AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN
THE WATER CAPITAL PROJECTS FUND IN THE AMOUNT OF $605,125.50 AND THE
SEWER CAPITAL PROJECTS FUND IN THE AMOUNT OF $599,496.16 FROM
AVAILABLE FUNDS, FOR THE PURPOSE OF EXECUTING A CONTRACT WITH
MCCLENDON CONSTRUCTION COMPANY, INC., FOR PAVEMENT
RECONSTRUCTION AND WATER AND SANITARY SEWER MAIN REPLACEMENT ON
PORTIONS OF HATCHER STREET, CHICKASAW AVENUE, JENNIFER COURT, LOUIS
STREET, SYDNEY STREET, NORRIS STREET AND WHITEHALL STREET (CITY
PROJECT NO. 00272); PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS
ORDINANCE CUMULATIVE OF PRIOR ORDINANCES IN CONFLICT HEREWITH; AND
PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS:
SECTION 1.
That in addition to those amounts allocated to the various City departments for Fiscal Year 2007-2008 in the
Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the
Water Capital Projects Fund in the amount of $605,125.50 and the Sewer Capital Projects Fund in the
amount of $599,496.16 from available funds, for the purpose of executing a contract with McClendon
Construction Company, Inc., for pavement reconstruction and water and sanitary sewer main replacement
on portions of Hatcher Street, Chickasaw Avenue, Jennifer Court, Louis Street, Sydney Street, Norris Street
and Whitehall Street (City Project No. 00272).
SECTION 2.
That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void
for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way
impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining
provisions shall be and remain in full force and effect.
SECTION 3.
That this ordinance shall be cumulative of Ordinance No. 17749 and all other ordinances and appropriations
amending the same except in those instances where the provisions of this ordinance are in direct conflict
with such other ordinances and appropriations, in which instance said conflicting provisions of said prior
ordinances and appropriations are hereby expressly repealed.
SECTION 4.
This ordinance shall take effect upon adoption.

Reconstruction and Water and Sanitary Sewer Main Replacement on Portions of Hatcher Street,
Chickasaw Avenue, Jennifer Court, Louis Street, Sydney Street, Norris Street and Whitehall Street
(Project No. 00272), and Adopt Appropriation Ordinance
RECOMMENDATION:
It is recommended that the City Council:
1. Authorize the City Manager to execute a contract with McClendon Construction Company, Inc., in the
amount of $2,938,673.80 for pavement reconstruction and water and sanitary sewer main replacement on
Hatcher Street (Quail Lane to Hardeman Street), Chickasaw Avenue (Shackleford Street to Miller Avenue),
Jennifer Court (Eastland Street to Eastland Street), Lois Avenue (Sydney Street to East Dead End), Norris
Street (Crouch Avenue to East Dead End), Sydney Street (East Berry Street to Reed Street) and Whitehall
Street (Miller Avenue to Pate Drive) (DOE - 5107);
2. Authorize the transfer of funds in the amount of $1,204,621.66 from the Water and Sewer Operating
Fund to the Water Capital Projects Fund in the amount of $605,125.50 and Sewer Capital Projects Fund in
the amount of $599,496.16; and
3. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the
Water Capital Projects Fund in the amount of $605,125.50 and the Sewer Capital Projects Fund in the
amount of $599,496.16, from available funds.
DISCUSSION:
The 2004 Capital Improvement Program (CIP) includes funds for pavement reconstruction on all streets
mentioned above. Street improvements include pavement reconstruction, construction of standard
concrete curb and gutter, driveway approaches and sidewalks as indicated on the plans.
The Water Department has determined that severely deteriorated water and sanitary sewer lines should be
replaced prior to street reconstruction.
On January 10, 2006, (M&C C-21243) the City Council authorized the City Manager to execute an
engineering agreement with RJN Group, Inc., for Pavement Reconstruction and Water and Sanitary Sewer
Main Replacement on Portions of Hatcher Street, Chickasaw Avenue, Jennifer Court, Lois Street, Norris
Street, Sydney Street and Whitehall Street (DOE 5107).
The project was advertised on July 12, 2007 and July 19, 2007. On August 23, 2007, the following bids
were received:

The new pavement will consist of 8-inch concrete over 6-inch lime stabilized subgrade with 7-inch concrete
curb.
Funding in the amount of $71,847.41 is included for associated water and sewer construction survey,
project management, pre-construction, material testing, inspection and project close out (water $39,940.50
and sewer $31,906.91). The contingency funds to cover change orders total $50,000.00 (water $25,000.00
and sewer $25,000.00).
Funding in the amount of $159,220.41 is required for associated paving and drainage construction survey,
project management, pre-construction, material testing, inspection and project close out. The contingency
fund for possible change orders for paving and drainage improvement is $55,676.81.
M/WBE -McClendon Construction Company, Inc., is in compliance with the City's MM/BE Ordinance by
committing to 33 percent M/WBE participation on this combined project. The City's goal on this project is
18 percent.
This project is located in COUNCIL DISTRICT 5, Mapsco 78U, Z, 79S, W & 92C.
FISCAL INFORMATION/CERTIFICATION:
The Finance Director certifies that upon approval of the above recommendations, and the adoption of the
attached appropriation ordinance, funds will be available in the current capital budgets, as appropriated, of
the Water Capital Projects Fund, the Sewer Capital Projects Fund and the Street Improvements Fund.
