Authorize execution of a contract with Flow -Line Construction, Inc., in the amount of $2,098,430.00 for Northeast Northside II 30-inch Water Transmission Main Along State Highway 170 - Part 2; and 2. Adopt the attached Appropriation Ordinance increasing estimated receipts and appropriations in the Water and Sewer Capital Projects Fund in the amount of $451,271.00 for Northeast Northside II 30-inch Water Transmission Main Along State Highway 170 - Part 2 (City Project No. 100261) transferred from available funds within the Water and Sewer Fund. DISCUSSION: The Texas Department of Transportation (TXDOT) is proposing to construct four main lanes and associated improvements along State Highway (SH) 170 from 0.5 miles East of Interstate Highway (IH) 35W to Trophy Lake Drive. As part of the TXDOT improvements along SH 170, four city existing water main crossings in direct conflict with the proposed roadway improvements will require relocation. The conflicting crossing locations are at Beach Street, Alta Vista Road, Westport Parkway and Independence Parkway. In accordance with the terms of the Utility Agreement between TXDOT and the City, TXDOT will reimburse the City for all costs incurred with the relocation of the Beach Street crossing because the water main was installed in an easement. This project consists of the relocation of the conflict at the SH 170 and Beach Street intersection. On April 7, 2020, Mayor and Council Communication (M&C 20-0168), the City Council adopted an appropriation ordinance in the Water and Sewer Capital Projects Fund for the amount of $2,264,435.00 and authorized the execution of Amendment No. 2 to City Secretary Contract No. 48423, an engineering agreement with CP&Y, Inc. for the Northeast Northside II Water Main along SH 170 from North Beach Street to US 377 as well as authorized the execution of an agreement with TXDOT for the relocation of City water facilities related to the construction of SH 170 from 0.5 miles East of IH 35W to Trophy Lake Drive. The sum of $1,997,450.00 out of the previously appropriated $2,264,435.00 is part of the current contract that will be approved with this M&C with Flow -Line Construction, Inc. for the relocation of the four conflict locations identified above. Construction of the project was advertised for bid on June 25, 2020 and July 2, 2020 in the Fort Worth Star -Telegram. This project will have no impact on the Water Department's operating budget when completed. M/WBE OFFICE: Flow -Line Construction, Inc., is in compliance with the City's BDE Ordinance by committing to ten percent MBE participation on this project. The City's MBE goal on this project is ten percent. Additionally, Flow -Line Construction, Inc. is a certified M/WBE. The project is located in COUNCIL DISTRICT 7. FISCAL INFORMATION / CERTIFICATION: The Director of Finance certifies that funds are available in the current operating budget, as previously appropriated, in the Water & Sewer Fund and upon approval of the above recommendations and adoption of the attached appropriation ordinance, funds will be available in the W&S Capital Projects Fund for the NSII Water Main Along SH170 project.
