COUNTY OF TARRANT
WHEREAS, The City of Fort Worth and Brinkley Sargent Wiginton Architects, Inc.,
(Consultant) made and entered into City Secretary Contract No. 52577 (The Contract)
which was administratively authorized, the 26th day of July, 2019, for Phase One,
Programming, Schematic Design and Cost Estimating of the Northwest Community
Center; and
WHEREAS, further amendment is necessary to reimburse the Consultant as part of the
design services agreement for additional design services for Drainage Study Models
and Report.
NOW THEREFORE, City and Consultant, acting herein by and through their duly
authorized representatives, enter into the following agreement which amends the
Contract:

Article I — Scope of Services, Paragraph (3) shall be added to read as follows:
(3) Provide additional design services for the Schematic Design, Design
Development, Construction Documents, Bidding/Negotiations and Construction
Administration Phases. The cost of this additional service is $739,750.00
including reimbursable expenses. The scope of services is described more fully
in Brinkley Sargent Wiginton Architects, Inc. Amendment 1A - Proposal dated
June 24, 2021 .

Article II — Compensation, first paragraph, is amended as follows:
"Consultant shall be compensated in accordance with the Fee Schedule shown
in Attachment "A". Payment shall be considered full compensation for all labor,
materials, supplies, and equipment necessary to complete the services
described in Attachment "A". However the total fee paid by the City shall
not exceed a total of $1 ,164,777.00 unless the City and the Consultant mutually
agree upon a fee amount for additional services and amend this
Agreement accordingly."

All other provisions of this Contract which are not expressly amended herein shall
remain in full force and effect.

SERVICES AND COMPENSATION
11.2.1 A/E BASIC SERVICES INCLUDED IN THE CONTRACT SCOPE OF WORK.
A. BASIC A/E SERVICES(ONE LEVEL STRUCTURE): $662,422
(Based upon$7,807,595 construction budget)
Basic Services Includes:
• Architecture
• MEP Engineering(SBE subcontract)
• Structural Engineering(SBE subcontract)
• All Services Noted Below
• Fees to be billed monthly by percent as follows:
i. Schematic Design 15%
ii. Design Development 25%
In. Construction Documents 35%
iv. Bidding/Negotiations 5%
v. Construction Administration 20%
The budget may be adjusted from time to time by City of Fort Worth's authorization. The Architect will
receive no adjustment in the fixed fee should the actual accepted construction bid amount vary from the
budget and subsequently be approved by the city unless it is a result from additions to the program areas.
Should the City increase the construction budget as a result of increased scope of work the Architect will
receive a fee adjustment equal to 8.25%of the budget increase.
SUPPLEMENTAL SERVICES IN ARE INCLUDED AS FOLLOWS:
*indicates services provided by SBE subcontract.
*CIVIL ENGINEERING (SITE ACCESS): "Site Access" civil engineering services is defined as those
required to site provide culvert and roadway access to the project. These services include additional
surveying, providing site horizontal control, drainage maps, paving plans, grading plans, storm water
pollution prevention plan(SW3P),and related construction administration. ($67,000)

EXCLUDED SUPPLEMENTAL SERVICES ARE AS FOLLOWS:
TECHNOLOGY DESIGN: Low voltage design will be provided by Owner. Such systems include
structured cabling, audio/visual,security and access controls. Owner shall provide timely design data and
direction as required for design team to include raceway in the electrical documents.
EQUIPMENT,FURNITURE SELECTIONS AND PROCURMENT: Assist in the selection,specification
&procurement of equipment and furnishings is excluded.

FOOD SERVICE DESIGN SERVICES: Food service design is excluded, pending possible scope to be
determined.
SUMMARY OF PROFESSIONAL FEES:
Basic Professional Services $662,422
Supplemental Services $70,600
Reimbursable Allowance (estimated) $6,728

SCOPE OF WORK ASSUMPTIONS AND EXCLUSIONS
1. Location of project is in Northwest Community Park, as concluded during the conceptual design and
programming phase.
2. Bidding and design will be executed using a single-phase construction approach and traditional CMAR
procurement method.
3. Cost estimating services is excluded beyond review of estimates provided by CNIAR. Any re-design
costs related to inaccurate estimates will be additional services.
4. Building size is approximately 20,000 sf, single story,as per approved program.
5. Anticipated design start is June of 2021.
6. Rezoning,if necessary,will be by Owner.
7. Fee excludes LEED or similar certification.
8. Contract Administrative site observation services are based on an average of twice monthly site visits
and 13 months duration.
9. Geotechnical reports will be provided by the Owner.
10. Structural engineering services are based upon utilizing a pre-engineered frame structure for the
gymnasium, and a structurally suspended foundation.
