AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND
APPROPRIATIONS IN THE WATER AND SEWER CAPITAL PROJECTS FUND
IN THE AMOUNT OF$529,795.00,TRANSFERRED FROM AVAILABLE FUNDS
IN THE WATER AND SEWER FUND, FOR THE PURPOSE OF FUNDING THE
WATER AND SANITARY SEWER REPLACEMENTS CONTRACT 2020,WSM-D
PROJECT (CITY PROJECT NO. 103419); PROVIDING FOR A SEVERABILITY
CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR
ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH;
AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That in addition to those amounts allocated to the various City departments for Fiscal Year 2020-2021 in the
Budget of the City Manager,there shall also be increased estimated receipts and appropriations in the Water
and Sewer Capital Projects Fund in the amount of$529,795.00,transferred from available funds in the Water
and Sewer Fund, for the purpose of funding the Water and Sanitary Sewer Replacements Contract 2020,
WSM-D project(City Project No. 103419).
SECTION 2.
That should any portion,section or part of a section of this ordinance be declared invalid,inoperative or void
for any reason by a court of competent jurisdiction,such decision,opinion or judgment shall in no way impair
the remaining portions,sections,or parts of sections of this ordinance,which said remaining provisions shall
be and remain in full force and effect.
SECTION 3.
That this ordinance shall be cumulative of Ordinance 24446-09-2020 and all other ordinances and
appropriations amending the same except in those instances where the provisions of this ordinance are in
direct conflict with such other ordinances and appropriations,in which instance said conflicting provisions of
said prior ordinances and appropriations are hereby expressly repealed.
SECTION 4.
This ordinance shall take effect upon adoption.

RECOMMENDATION:
It is recommended that the City Council:
1. Authorize execution of an engineering agreement with MAS Consultants,LLC,in the amount of$269,495.00 for Water and Sanitary Sewer
Replacement Contract 2020,WSM-D project;and
2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Water and Sewer Capital Projects Fund
in the amount of$529,795.00 transferred from available funds within the Water and Sewer Fund,for the Water and Sanitary Sewer
Replacements Contract 2020,WSM-D(City Project No. 103419).
DISCUSSION:
This Mayor and Council Communication(M&C)is to authorize execution of an engineering agreement with MAS Consultants,LLC,in the amount
of$269,495.00 for Water and Sanitary Sewer Replacement Contract 2020,WSM-D project for the preparation of plans and specifications for
sanitary sewer and water main replacements on the following streets,alleys and easements:

In addition to the contract amount,$260,300.00(Water:$133,050.00;Sewer:$127,250.00)is required for project management, real property
acquisition, utility coordination,and material testing.This project will have no impact on the Water Department's operating budget when completed.
The sewer component of the project is part of the Water Department's Sanitary Sewer Overflow Initiative Program.Due to insufficient funds
remaining in the Water Pay-As-You Go allocation for Fiscal Year 2021,Sewer funding is being used to fund the Water construction cost required in
this M&C.

Business Diversity:MAS Consultants,LLC,is in compliance with the City's Business Equity Ordinance by committing to 10 percent Business
Equity participation on this project.The City's Business Equity goal on this project is 10 percent.
The project is located in COUNCIL DISTRICTS 7 AND 9.
FISCAL INFORMATION/CERTIFICATION:
The Director of Finance certifies that funds are currently available in the Water and Sewer Fund,and upon approval of the above recommendations
and adoption of the attached appropriation ordinance,funds will be available in the W&S Capital Projects Fund for the W/SS Repl Contract 2020
WSM-D project to support the approval of the above recommendations and execution of the engineering agreement.Prior to any expenditure
being incurred,the Water Department has the responsibility of verifying the availability of funds.
