AN ORDINANCE INCREASING APPROPRIATIONS IN THE ENVIRONMENTAL
MANAGEMENT OPERATING FUND IN THE AMOUNT OF $507,159.79 AND
DECREASING THE UNRESERVED RETAINED EARNINGS BY THE SAME
AMOUNT, FOR THE PURPOSE OF TRANSFERRING SAID FUNDS TO THE
ENVIRONMENTAL MANAGEMENT PROJECT FUND; PROVIDING FOR A
SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR
ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE
DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That in addition to those amounts allocated to the various City departments for Fiscal Year 2007-
2008 in the Budget of the City Manager, there shall also be increased appropriations in the
Environmental Management Operating Fund in the amount of $507,159.79 and decreasing the
unreserved retained earnings by the same amount, for the purpose of transferring said funds to the
Environmental Management Project Fund.
SECTION 2.
That should any portion, section or part of a section of this ordinance be declared invalid,
inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or
judgment shall in no way impair the remaining portions, sections, or parts of sections of this
ordinance, which said remaining provisions shall be and remain in full force and effect.
SECTION 3.
That this ordinance shall be cumulative of Ordinance No. 17749 and all other ordinances and
appropriations amending the same except in those instances where the provisions of this ordinance
are in direct conflict with such other ordinances and appropriations, in which instance said
conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed.
SECTION 4
This ordinance shall take effect upon adoption.

Authorize Execution of Contract with Intercon Environmental, Inc., for Asbestos Abatement and
Demolition at the Villa Del Rio and Oak Hollow Apartment Complexes, Approve Transfer of Funds,
and Adopt Appropriation Ordinances
RECOMMENDATION:
It is recommended that the City Council:
1. Authorize the City Manager to execute a contract with Intercon Environmental, Inc., for asbestos
abatement and demolition at the Villa Del Rio and Oak Hollow apartment complexes in the amount of
$1, 492,159.79;
2. Adopt the attached supplemental appropriation ordinance increasing appropriations in the Environmental
Management Fund (R103) by $507,159.79 and decreasing the unreserved retained earnings by the same
amount;
3. Approve the transfer of $507,159.79 in undesignated funds in the Environmental Management Operating
Fund (R103) to the Environmental Management Project Fund (R101);
4. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the
Environmental Management Project Fund (R101) by $507,159.79; and
5. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the
Specially Funded Capital Projects Fund (C291) by $250,000.
DISCUSSION:
On June 5, 2007, the City Council authorized the Execution of Agreements for the Purchase of the Villa Del
Rio and Oak Hollow Apartment Complexes located at 5817 Boca Raton and 5901 Boca Raton Fort Worth,
Texas, and $750,000 for the fencing and demolition (M&C Reference No. L-14332; Ordinance No. 17588-
06-2007).
The apartment buildings contain asbestos-containing materials that are required to be removed prior to
building demolition. The Environmental Management Department is contracting for removal of the asbestos-
containing materials including: sheetrock with wall texture and joint compound, popcorn ceiling texture,
linoleum floor covering, and floor file with mastic. Following the asbestos removal activities, all buildings will
be demolished and all improvements including parking areas, sidewalks, building slabs, and pools will be
removed.
An Invitation to Bid was advertised on October 4 and October 12. The following firms submitted bids on

Eagle Construction and Environmental Services, L.P.;
Intercon Environmental, Inc.;

Midwest Wrecking Co. of Texas, Inc.; and
Project Development Group, Inc.
Based on the low bid of $1,492,159.79, City staff recommends award of the contract to Intercon
Environmental, Inc.
Intercon Environmental, Inc., is in compliance with the City's M/WBE Ordinance by committing to 7 percent
MWBE participation. The City's goal on this project is 26 percent.
Work on the project is expected to begin in December 2007.
The apartment complexes are located in COUNCIL DISTRICT 4.
FISCAL INFORMATION/CERTIFICATION:
The Finance Director certifies that upon approval of the above recommendations and adoption of the
attached appropriation ordinance, funds will be available in the Environmental Management Project Fund
(R101) and the Specially Funded Capital Projects Fund (C291).
