AUTHORIZING THE WAIVER OF CERTAIN PUBLIC RIGHT OF WAY PERMIT FEES FOR THE CONSTRUCTION OF THE TARRANT COUNTY LAW ENFORCEMENT MEMORIAL WHEREAS, Tarrant County plans to construct the Tarrant County Law Enforcement Memorial ("Memorial") which is a memorial for law enforcement officers who have lost their lives in the line of duty since the establishment of Tarrant County in 1849; and WHEREAS, the project is being funded with donations from private citizens and various businesses; and WHEREAS, temporary street use is required for the construction of the Memorial on the 100 block of North Houston Street and the City of Fort Worth ("City") requires a street use permit fee for such temporary street use; and WHEREAS, use of space on the sidewalk for construction activity is required on the 100 block of North Houston and the 100 block of West Weatherford Streets and the City requires a temporary encroachment fee for such use of space on the sidewalk; and WHEREAS, use of space in the parking lane for construction activity is required on the 100 block of West Weatherford Street and the City requires a parking meter permit fee for the use of space in a parking lane; and WHEREAS, the County requests that the City waive all appropriate street use, encroachment, and parking permit fees associated with the construction of the Memorial for the length of time required to complete the Memorial; and WHEREAS, the City Manager's Office recommends that all appropriate street use, encroachment, and parking permit fees associated with the construction of the Memorial for a total of $10,779.40 be waived during the length of time required to complete the Memorial, which is estimated to be completed in 90 days, starting in November 2020. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS, THAT: The Tarrant County Law Enforcement Memorial provides a public purpose by commemorating the service of law enforcement officers who have lost their lives in the line of duty since the establishment of Tarrant County. 2. The City Manager is authorized to waive all appropriate parking, street use, and encroachment permit fees associated with the construction of the Tarrant County Law Enforcement Memorial and provide sufficient controls to ensure the waiver of fees will achieve the public purpose outlined above.
