TEXAS, THAT:

The City Council, fjwn the ey dcrwe, finds that the assessments herein levied should be made and levied
against the respective p urcels of property ahutting' upon the ii aid portions of streets, avenues and public places
and against the owners of such property, ;md that s{YCh assess vents and charges are right and proper and are
substantially in proportion to the IwIwlits to the rf- ;pective parcels of property 1, >y means of the improvements
in the unit for wvhia h such assessments are levied, and establish substantial ,justice and equality and uniformity
between the respective owners of the rr,,spective properties, and between all parties concerned, Considering the
benefits received and burdens inrposed, ai.nd further finds that in each case the abutting property assessed is
specially benefited in enhanced value to the said property hr means of the said improvements in the unit upon
which the particular property abuts and for which as essi-nent is levied and charge made, in a sum in excess of

There shall ire, and is here6%, le% icd and asscw '',ed against the parcels of property herein below mentioned,
and against the rvgad and true owners [hereof (whet)er such (m neis be correctly named herein or not) the sums of
money itemized below opposite the description of the respective parcels of property and the several amounts
assessed against the >swne, and the ownrra thel eof. as fnr as such owners are known, being as follows:
Where more than one person, firm or corporation own„ an interest in any property above described, each
said person, firm or corporation shall be personally liable only for its, her or his pro rata of the total assessment
against such property in proportion as its, his or her respective interest bears to the total ownership of such _
property, and its, his or respective interest in such property may be released from the assessment lien upon pay-
ment of such proportionate sum.

The several sums above mentioned and assessed against the said parcels of property, and the owners
thereof, and interest thereon at the rate of .six per cent (6``,�) per annum, together with reasonable attorney's
fees and costs of collection, if incurred, are hereby declared to be and are made a lien upon the respective parcels
of property against which the same are assessed, and a personal liability and charge against the real and true
owners of such property, whether such owners be correctly named herein or not, and the said liens shall be and
constitute the first enforceable lien and claim against the property on which such assessments are levied, and
shall be a first and paramount lien thereon, superior to a.dl other liens and claims, except State, County, School
District and City ad valorem taxes.
The sums so assessed against the abutting property and the owners thereof shall be and become due and
payable as follows, to -wit: in five (5) equal installments, due respectively on or before thirty (30) days, one (1),
two (2), three (3), and four (4) years from the date of completion and acceptance of the improvements in the
respective unit, and the assessments against the property abulling upon the remaining unit,, shall be and become
due and payable in such installments after the date of the completion and acceptance of such respective units, and
shall bear interest from said date at the rate of six per cent (61, ) per annum, payable annually with each install-
ment, except as to the first installment, which shall be due and payable at the maturity thereof, so that upon the
completion and acceptance of the improvements in a particular unit, assessments against the property abutting
upon such completed and accepted unit shall he and become due and payable in such installments, and with
interest from the date of such completion and acceptance. Provided, however, that any owner shall have the
right to pay the entire assessment, or any installment thereof, before maturity by payment of principal and
accrued interest, and provided further that if default shall be made in the payment of principal or interest,
promptly as the same* matures, then the entire amount of the assessment upon which such default is made shall,
at the option of said City of Fort Worth, or its as:,igns, be and Become immediately due and payable, and shall be
collectable, together with reasonable attorney's fees and cost, of collection, if incurred, PROVIDED, however,
that acting through its duly a�authorized Director of Puhlic Works the City of Fort 'Worth retains the right to
authorize payment of the sums assesed against abutting property upon such completed and accepted unit in not
more than forty -eight (18) equal regular monthly installments of not le„U,s than $9.00 each, they first of such
installments to become due and payable not more than thirty (30) days after the completion and acceptance by
the City of the particular unit. PROVIDED F URTHUR, that tfie Cite- Attorney is hereby empowered to authorize
payments of said sums of lesser installments and /or over a longer period of time in cases in which the Director
of Public Works has previously determined that an extreme financial hardship upon the property owner will
otherwise result; and PROVIDED FURTHER, that such method of payments shall be authorized only in instances
where the owner or owners of property abutting upon ouch completed and accepted unit shall have executed and
delivered to the Cite of Fwt Worth a lawful, valid and binding notE_ and mecl�ranic's and materialman's contract
upon forms supplied t>y the City- granting a mechanic's lien upon and convey ing the said abutting property in
trust to secure the payment by said owner or owners according to tl)e terms thereof of the sums assessed against
such property.

If default shall be made in the payment of ona collection thereof . -hall be enforced either by
the sale of the property by the Assessor and Collector of laree>r, of said C ity as near u possible in the same man-
ner provided for the sale of property for the non - payment of ael vahxi-em taxes, or at the option of the City of
Fort Worth, or its assigns, pay rrient of said sums shah bo cKatorced bY° suit in any court of competent jurisdic-
tion, or as provided in any mechanic's or materialman's contract as rafoi,esaki, and said City shall exercise all of
its lawful powers to aid in the enforcement and collection of said assessments.

Said certificates shall further recite that the City of Fort Worth, Texas shall exercise all of its lawful
powers, when requested so to do, to aid in the enforcement and collection thereof, and may contain recitals sub-
stantially in accordance with the above and other additional recitals pertinent or appropriate thereof, and it
shall not be necessary that the recitals be in the exact form above set forth, but the substance thereof shall be
sufficient. The fact that such improvements may be omitted on any portion of any of said units adjacent to any
premises exempt from the lien of such assessments shall not in anywise invalidate, affect or impair the lien of
such assessments upon other premises.
X.
Full power to make and levy reassessments and to correct mistakes, errors, invalidities or irregularities,
either in the assessments or in the certificates issued in evidence thereof, is, in accordance with the law in force
in this City, vested in the City.
XI.
All assessments levied are a personal liability and charge against the real and true owners of the premises
described, notwithstanding such owners may not be named, or may be incorrectly named.
XII.
The assessments so levied are for the improvements in the particular unit upon which the property
described abuts, and the assessments for the improvements in any unit are in nowise affected by the improve-
ments or assessments in any other unit, and in making assessments and in holding said hearing, the amounts
assessed for improvements in any one unit have been in nowise connected with the improvements or the assess-
ments therefor in any other unit.
XIII.
The assessments levied are made and levied under and by virtue of the terms, powers and provisions of an
Act passed at the First Called Session of the Fortieth Legislature of the State of Texas, known as Chapter 106
of the Acts of said Session and now shown as Article 1105b of Vernon's Texas Civil Statutes, which Act has been
adopted as an amendment to and made a part of the Charter of the City of Fort Worth, Texas.
XIV.
The City Secretary is hereby directed to engross and enroll this ordinance by copying the caption of same
in the Minute Book of the City Council of Fort Worth, Texas, and by filing the complete Ordinance in the appro-
priate Ordinance Records of said City.
Xv.
This ordinance shall take effect and be in full force and effect from and after the date of its passage and
it is so ordained.

Gentlemen:
In accordance with the proceedings of your Honorable Body, I have prepared
estimates of the cost of street improvements as shown below:
Estimates of the total cost of improvements on a portion of WEST BERRY STREET
and portions of sundry other streets, avenues and public places in the City of Fort
Worth, Texas, and estimated amounts per front foot to be assessed against abutting
property and the owners thereof, on each portion of street, avenue and public;: place
are as follows, to-wit-
UNIT NO. 3 -B: WEST BERRY STREET FROM COCKRELL AVENUE TO UNIVERSITY DRIVE to be im-
proved by removing existing brick pavement, curbs, gutters, walks and driveways; by
utilizing existing concrete base, widening the existing roadway, using a six and one -
half -inch thick reinforced concrete base on a four -inch thick foundation course of
pit run gravel; by laying a minimum thickness of three -and one -half- inches of hot
mix asphaltic concrete surface and binder base course; by constructing seven -inch
high reinforced concrete curbs with two -foot wide gutters so that the finished street
will consist of two thirty - three -foot wide roadways with concrete median strips and
necessary left turn lanes and by reconstructing existing concrete sidewalks and
driveways.
The following assessment rate has been established:
6 -foot pavement widening ......................$5.28
UNIT NO. 4: WEST BERRY STREET FROM UNIVERSITY DRIVE TO STADIUM DRIVE, to be im-
proved by removing existing pavement, curb, gutter, walks and driveways and const-
ucting thereon a seven -inch thick reinforced concrete pavement on a six -inch thick
lime stabilized subgrade, seven -inch high reinforced concrete curbs and two -foot
wide gutters so that the finished street will consist of two thirty- three -foot
wide roadways with median strips and necessary left turn lanes, and by reconstr-
ucting existing walk and driveways to proper alignment and grade and constructing
five -inch thick concrete sidewalk where specified.
The following assessment rates have been extablished:
4 -foot wide sidewalk .........................$1.91 per L.F.
Concrete pavement seven -feet wide
(curb and gutter existing) .......... $3.31 per L.F.
Concrete pavement seven -feet wide with
curb and gutter.$5.14 per L.F.
UNIT N0; 5 -A: STADIUM DRIVE FROM WEST BERRY STREET TO BELLAIRE DRIVE NORTH, to be
improved by removing existing pavement, curbs and gutters and constructing thereon
a seven -inch thick reinforced concrete pavement on a six -inch thick lime stabilized
subgrade, seven -inch high reinforced concrete curbs and two -foot wide gutters so
that the finished street will be forty -four feet in width, and by constructing five -
inch thick concrete sidewalk where specified.
The following assessment rates have been established:
Four -foot wide sidewalk .....................$1.91
Six -foot wide sidewalk ......................$2.86
Concrete pavement seven -feet wide
(curb and gutter existing)...$3.31
UNIT NO. 5-B: WEST BERRY STREET EXTENSION FROM WEST BERRY STREET TO WESTCLIFF ROAD
WEST, to be improved by constructing thereon a seven-inch thick reinforced concrete
pavement on a six-inch thick lime stabilized subgrade, seven-inch high reinforced
concrete curbs and two-foot wide gutters so that the finished street will consist of
two twenty-four foot wide roadways with median strips and necessary left turn lanes,
and by constructing five-inch thick concrete sidewalks when specified.
The following assessment rates have been established:

WEST BERRY STREET EXTENSION

A Neighborhood Hearing was conducted at Bluebonnet Elementary School by
the Engineering Division on February 5, 1968, for the West Berry Street Exten-
sion Improvements, Project No, 104-23000-115w
The procedures concerning owner participation in the cost of paving, in-
cluding methods and policies of determining assessments and street construction
standards were explained by members of the staff to the two persons in atten-
dance.
Mr. Warren W. McKeever, Bellaire House Ltd., and Mr. L. C. White, Vice-
Chancellor of T.C.U., were in attendance at the meeting. Both expressed opposi-
tion to the project. Mr. McKeever requested, with Mr. White concurring, that
the Benefit Hearing be delayed 2 or 3 weeks in order to give the property owners
an opportunity to get independent appraisals and to meet with their attorneys
in an effort to prepare their cases properly before Benefit Hearing.
Following the Neighborhood I'learing, Mr. White contacted the Assessment
Paving Office by telephone and requested that it be known that Texas Christian
University is in favor of the project and that they would pay their share of the
cost for improvements. Mr. White also withdrew his request for a delay in
Benefit Hearing.

Gentlemen:
In accordance with the proceedings of your lionotable Body, I have prepared
estimates of the cost of street improvements as shown below:
Estimates of the total cost of improvement's on a portion of WEST BERRY STREET
and portions of sundry other streets, avenues, and public t.,)laces in the City of Fort
Worth, Texas, and estimated amounts per front foot to be assessed against abutting
property and the owners thereof, on each, portion of street, aventle and pub Lic place
are as follows, to-wit:
UNIT NO. 3-B: WEST BERRY STREET FROM COCKRELL AVE'fR;E TO UNIVERSITY DRIVE to be im-
proved by removing existing brick pavement, curbs, gutters, walks and driveways; by
utilizing existing concrete base, widening the existing roadway, using a six arid one-
half-inch thick reinforced concrete base an a four- i ach thick foundation course of
pit run gravel; by laying a minimuin thickness of three-and one-half-inches of hot
mix asphaltic concrete surface rind binder base, course; by cm:msrructing seven-inch
high reinforced concrete curbs with two-foot wide gutters so that the finished street
will consist of two thirty -three -foot wide roadways with concrete median strips and
necessary left turn lanes and by reconstructing existing concrete sidewalks and
driveways.
The following assessment rate has been established,

lime stabilized subgrade, seven-inch high reinforced concrete curbs and two•foot
wide gutters so that the finished street will consist of two thi rty- three.- foot
wide roadways with median strips and ncl�cessary left turn lanes, and by reconstr-
ucting existing walk and driveways to proper alignment and grade and constructing
five-inch thick concrete sidewalk whete specified.

New Format for Engineer's Rolls
The Council's attention is called tm3 the new format of the Engineers' Prelimi-
nary Assessment Rolls, The format has been redesigned to provide for simplic-
ity and brevity in showing the property owners net assessment.
The new format provides information on the type of pavement, ownership, prop-
erty description, zoning, improvements and net assessment after all credits,,
It is anticipated that the new format will provide all information desired by
the members of the City Council in a manner which is easier to read.
