THIS SECOND AMENDMENT to City Secretary Contract No. 44806 is entered into by
and between the City of Fort Worth, a home-rule municipal coiporation situated in
Tarrant �ounty, i exas ("Fort Worth"j, acting through Fei�iando Costa, its duly
authorized Assistant City Manager, and Upper Trinity Regional Water District, a
conservation and reclamation District created pursuant to Article XVI Section 5.9 of the
Constitution of the State of Texas located in Denton County, Texas ("Participant"), acting

WHEREAS, Fort Worth and th Participant have entered into that certain agreement
identified as City Secretary Contract No. 44806 (also the "Agreement") for fiscal year
2014 (October 1, 2013 through September 30, 2014) whereby Fort Worth will purchase
the services of a waste disposal/recycling fiim or firms and will administer a household
hazardous waste collection pi•ogi•am as authorized by Mayar and Council Communication
C-26421; and
WHEREAS, that Agreement was for an initial term of one year and that Agreement
provides foz� the extension of the term for up to three additional periods of one year each;
and ,
WHEREAS, City Secretary Contract No. 44806 A-1 extended the contract teim fi•om
October l, 2014 through Septembei• 30, 2015; and
WHERE�,S, the narties wish to extend the terin of the initial Agreement f�r an additional
year commencing on October l, 2015 through Septeinber 30, 2016; and
WHEREAS, the parties agree that all other conditions, terms, and pricing shall remain the
same as stated in City Secretary Contract No. 44806;
NOW, THEREFORE, for and in consideration of the mutual covenants contained herein,
and other good and valuable consideration, the receipt and sufficiency of which are
hereby aclaiowledged and confessed, the parties hereto agree as follows:

2. Anticipated Holida�Closures:
During the extended terin of the agreement, the Environtnental Collection Center (ECC)
will be closed on the following holidays that are obseived on days the ECC would
otherwise be open to the public:
Thanlcsgiving holiday, Thursday and Friday, November 26-27, 2015
Christmas holiday, Friday, December 25, 2015
New Year's Day holiday, Friday, Januaiy l, 2016

All definitions, tenns, conditions, and prices, as well as the rights and obligations of the
parties as set foi lh in i�ity �ecretary Lontract number 4480G shall remain uiichanged
except as expressly set forth herein.

Authorize Execution of Interlocal Agreements with Various Municipalities and Other Governmental Entities
for Participation in the Environmental Collection Center Household Hazardous Waste Program (ALL
COUNCIL DISTRICTS)
RECOMMENDATION:
It is recommended that the City Council authorize the execution of Interlocal Agreements with various
local municipalities and other governmental entities for their participation in the Environmental Collection
Center Household Hazardous Waste Program.
DISCUSSION:
The City's Environmental Collection Center is now in its 16th year of operation collecting household
hazardous waste from the residents of Fort Worth and surrounding communities on a year round basis. In
order for non-Fort Worth residents to participate at the center, each entity is required to enter into an
Interlocal Agreement with the City of Fort Worth.
The term for these Agreements will be for Fiscal Year 2014 (October 1, 2013 through September 30,
2014) with three one-year options to renew (through Fiscal Year 2017). Renewal may be effected by
written notification by the City Manager or his designated representative to the participating entity within
30 days of the expiration of the prior term and does not require specific City Council approval. The rate
per household for the period covered by these Agreements is $47.00 per household. It is anticipated that
approximately $760,000.00 will be collected annually under these Agreements. During Fiscal Year 2013,
46 entities signed participation Agreements with the City of Fort Worth. For the upcoming year, it is
expected that all of these entities will participate.
This Agreement outlines the responsibilities of each pa►ty, establishes the rate for participation, details
procedures for loan of mobile collection unit, and delineates the usage of service marked public education
materials. The City of Fort Worth is responsible for overall operation of the center including contracting
with a hazardous waste disposal company for transportation and disposal of materials collected.
The following entities are expected to execute an Agreement to participate in Fiscal Year 2014:
