Ordinance No. 16757-1 ~-2006 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE WATER CAPITAL PROJECT FUND IN THE AMOUNT OF $266,972 AND THE SEWER CAPITAL PROJECT FUND 1N THE AMOUNT OF $343,378 FROM AVAILABLE FUNDS FOR THE PURPOSE OF FUNDING A CONTRACT WITH STABILE & WINN, INC. FOR PAVEMi=NT RECONSTRUCTION AND WATER AND SANITARY Si~WER REPLACEMENT ON DONALEE STREET FROM REED STREET TO HIGHWAY 287 (MLK FREEWAY) AND KILLIAN STREET TO HIGHWAY 287; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES IN CONFLICT HERE=WITH; AND PROVIDING AN EFFECTIVE DATi=. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SE=CTION 1. That in addition to those amounts allocated to the various City departments for Fiscai Year 2005-2006 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Water Capital Project Fund in the amount of $266,972 and the Sewer Capital Project Fund in the amount of $343,378 from available funds for the purpose of funding a contract with Stabile & Winn, Inc. for Pavement Reconstruction and Water and Sanitary Sewer Replacement on Donalee Street from Reed Street to Highway 287 (MLK Freeway) and Killian Street to Highway 287 SECTION 2. That should any portion, section or part of a section ofi this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion ar judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in fuEl force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. '16582 and ail other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct confilict with such other ordinances and apprapriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Authorize the transfer of $610,350.00 from the Water and Sewer Operating Fund to the Water Capital Project Fund in the amount of $28fi,972.00 and Sewer Capital Project Fund in the amount of $343,378.00; 2. DISCUSSION: On September 7, 2004, (M&C C-20258} the City Council authorized the City Manager to execute an engineering agreement with Teague Nall & Perkins, Inc., for the design of Donalee Street from Reed Street to MLK Freeway and Kiiiian Street from Shackelford Street to MLK Freeway (©OE 4575), which consists of pavement reconstruction. The 2004 Capital Improvement Program {CIP) includes funds for pavement reconstruction of Danalee Street from Reed Street to MLK Freeway and Killian Street from Shackelford Street to MLK Freeway. Street improvements include pavement reconstruction, construction of standard concrete curb and gutter, driveway approaches and sidewalks as indicated on the plans. The Water Department has determined that water and sanitary sewer lines should be replaced prior to street reconstruction. The project was advertised on August 4, 2DD5 and August 11, 2D05. Alternate "A" consists of a 6-inch concrete over 6-inch lime stabilized subgrade with 7anch concrete curb. Alternate "B" consists of a 6-inch hot mix asphalt cancrete (HMAC) over 8-inch lime stabilized subgrade with 7-inch concrete curb and 18-inch gutter. After reviewing all bid proposals, staff recommends Alternate "A" (concrete) for construction because the use of concrete will result in less maintenance cast over the street's useful fife. Funding in the amount of $58,483.00 is included for associated water and sewer construction survey, project management, pre-construction, material testing, inspection and project close out (water $25,480.00 and sewer $33,003.00}. The contingency funds to cover change orders total $29,068.50 (water $14,943.50 and sewer $14,125.00}. Funding in the amount of $85,515.64 is required far associated paving and drainage construction survey, project management, pre-construction, material testing, inspection and project close out. Contingency for pavement reconstruction is $25,000.00. MIWBE -- Stabile & Winn, Inc., is in compliance with the City's MIWBE Ordinance by committing to 46% MNVI3E participation. The City's goal on this project is 29%. This project is located in COUNCIL DISTRICT 5 Mapsco 78Y and 92C, D.
