HomeMy WebLinkAboutOrdinance 17928-12-2007ORDINANCE NO. 17928-12-2007 AN ORDINANCE OF THE CITY OF FORT WORTH VACATING AND EXTINGUISHING A PORTION OF AN ALLEY LOCATED IN BLOCK 54, FACTORY PLACE ADDITION, AN ADDDITION IN THE CITY OF FORT WORTH, TAI2RANT COUNTY, TEXAS AS RECORDED IN VOLUME 204-A PAGE 101 OF THE DEED RECORDS OF TAIZRANT COUNTY, TEXAS, CONTAINING APPROXIMATELY 0.184 ACRES OF LAND; PROVIDING FOR REVERSION OF FEE IN SAID LAND, PROVIDING THAT THE CITY SHALL RETAIN ALL EXISTING UTILITIES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That a portion of an existing 16-foot alley from the east right of way line of Owasso Street to the west right of way line of Margaret Street located in Block 54, Factory Place Addition, an addition to the City of Fort Worth, Tarrant County, Texas as recorded in Volume 204-A, Page 101 of the Deed Records of Tarrant County, Texas containing 8,000 square feet or 0.184 acres of land more or less, and as more specifically described in Exhibits "A" and "B" attached hereto and incorporated herein by reference be and the same is vacated and extinguished. SECTION 2. That the easement to the land in the above-described vacated street right of way is hereby released and shall revert to the adjacent owner as provided by law. SECTION 3. All existing utility easement be shall be retained by the City until such time all utilities located in that easement are relocated at the owner's expense. Ordinance No. 17928-12-2007 1 SECTION 4. Field notes for the vacation of a x6-foot wide alley in Factory Place, Block 54. BEING all of an existing x6-foot alley as recorded by the plat filed in Volume 204-A, Page xox, Deed Records, Tarrant County, Texas, situated in the westerly part of Fort Worth in Tarrant County, Texas, said alley vacation being more particularly described as follows: COMMENCING at the northeast corner of Lot 20, Bloclt 54, Factory Place, an addition to the City of Fort Worth, according to the plat filed in Volume 204-A, Page xox, Deed Records, Tarrant County, Texas, said point being at the intersection of the southerly right-of--way line of Birchman Avenue (60' right-of way) and the westerly right-of--way line of Margaret Street (60' right-of-way}; THENCE SOUTH, departing the sautherlyright-af--way line of said Birchman Avenue and with the westerly line of said Margaret Street, a distance of x~o.oo feet to a point an the northerly line ofsaid x6-foot alley, said point also being the southeast corner of said Lot za, and the POINT OF SEGI:IVNING of the herein described tract; THENCE South, continuing with the westerly line of said Margaret Street, a distance of x6.00 feet to a point in the southerly Iine of said x6-foot alley, said point also being the northeast corner of Lot xo, said Block 54> THENCE WEST, departing the westerly line of said Margaret Street and with the southerly Iine ofsaid x6-foat alley, a distance of 500.00 feet to a paint on the easterly right-of-way line of Owasso Street (60' right-of way), said paint also being the northwest corner of Lot x, said BIock 54~ THENCE NORTH, with the easterly line of said Owasso Street, a distance of x6.00 feet to a point in the northerly line of said x6-faot alley, said paint being the southwest corner of Lot xx, said Block 54, THENCE EAST; departing the easterly line of said Owasso Street and with the northerly line of said x6-foot alley, a distance of 500.00 feet to the POINT OF BEGINNING. No. 17928-12-2007 DATE: Tuesday, December 18, 2007 LOG NAME: 06VA-07-021 REFERENCE NO.: PZ-2768 SUBJECT: Adopt an Ordinance Vacating an Alley Located in Block 54, Factory Place Addition, Between Owasso Street and Margaret Street in the City of Fort Worth, Texas, and Waive Purchase Fees RECOMMENDATION: It is recommended that the City Council: 1. Adopt an ordinance vacating an alley containing 8,000 square feet of land from the east right-of-way line of Owasso Street to the west right-of-way line of Margaret Street located in Block 54 Factory Place Addition, as recorded in Volume 204-A, Page 100, Deed Records of Tarrant County; and 2. Waive any and all purchase fee value of the vacated land in accordance with City policy (M&C G-15624). DISCUSSION: Dunaway and Associates, on behalf of Christ Chapel Bible Church, has requested to vacate the above referenced right-of-way and to replat and incorporate it within the adjoining property. The City Plan Commission recommended approval of this request at its meeting on September 26, 2007. An acceptable replat (FS-07-213) has been received. Any existing utilities will be relocated at the applicant's expense, or retained within a designated easement, along with an appropriate plat note that no permanent structures may be constructed or placed thereon. The City of Fort Worth originally obtained the above mentioned right-of-way through the platting process. The City does not own land under, or adjacent to, the above referenced right-of-way. Since no City funds have been expended to purchase property or easement rights, collection of the fee value or any portion thereof is recommended by staff to be waived.
