HomeMy WebLinkAboutOrdinance 24964-08-2021 ORDINANCE NO. 24964-08-2021 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE GRANTS OPERATING FEDERAL FUND,SUBJECT TO RECEIPT OF THE GRANT,IN THE AMOUNT UP TO$528,942.00,FOR THE PURPOSE OF FUNDING THE EDWARD BYRNE MEMORIAL JUSTICE ASSISTANCE GRANT PROGRAM FOR FY2021, PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2020-2021 in the Budget of the City Manager,there shall also be increased estimated receipts and appropriations in the Grants Operating Federal Fund, subject to receipt of the grant, in the amount up to $528,942.00 for the purpose of funding the Edward Byrne Memorial Justice Assistance Grant Program for FY2021. SECTION 2. That should any portion,section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction,such decision,opinion or judgment shall in no way impair the remaining portions,sections,or parts of sections of this ordinance,which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance 24446-09-2020 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations,in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Authorize amendment to Mayor and Council Communication 21-0390 to revise the amount of the application for,and the acceptance of, if awarded,the Edward Byrne Memorial Justice Assistance Grant Program for Fiscal Year 2021 from the United States Department of Justice, Office of Justice Programs and Bureau of Justice Assistance from an amount up to$500,000.00 to the allocated amount of$528,942.00; and 2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Grants Operating Federal Fund,subject to receipt of the grant, in the allocated amount of$528,942.00. DISCUSSION: The goal of the United States Department of Justice(US DOJ)Edward Byrne Memorial Justice Assistance Grant(JAG)Fiscal Year 2021 Program,which has been established by the US DOJ, is to allow local governments to support a broad range of activities aimed at preventing crime and improving the criminal justice system.The City Council,through Mayor and Council Communication (M&C)21-0390,authorized the application for,and acceptance of,the grant funds and the execution of the associated grant agreement, related memoranda of understanding with sub-grantees,and adoption of the appropriation ordinance.The purpose of this M&C is to amend M&C 21-0390 to revise the authorized amount to be received from$500,000.00 to$528,942.00 and also revise the appropriation ordinance accordingly. The City of Fort Worth will apply for the grant in conjunction with the US DOJ identified sub-grantees determined on a formula basis through crime data.The Fort Worth Police Department(FWPD)will apply for program funding in the allocated amount of$528,942.00 for the purpose of supporting a broad range of activities aimed at preventing crime and improving the criminal justice system. Table 1 below shows the list of various FWPD Units and their requested items that were approved through the FWPD Needs Assessment budgeting process,including the Chain of Command for the effective and efficient operations of each Unit. This approved list will be used to request FWPD's portion of funding,totaling $263,889.00. Sub-grantees items and amounts to be requested are also listed. A Form 1295 is not required because:This contract will be with a governmental entity,state agency or public institution of higher education: US DOJ FISCAL INFORMATION/CERTIFICATION: The Director of Finance certifies that upon approval of the above recommendations,and adoption of the attached appropriation ordinance,funds will be available in the current operating budget,as appropriated,in the Grants Operating Federal Fund. The Police Department(and Financial Management Services)will be responsible for the collection and deposit of funds due to the City. Prior to an expenditure being incurred,the Police Department has the responsibility to validate the availability of funds. This is a reimbursement grant.
