Ordinance No. 167'5$-1-2006 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS iN THE WATER CAPITAL PROJECT FUND IN THE AMOUNT OF $408,647 AND THE SEWER CAPITAL PROJECT FUND IN THE AMOUNT OF $400,030 FROM AVAILABLE FUNDS FOR THE PURPOSE OF FUNDING A CONTRACT WITH MCCLENDON CONSTRUCTION, INC. FOR PAVEMENT RECONSTRUCTION AND WATER AND SANITARY SEWER REPLACEMENT ON GRIGGS AVENUE TO PANOLA STREET TO SOUTH DEAD END, MARTHA LANE FROM MONTCLAIR STREET TO QUEEN STREET, SAN JOSE DRIVE FROM MEADOWBROOK DRIVE TO JEWELL AVENUE, VIEW STREET FRO BARRON STREET TO 280 FEET WEST OF TANDY DRIVE, MARION AVENUE FROM SOUTH JONES STREET TO SOUTH FREEWAY FRONTAGE ROAD AND EAST ROBERTS STREET FROM SOUTH JONES STREET TO SOUTH FREEWAY FRONTAGE ROAD (2004 CIP PROJECT NO. 00025}; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1 That in addition to those amounts allocated to the various City departments for Fiscal Year 2005-2006 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Water Capital Project Fund in the amount of $408,647 and the Sewer Capital Project Fund in the amount of $400,030 from availabie funds far the purpose of funding a contract with McClendon Construction, Inc. far Pavement Reconstruction and Water and Sanitary Sewer Replacement on Griggs Avenue to Panola Street to South Dead End, Martha Lane from Montclair Street to Queen Street, San Jose Drive from Meadowbrook Drive to Jewell Avenue, View Street fro Barran Street to 280 feet West of Tandy Drive, Marian Avenue from South Janes Street to South Freeway Frontage road and East Roberts Street from South Janes Street to South Freeway Frontage Road (2004 CIP Project No. 00025}. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void far any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, ar parts of sections of this ordinance, which said remaining provisions shall be and remain in full farce and effect. SECTION 3. That this ordinance shall be cumulative at Ordinance Na. 16582 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressiy repealed. Authorize the transfer of $8D8,~77.00 from the Water and Sewer Operating Fund to the Water Capital Project Fund in the amount of $408,647.D0 and Sewer Capital Project Fund in the amount of $4DD,D30.00; 2. Adapt the attached appropriation ordinance increasing estimated receipts and appropriations in the Water Capital Project Fund in the amount of $408,847.DD, .and the Sewer Capital Project 1=und in the amount of $400,030.00, from available funds; and 3. Authorize the City Manager to execute a contract with McClendon Construction, Inc., in the amount of $1,541,501.84 for pavement reconstruction and water and sanitary sewer replacement on Griggs Avenue from Panola Street to S. Dead End, Martha Lane from Montclair Street to Queen Street, San Jose Drive from Meadowbrook Drive to Jewell Avenue, View Street from Barran Street to 280 feet West of Tandy Drive, Marion Avenue from South Jones Street to South Freeway Frontage Rnad and East Roberts Street from South Jones Street to South Freeway Frontage Road {2DD4 CIP Project No. 00025}. ©ISCUSSIOIV: On September 7, 2004, (M&C C-2D257} the City Council authorized the Cify Manager to execute an engineering agreement with RJN Group, Inc., far the design of Griggs Avenue from Panola Street to South Dead End, Martha Lane from Montclair Street to Queen Street, San Jose Drive from Meadowbrook Drive to Jewell Avenue, View Street from Barron Street to 28D feet West of Tandy Drive, Marion Avenue from South Jones Street to South Freeway Frontage Road and East Roberts Street from Saufih Jones Street to South Freeway Frontage Road {DOE 4578). The 2004 Capital Improvement Program {CIP} includes funds for pavement reconstruction. Street improvements include pavement reconstruction, construction of standard concrete curb and gutter, driveway approaches and sidewalks as indicated on the plans. The Water Department has determined that water and sanitary sewer lines should be replaced prior to street reconstruction. On September 8, 2DD5, the following bids were received: Biciclers McClendon Construction Co.,...Inc.. Stabile & Winn, lnc. JLB Contracting, L.P. Alternate A Alternate B (As~_phalt~ fConcretel Nn Bid 1~541,5Q9.$4 $1,528,596.3E1 Na Bid Na Bid $1,537,784.39 Time of Completion: 240 Working Days Bids were received on two alternates: Alternate "A" consists of a 6-inch hot mix asphalt concrete {HMAC) aver 8-inch lime stabilized subgrade with 7-inch concrete curb and 18-inch gutter. d Alternate "B" consists of a 6-inch concrete over 6-inch lime stabilized subgrade with 7-inch concrete curb. Stabile & Winn, Inc., was the apparent low bidder for Alternate "A" (Asphalt Pavement) and did not bid for Alternate "B"' (Concrete Pavement). JLB Contracting, the second low bidder made a mistake in pricing for concrete sidewalk and will not honor the bid price due to the error. The third low bidder, McClendon Construction, Co. lnc., bid only for Alternate "A" (Concrete Pavement). After reviewing all bid proposals, staff recommends Alternate "B" (concrete) for construction since the use of concrete will result in less maintenance cost over the street's useful life and the cast difference between the asphalt and concrete pavement is less than 2%. Funding in the amount of $69,630.00 is included far associated water and sewer construction survey, project management, pre-construction, material testing, inspection and project close out (water $32,487.00 and sewer $37,143.00). The contingency funds to cover change orders total $35,992.20 (water $17,912.00 and sewer $17,280.20). Funding in the amount of $77,016.00 is required for associated paving and drainage construction survey, project management, pre-construction, material testing, inspection and project close out. Contingency for pavement reconstruction is $25,129.41. MNVBE -McClendon Construction Co Inc. is in compliance with the City's MIWBE Ordinance by committing to 9% M/WBE participation and documentation good faith effort. The City's goal an this project IS 23%. This project is located in COUNCIL DISTRICT 8.
