HomeMy WebLinkAboutOrdinance 17921-12-2007Ordinance No. 17921-12-2007 AN ORDINANCE INCREASING APPROPRIATIONS IN THE STORM WATER UTILITY FUND IN THE AMOUNT OF $188,426 AND DECREASING THE UNRESERVED RETAINED EARNINGS BY THE SAME AMOUNT, FOR THE PURPOSE OF FUNDING THE PURCHASE OF TWO NEW TRUCKS FROM ATC FORT WORTH FREIGHTLINER AND HOLT CAT AND ONE NEW WATER TANK FROM THE TEXAS DEPARTMENT OF CRIMINAL JUSTICE; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2007- 2008 in the Budget of the City Manager, there shall also be increased appropriations in the Storm Water Utility Fund in the amount of $188,426 and decreasing the unreserved retained earnings by the same amount, for the purpose funding the purchase of two new trucks from ATC Fort Worth Freightliner and Halt Cat and one new water tank from the Texas Department of Criminal Justice. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 17749 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Adopt the attached supplemental appropriation ordinance increasing appropriations in the Storm Water Utility Fund by $188,426 and decreasing the unreserved retained earnings by the same amount; and 2. Authorize the purchase of new trucks from ATC Fort Worth Freightliner and Holt Cat using cooperative contracts and authorize the purchase of one new water tank from the Texas Department of Criminal Justice. DISCUSSION: This recommendation is for the purchase of two new trucks from a Texas Procurement and Support Services Contract (TPASS) with ATC Fort Worth Freightliner and from a Texas Association of School Boards (TASB) Contract with Holt Cat and one new water tank from the Texas Department of Criminal Justice (TDCJ) Contract for the Transportation and Public Works Department (T/PW) as listed below for a cost not to exceed $188,426, with payment due within 30 days of the date of the invoice. The trucks and equipment are additions to the Storm Water Division fleet. T/PW and Equipment Services departments have reviewed the pricing and find the costs to be competitive. State law provides that a local government purchasing an item under an interlocal cooperative contract satisfies any state law requiring that the local government seek competitive bids for purchase of the item. TPASS and TASK contracts have been competitively bid to increase and simplify the purchasing power of local government entities across the State of Texas. FISCAL INFORMATION/CERTIFICATION: The Finance Director certifies that upon approval of the above recommendations and adoption of the attached supplemental appropriation ordinance, funds will be available in the current operating budget, as appropriated, of the Storm Water Utility Fund. Upon approval, the cash balance of the Storm Water Utility Fund will be $6;661,900.
