FIRST AMENDMENT TO
CITY SECRETARY CONTRACT NO. 44801
THIS FIIZST AMENDMENT to City Secretary Contract No. 44801 is entered into by and
between the City of Fort Worth, a home-rule municipal corparation situated in Tarrant
County, Texas ("Fort Worth"), acting through Fernando Costa, its duly authorized
Assistant City Manager, and The City of Joshua, located in Johnson County, Texas
("Participant"), acting tbrough Chester Nolen, its duly authorized Interim City Mar.ager.
W�IEREAS, Fort Worth and The City of the Participant have entered into that certain
agreement identified as City Secretary Contract No. 44801 (also the "Agreement") for
fiscal year 2014 (October 1, 2013 through September 30, 2014) whereby Fort Worth will
purchase the services of a waste disposal/recycling firm or firms and will administer a
household hazardous waste collection program as authorized by Mayor and Council
Communication G26421; and • � •
WI�REAS, that Agreement was for an initial term of one year and that Agreement
provides for the extension of the term for up to three additional pe�iods of one year each;
and � •
WHEREAS, the parties wish to extend the term of the initial Agreement far an additional
year commencing on October 1, 2014 through September 30, 2015; and
WIIEREAS, the parties agree that all other conditions, terms, and pricing shall remain the
same as stated in City Secretary Contract No. 44801;
NOW, THEREFORE, for and in consideration of the mutual covenants contained herein,
and other good and valuable consideration, the receipt and sufficiency of which are
hereby acknowl�dged and ccr.fessed, the parties hereto agree as follo�vs:
1. Extended term of agreement:
City Secretary Contract number 44801 is extended to include the term beginning on
October 1, 2014 and ending on September 30, 2015.
2. Anticipated Holiday Closures:
During the extended term of the agreement, the Environmental Collection Center (ECC)
will be closed on the following holidays that are observed on days the ECC would
otherwise be open to the public:

Thanksgiving holiday, Thursday and Friday, November 27-28, 2014
Christmas holiday, Thursday, December 25, 2014

Miscellaneous:
All definitions, terms, conditions, and prices, as well as the rights and obligations of the
parties as set forth in City Secretary Contract number 44801 shall remain unchanged
except as expressly set forth herein.
IN WTTNESS THEREOF, the parties have executed this contract in triplicate in Fort
Worth, Texas, on the dates written below.

Authorize Execution of Interlocal Agreements with Various Municipalities and Other Governmental Entities
for Participation in the Environmental Collection Center Household Hazardous Waste Program (ALL
COUNCIL DISTRICTS)
RECOMMENDATION:
It is recommended that the City Council authorize the execution of Interlocal Agreements with various
local municipalities and other governmental entities for their participation in the Environmental Collection
Center Household Hazardous Waste Program.
DISCUSSION:
The City's Environmental Collection Center is now in its 16th year of operation collecting household
hazardous waste from the residents of Fort Worth and surrounding communities on a year round basis. In
order for non-Fort Worth residents to participate at the center, each entity is required to enter into an
Interlocal Agreement with the City of Fort Worth.
The term for these Agreements will be for Fiscal Year 2014 (October 1, 2013 through September 30,
2014) with three one-year options to renew (through Fiscal Year 2017). Renewal may be effected by
written notification by the City Manager or his designated representative to the participating entity within
30 days of the expiration of the prior term and does not require specific City Council approval. The rate
per household for the period covered by these Agreements is $47.00 per household. It is anticipated that
approximately $760,000.00 will be collected annually under these Agreements. During Fiscal Year 2013,
46 entities signed participation Agreements with the City of Fort Worth. For the upcoming year, it is
expected that all of these entities will participate.
This Agreement outlines the responsibilities of each party, establishes the rate for participation, details
procedures for loan of mobile collection unit, and delineates the usage of service marked public education
materials. The City of Fort Worth is responsible for overall operation of the center including contracting
with a hazardous waste disposal company for transportation and disposal of materials collected.
