ordinance No. 16753-1-2006 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE WATER CAPITAL PROJECT FUND IN THE AMOUNT OF $49,871.83 AND THE SEWER CAPITAL PROJECT FUND IN THE AMOUNT DF $65,580.73 FROM AVAILABLE FUNDS FOR THE PURPOSE OF FUNDING AN ENGINEERING AGREEMENT WITH RJN GROUP, INC. FOR PAVEMENT RECONSTRUCTION AND WATER AND SANITARY SEWER MAIN REPLACEMENT ON HATCHER STREET (QUAILS LANE TO HARDEMAN STREET}, CHICKASAW AVENUE (SHACKLEFORD STREET TO MILLER AVENUE}, JENNIFER COURT (EASTLAND STREET TO EASTLAND STREET}, LOTS STREET (SYDNEY STREET TO EAST DEAD END}, NORRIS STREET (CROUCH AVENUE TO EAST DEAD END}, SYDNEY STREET (EAST BERRY STREET TO REED STREET} AND WHITEHALL STRI=ET {MILLER AVENUE TO PATE DRIVE)}; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments far Fiscal Year 2(365-2QQ6 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Water Capital Project Fund in the amount of $49,871.83 and the Sewer Capital Project Fund in the amount of $65,580.73 from available funds for the purpose of funding an engineering agreement RJN Group, Inc. for pavement reconstruction and water and sanitary sewer main replacement on Hatcher Street (Quails Lane to Mardeman Street), Chickasaw Avenue (Shackieford Street to Miller Avenue), Jennifer Gourt (Eastland Street to Eastland Street), Lais Street (Sydney Street to East Dead End}, Norris Street (Crouch Avenue to East Dead End}, Sydney Street (East Berry Street to Reed Street} and Whitehall Street (Miller Avenue to Pate Drive). SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inopera#ive or void for any reason by a court of competent jurisdiction, such decision, opinion ar judgment shall in na way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance Nn. 16582 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Authorize the transfer of $115,482.56 from the Water and Sewer Operating Fund to the Water Capital Project Fund in the amount of $49,871.83 and Sewer Capital Project Fund in the amount of $65,580.73; 2. Adapt the attached appropriation ordinance increasing estimated receipts and appropriations in the Water Capital Prnject Fund in the amount of $49,871.83 and the Sewer Capital Project Fund in the amount of $65,580.73, from available funds; and 3. Authorize the City Manager to execute an engineering agreement with RJN Group, Inc., in the amount of $221,908.05 for pavement reconstruction and water and sanitary sewer main replacement an Hatcher Street (Quails Lane to Hardeman Street), Chickasaw Avenue (Shackleford Street to Miller Avenue), Jennifer Court (Eastland Street to Eastland Street}, Lois Street {Sydney Street to East Dead End), Norris Street (Crouch Avenue to East Dead End}, Sydney Street (East Berry Street #n Reed Street) and Whitehall Street {Miller Avenue to Pate Drive). DtSCUSSI'QN: The 2004 Capital Improvement Program (CIP} includes funds far Pavement reconstruction and Water and Sewer Operating Fund includes funds for water and sanitary sewer main replacement an Hatcher Street (Quails Lane fo Hardeman Street), Chickasaw Avenue (Shackleford Street to Miller Avenue), Jennifer Court (Eastland Street to Eastland Street), Lois Street (Sydney Street to East Dead End), Norris Street (Crouch Avenue to East Dead End), Sydney Street (East Berry Street to Reed Street) and Whitehall Street {Miller Avenue to Pate Drive). This project consists of the preparation of plans and specifications for the replacement of water and sanitary sewer mains and pavement reconstruction an the above identified streets. RJN Group, lnc., proposes to perform the necessary design work for a lump sum fee of $221,908.05. City stafF considers this fee to be fair and reasonable for the scope of services proposed. In addition to the contract amount $39,029.86 (water: $7,249.50; sewer: $5,630.63; and streets: $26,149.73) is required for project management by the Engineering Department. RJN Group, Inc., is in compliance with the City's MIVVBE Ordinance by committing to 24% MIWBE participation.
