CONULTANTS, L.L.C., FOR WATER AND SANITARY SEWER MAIN REPLACEMi=NT CONTRACT 2002 STM-O, TO PROVIDE ADDITIONAL DESIGN AND SURVEY SERVICES THE SCOPE OF THE WORK INCLUDES SOUTH HILLS AVENUE FROM UNIVERSITY DRIVE TO TRAIL LAKE bRIVE, (WATERISEWER) WEST SPURGEON STREET FROM HEMPHILL STREET TO COLi_EGE AVENUE, (WATERISEWER) TOWNSEND DRIVE WEST FROM SPURGEON STREET TO YATES STREET (WATER} AND WESTCREEK DRIVE FROM WAYSIDE DRIVE TO EDGECLIFF ROAD (WATERISEWER}.; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES AND REPEALING ALL PRIOR ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1 That in addition to thaw amounts allocated to the various City departments far Fiscal Year 2005-2006 and in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Water Capital Project Fund in the amount of $8,264.50 from available funds for the purpose of funding Amendment No. 3 to City Secretary Contract Nn. 29018 (M&C C-19700, August 12, 2003} with A.N.A. Consultants, L.L.C., for Water and Sanitary Sewer Main Replacement Contract 2002 STM-O, to provide additional design and survey services. The scope of the work includes South Hills Avenue from University Drive to Trail Lake Drive, (waterlsewer) West Spurgeon Street from Hemphill Street to College Avenue, (waterlsewer} Townsend Drive West from Spurgeon Street to Yates Street (water) and Westcreek Drive from Wayside Drive to Edgecliff Road (waterlsewer}, SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative ar void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ardinanae, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 16582 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect upon adoption. Consultants, L.L.C. for Water and Sanitary Sewer Main Replacement on Portions of South Hills Avenue, West Spurgeon Street, Townsend Drive West, and Westcreek Drive, Contract 2002 STMTO RECOMMENE?AT[ON: It is recommended that the City CounciL• 1. Autharize the transfer of $8,264.50 from the Water and Sewer Operating Fund to the Water Capita! Project Fund; 2. Adopt the attached appropriation ordinance increasing the estimated receipts and appropriations in the Water Capifial Project Fund in the amount of $8,264.50 from available funds; and 3. Autharize the City Manager to execute Amendment Na. 3 to City Secretary Contract No. 29018 with A.N.A. Consultants, L.L.C., in the amount of $16,529.00 to provide additional design and survey services, thereby increasing the contract amount to $211,325.00. The scope of work includes South Hills Avenue from University Drive to Trail Lake Drive, (waterlsewer) West Spurgeon Street from Hemphill Street fia College Avenue, (waterlsewer) Townsend Drive West from Spurgeon Street to Yates Street {water} and Westcreek Drive from Wayside Drive to Edgecliff Road (waterlsewer). Subsequent amendments, if necessary, will be processed administratively, up to a $25,000 total. ©ISCIISSION: On August 12, 2003, (M&C C-19700) the City Council authorized an engineering agreement with A.N.A. Consultants, L.L.C. in the amount of $157,093.00 for Water and Sanitary Sewer Rehabilitation Contract, 2002 STM-O. The agreement was subsequently revised by two previous amendments totaling $37,703.00 as follows: ® Amendment No. 1 (City Secretary No. 30203) in the amount of $24,793.00 and administratively approved by the City Manager on July 14, 2004, provided for the design of additional water mains; and . Amendment No. 2 (City Secretary No. 32131) in the amount of $12,901.00 and administratively approved by the City Manager on July 25, 2005, provided for additional design services an the project. Amendment Na. 3 will allow A.N.A. Consultants, L.L.C. to provide design grades for five streets on which a new curb and gutter wip be installed and the pavement surfaces overlayed with asphalt after water and k~ilp://ww~v.cfwnet.arg/cauz~cil~ac~Cei/Reports/a~xac~rint.asp 1/23/2Q06 Page 2 of 2 sanitary sewer installation is complete. A.N.A. Consultants, L.L.C. proposes to provide the additional design services for a lump sum fee of $16,529.00. Staff considers this amount to be fair and reasonable. The Transportation and Public Works Department will pay fifty percent of the cost ofi this amendment from 2005 Contract Street Maintenance Funds. A.N.A. Consultants, L.L.C., is in compliance with the city`s MIWBE Ordinance by committing to 18% MIWBB participation on this Amendment No. 3. The City's goal on this amendment is 10%. The project is located in COUNCIL DISTRICTS 3, 6 and 9, Mapsco 89 D, 90 A, L, Q, M, T and 91 .1. FISCAL WFORMATIONICERTIFICATION: The Finance Director certifes that upon approval and completion of recommendation No. 1, and adoption of the attached appropriation ordinance, funds will be available in the current capital budget, as appropriated, of the Water Capital Project Fund and the Contract Street Maintenance Fund.
