HomeMy WebLinkAboutOrdinance 16760-01-2006Ordinance No. 16760-1-2006 AN ORDINANCE INCREASING THE ESTIMATEb RECEIPTS AND APPROPRIATIONS IN THE WATER CAPITAL PROEJCT 1=UND {CONSTRUCTION ACCOUNT) IN THE AMOUNT OF $2,884,732.44 FROM AVAILABLE FUNDS, FOR THE PURPOSE OF FUNDING AN ENGINI=EKING AGREEMENT WITH FREESE & NICHOLS, INC. FOR THE CONSTRUCTION MANAGEMENT OF THE EAGLE MOUNTAIN WATER TREATMENT PLANT, RAW WATER PUMP STATION, RAW WATER INTAKI=, AND RAW WATER TRANSMISSION MAIN; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES AND REPEALING ALL PRIOR ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF TH)~ CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments far Fiscal Year 20Q5-2D06 and in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Water Cap'stal Project Fund (Construction Account) in the amount of $2,884,732.44 from available funds for the purpose of funding an engineering agreement with Freese & Nichols, Inc. for the Construction Management of the Eagle Mountain Water Treatment Plant, Raw Water Pump Station, Raw Water Intake, and Raw Water Transmission Main. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion ar judgment shall in na way impair the remaining portions, sections, nr parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 16582 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Water Capital Project Fund in the amount of $2,884,732.44 from impact fees; 2. Authorize the transfer of $2,884,732.44 from the Water Capita[ Project Fund (impact fee collection account) to the Water Capital Project Fund (construction account}; 3. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Water Capital Project Fund in the amount of $2,884,734.44 from available funds; and 4. Authorize the City Manager to execute an engineering agreement with Freese & Nichols, loc., in the amount of $2,884,732.44 far the Construction Management of the Eagle Mountain Water Treatment Plant, Raw Water Pump Station, Raw Water lntake and Raw Water Transmission Main. DISCUSSION: The Eagle Mountain Water Treatment Plant (EMWTP} was originally constructed in 1992 and was subsequently expanded in 2001 to 70 million gallons per day (MGD} capacity. The EMWTP primarily serves north Fort Worth along with wholesale customer cities such as Keller and Southlake. The recently completed Water Master Plan predicts total peak flow for the northside pressure plan will exceed the delivery capacity by 2007. In order to meet the projected peak day demands, the Water Master Plan recommends that the EMWTP and raw water delivery system be expanded to 105 MGD capacity, with construction to be substantially complete prior to the summer of 2007. On August 24, 2004, the City Council authorized three design contracts for the EMWTP and raw water delivery system expansion. Firm Contract C3esign Fee M&C Ng. Raw Water Transmission Main $799,855.00 C-20237 On October 24, 2008, the City Council authorized the award of a construction contract far the EMWTP krttp://www.cfwnet.orglcouz~cil~aclcet/Reports/mc~rint.asp 1 /23/2006 Page 2 of 2 Phase III Expansion to Oscar Renda Contracting in the amount of $43,714,900 and the Eagle Mountain Raw Water Pump Station improvements to Archer Western Contractors, Ltd. in the amount of $6,888,500. Two remaining construction contracts, consisting of the Eagle Mountain Raw Water Intake Improvements and the Eagle Mountain Raw Water Transmission Main will be advertised fnr bid in December 2005. Freese & Nichols was selected to perform the construction management based on their familiarity with both the existing plant layout and the current design components, having provided the construction management on earlier Eagle Mountain Water Treatment Plant expansions, as well as serving as the Eagle Mountain Expansion Program Manager during the design process. The scope of work within the construction management services includes the construction contract administration, inspection and testing services for all four construction contracts. This project is located in COUNCIL DISTRICT 7 and northwest Tarrant County. Freese & Nichols, Inc., is complying with the City's M/WBE policy by committing 16% MIVIIBE participation on this project.
