THIS FIRST AMENDMENT to City Secretary Contract No. 46403 is entered into by and
between the City of Fort Worth ("City"), a home-rule municipality in the State of Texas,
acting through Fernando Costa, its duly authorized Assistant City Manager, and 1
Priority Environmental Services, Inc. ("Contractor"), acting through Gary Caldwell, its
duly authorized President and CEO.
WHEREAS, the City and 1 Priority Environmental Services, Inc. have entered into that
certain agreement identified as City Secretary Contract No. 46403 (also the "Contract")
commencing on July 25, 2014 for the removal, packaging, transportation, and disposal
of asbestos-containing materials from the general terminal building, Meacham
International Airport, as authorized by Mayor and Council Communication C-26842; and
and
WHEREAS, the contract provides for compensation of three-hundred seventy-nine
thousand, six-hundred and six dollars and ninety cents ($379,646.90) for abatement
services at the General Terminal Building at Fort Worth Meacham International Airport;
WHEREAS, the Scope of Work under Contract No. 46403 has unforeseeably increased
due to additional asbestos-containing materials being discovered during the interior
demolition phase of certain areas of the General Terminal Building.
WHEREAS, Administrative Change Order No. 1 provides for a twenty-four thousand,
three-hundred seventy-nine dollars and seventy cent ($24,379.70) increase in the
contract amount for the original contract term; and
WHEREAS, the parties wish to increase the contract amount for the original contract by
an additional one hundred ninety-thousand, eight-hundred, sixty-two dollars and ninety
cents ($194,862.90) to provide for additional asbestos abatement removal services at
Meacham International Airport General, Terminal Building beyond the original scope of
the contract, and sufficient funds have been appropriated as approved by Mayor and
Council Communication C-27371; and
WHEREAS, the parties agree that all other terms and conditions shall remain the same
as stated in City Secretary Contract No. 46403;

NOW, THEREFORE, for and in consideration of the mutual covenants contained herein,
and other good and valuable consideration, the receipt and sufficiency of which are
hereby acknowledged and confessed, the parties hereto agree as follows:
1. Scope of Work:
Contractor will furnish all labor, materials and equipment necessary to perform the
removal of additional asbestos-containing materials discovered during interior
demolition activities which includes approximately 10,771 square feet (SF) of fire-
proofing overspray on the perimeter beams, existing columns, and on the underside of
the 1St and 2"d Floor decks, plus, approximately 12,085 SF of plaster/fireproofing
overspray located on the north stairwell, center stairwell/utility shaft, and HVAC
ductwork located within the General Terminal Building located at Meacham International
Airport, in accordance with the abatement and work specifications determined by the
City's consultant, attached as Specifications for Asbestos Abatement Addendum 1.
2. Compensation Not to Exceed Amount:
Compensation to provide for additional asbestos abatement removal services at
Meacham International Airport Generai, Terminal Building is increased by an additional
one hundred ninety-four thousand, eight-hundred, sixty-two dollars, and ninety cents
($194,862.90). Total compensation, including the original amount for Contract No.
46403 of three-hundred seventy-nine thousand, six-hundred forty six dollars and ninety
cents ($379,646.90), plus Administrative Change Order No. 1 which provides for a
twenty-four thousand, three-hundred seventy-nine dollar and seventy cent ($24,379.70)
increase, and this Amendment totals to a new total amount of five hundred ninety-eight
thousand, eight-hundred eighty-nine dollars and fifty cents ($598,889.50) for the
original, revised, and amended scope of work, subject however to all other terms and
conditions as stated in City Secretary Contract No. 46403.
3. Time to Complete Work:
All work shall commence and be completed as specified in a new Notice to Proceed
issued by the City.
4. Miscellaneous_
All other definitions, terms, and conditions of City Secretary Contract No. 46403 shall
remain unchanged except as expressly set forth herein.

A brief summary of the extent of the work and non-binding to the contract documents includes:

HEPA ventilation from specified areas of the buildings. The following asbestos- containing ma-

Authoiize Execution of a Contract with 1 Priority Environmental Services, Inc., in the Amount of
$379,646.90 for Removal, Transportation and Disposal of Asbestos Containing Materials from the General
Teiminal Building at Meacham International Airport and Adopt Appropriation Ordinances (COLTNCIL
DISTRICT 2)
RECOMMENDATION:
It is recommended that the City Council:
1. Adopt the attached appropriation ordinance increasing estimated appropriations in the Environmental
Protection Operating Fund in the amount of $379,647.00 and decreasing the unaudited, unassigned fund
balance by the same amount;
2. Authorize the transfer of $379,647.00 from the Environmental Protection Operating Fund to the
Environmental Protection Project Fund;
3. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the
Environmental Protection Project Fund in the amount of $379,647.00; and
4. Authorize City Manager to execute a contract with 1 Priority Environmental Services, Inc., far asbestos
abatement services in the General Terminal Building at Fort Worth Meacham International Airport in the
amount of $379,646.90.
DISCUSSION:
On May 11, 2010, (M&C C-24215) the City Council authorized the execution of an Architectural Services
Agreement with Hahnfeld, Hoffer and Stanford to begin schematic design to renovate and expand the
General Terminal Building at Fort Worth Meacham International Aiiport. The design for the renovation has
been completed and bids have been received for the construction. As part of the renovation, all regulated
asbestos—containing materials located in the General Terminal Building must be removed prior to renovating
the structure, in order for the Ciry to be in compliance with state and federal regulations related to
asbestos—containing materials in City—owned property.
The General Terminal Building contains approximately 35,000 square feet of asbestos—containing sheetrock
and joint compound in the ceilings and walls, approximately 26,000 square feet of asbestos containing floor
tile and/or mastic, approximately 2601inear feet of HVAC duct mastic, approximately 10,000 square feet of
spray—on fireproofing, and approximately 20,000 square feet of exterior surfacing material on columns and
soffits. Under State of Texas rules, the City is required to contract with a firm licensed by the Texas
Department of State Health Services to perforin the asbestos removal, packaging, transportation and disposal.
