
from Eighth Avenue to South Main Street. This phase of the project includes reduction in the number of
vehicle lanes from six to four and includes the addition of curb line bulb-outs, on-street parking, pedestrian
improvements, landscaping and lighting under a context sensitive approach to enhance the corridor.
The purpose of this proposed change order is to provide communication conduits from Eighth Avenue to
South Main Street in support of the Citywide Fiber Masterplan for Communication for the City. The
initiative to provide communication conduits is relatively new and was not included in the original scope of
the project.

made on the original contract and extend and maintain that same MNVBE commitment of 23 percent to
this first change order. Therefore, The Fain Group remains in compliance with the City's M/WBE

Throughout the duration of this project, the City of Fort Worth is requesting that yaur company continue to
adhere to the MlWBE Ordinance by complying with the following procedures in this compliance letter,
Failure to foilvw these procedures in submitting reports and other requested information, if any, as required
shall authorized the City to withold payment from the contractor and/or ta reject future bidlpropasals from
the contractor until compliance with this ordinance is attained.
An MBE Monthly Participation Report Form (eric)osed) must be submitted monthly until the contract is
completed. The first report will be due after the first payment and beginning with the second application,
including proof oi payment documentation. The monthly report mvst have an original signature to ensure

Provide this office with proof of payment to your MBE subconteactars and suppliers. The M/WB� Office
will accept the fallowing as pro�f of payment:
1. Copies of MBE invoices with front and back copies of canceled checks, or
2. A notarized letter explaining, in detail:
a. Subcon�ractor/supplier scope of work;
b. Date when services were received from subcontractor/supplier;
c. Amounts paid to the subcontractorlsupplier; and,
d. Original signatures from both parties must be included on this letter.
If your company faresees a problem with submitting participation reports and/or proof of payment on a
monthly basis, please notify this office to discuss possible remedies.
If your company wishes to change or delete an MBE subcontractor or supplier, you should adhere tv the
