HomeMy WebLinkAboutContract 48423-A4CSC No. 48423-A4 AMENDMENT No . 4 TO CITY SECRETARY CONTRACT WHEREAS, the City of Fort Worth (CITY) and CP&Y, Inc. , (ENGINEER) made and entered into City Secretary Contract No.48423 (the CONTRACT) which was authorized by M&C C-27985 on the 8�' day of November 2016 in the amount of $456,340.00; and WHEREAS , the CONTRACT was subsequently revised by Amendment No . 1 in the amount of $13,098.36 administratively authorized July 3, 2017 and Amendment No. 2 in the amount of $168,985.00 which was authorized by M&C 20-0168 on April 7, 2020 and Amendment No. 3 in the amount of $99,815.00 administratively authorized November 13,2020; and WHEREAS , the CONTRACT involves engineering services for the following project: Northeast Northside II 30-inch Water Transmission Main Along State Highway 170 from North Beach Street to US 377. WHEREA5, it has become necessary to execute Amendment No.4 to the CONTRACT to include an increased scope of work and revised fee. NOW THEREFORE, CITY and ENGINEER, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the CONTRACT: 1. Article I of the CONTRACT is amended to include the additional engineering services specified in the proposal attached hereto and incorporated herein. The cost to City for the additional professional services to be performed by Engineer totals $47,265.00 (Water). 2. Article II of the CONTRACT is amended to provide for an increase in the fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall be an amount of $785,503.36. CP&Y is currently performing design and construction services for these locations, however additional Professional Engineering Services are required to assist in the inspection of the tunneling construction. Both the CITY and ENGINEER have attempted to clearly define the work to be performed and address the needs of the Project. Background As part of the TXDOT improvements along Highway 170, ENGINEER was tasked with the design the relocation of 4 crossings to an acceptable location and depth that is not in conflict with the TXDOT changes, as specified by TXDOT. One of the crossing, the 30-inch water line crossing of Highway 170 near Beach Street, was bid and awarded for construction separately from the other pipelines. Construction of this pipeline includes hand mine tunneling of the crossing of Highway 170. This amendment modifies the previous amendments based on the revised scope items. SCOPE Beach Street Tunnel Inspection Services ENGINEER will perform Construction Tunneling Inspection Services as part of the Beach Street relocation. The inspection services will occur at the following milestones associated with the construction of the tunnel. • Inspection #1 - Engineer will perForm 2 site visits to observe and inspect the tunnel shaft construction and general conformance to specifications, shop drawings and design pians. • Inspection #2 - Engineer will perform 1 site visit to observe and inspect the start of the jacking operation and review propulsion of the casing. • Inspection #3 — Engineer will perform 1 site visit to observe the welding of the 2nd section of casing to the initial and confirm the general quality of the penetration welds and procedures used. • Inspection #4 — Engineer will monitor the amount of overcut that occurs at the face of the tunnel — before advancing the casing forward including confirming the contractor's calculated volume of material removed. o Based on construction duration provide by contractor it is anticipated the effort will be approximately 18 hours a week for 9 week duration City of Fort Worth, Texas Attachment A PMO Release Date: 07.23.2012 Page 1 of 2 ATTACHMENT A DESIGN SERVICES FOR SANITARY SEWER REHABILIATION CITY PROJECT N0.:102 • Inspection # 5— Engineer will observe the breast boards usage at face of the tunnel before the start of a long shut down period. 2 site visits are anticipated for this inspection. • Inspection # 6— Engineer will perform 1 site visit to observe the tunnel at end of the jacking to confirm the completeness of the grouting of the casing in its final position. • Inspection #7 - Prior to inserting the water line, Engineer will observe the roundness and alignment of the casing to detect potential issues with inserting the pipe. • Engineer will review the daily tunnel logs for conformance and completion. o Approximately 62 logs based on construction duration provide by contractor. Additional Survev/Easement Services The existing easement for the water line crossing of Highway 170 at Beach Street will be abandoned within the TXDOT right of way. • Engineer will provide Easement Legal Descriptions and Exhibits for the abandonment of the portion of the 30-ft water line easement within TXDOT ROW. • The documentation shall conform with the checklists and templates available on the City of Fort Worth's site per the requirements of Task 7.2 of the original contract ASSUMPTIONS • ENGINEER will not be performing full time inspection services for the duration of the tunnel. ENGINEER will perform periodic site visits or observe specific tunneling activities as defined in the scope. • City of Fort Worth and TXDOT will have full time inspection services to monitor the day to day construction activities. • Inspection services are associated with tunneling at Beach Street only, and does not include any additional services at any other crossing of Highway 170 that are a part of the overall contract. COMPENSATION Additional Compensation for this amendment is $47,265.00 The overall contract amount is modified from $738,238.36 to $785,503.36 as part of this amendment. DISCUSSION: On November 8, 2016, Mayor and Council Communication (M&C C-27985), the City Council authorized execution of an engineering agreement with CP&Y, Inc. in the amount of $456,340.00 for the preparation of plans and specifications for the Northeast Northside II 30-inch Water Transmission Main. The agreement was subsequently revised by Amendment No. 1 in the amount of $13,098.36, administratively authorized July 3, 2017, that provided for additional design survey on the project, Amendment No. 2 in the amount of $168,985.00 (M&C 20-0168, April 7, 2020), that provided for design for the relocation of conflicting water mains at Beach Street, Alta Vista Road, Westport Parkway and Independence Parkway as required by Texas Department of Transportation (TXDOT), and Amendment No. 3 in the amount of $99,815.00, administratively authorized November 13, 2020, that provided for construction related services during construction of Phase 2 of the project. Amendment No. 4 will provide additional construction services on Phase 2 and additional easement preparation on the project. FISCAL INFORMATION / CERTIFICATION: The Director of Finance certifies that funds are available in the current operating budget in the Water & Sewer Fund, and upon approval of the above recommendations and adoption of the attached appropriation ordinance, funds will be available in the W&S Capital Projects Fund for the NSII Water Main Along SH170 project to support the approval of the above recommendations and execution of the amendment to the engineering agreement. Prior to any expenditure being incurred, the Water Department is responsible to validate the availability of funds.
