AMENDMENT No. 3
TO CITY SECRETARY CONTRACT No.
WHEREAS, the City of Fort worth (CITY) and Kennedy Consulting, Ltd. ,
(ENGINEER) made and entered into City Secretary Contract No. 38775, the
CONTRACT) which was authorized by M&C C-23596 on the 16th day of June,
2009 in the amount of $ 1, 465, 379; and
WHEREAS, the CONTRACT was subsequently revised by: Amendment Number
1 in the amount of $ 21, 154 . 05 which as administratively authorized on
the 29th day of November, 2010, Amendment Number 2 in the amount of
$121, 950 . 80 which as authorized by M&C # C-25348 on the 9th day of June,
2012; and
WHEREAS, the CONTRACT involves engineering services for the
following project:
Dirks Road Phase 2 from Bryant Irvin Road to Cranbury Road: and
WHEREAS, it has become necessary to execute Amendment No. 3 to the
CONTRACT to include an increased scope of work and revised fee.
NOW THEREFORE, CITY and ENGINEER, acting herein by and through their
duly authorized representatives, enter into the following agreement,
which amends the CONTRACT:

Article I of the CONTRACT is amended to include the additional
engineering services specified in a proposal dated June 7, 2012, a copy
of which is attached hereto and incorporated herein. The cost to City
for the additional design services to be performed by Engineer totals
$64, 400 . 00 . (See Attached Funding Breakdown Sheet, Page -3-)

Article II of the CONTRACT is amended to provide for an increase in
the fee to be paid to Engineer for all work and services performed under
the Contract, as amended, so that the total fee paid by the City for all
work and services shall be an amount of $1, 672, 883 . 85 .
3 .
All other provisions of the Contract, which are not expressly
amended herei in full force and effect .

Proposal to provide:
l} Add continuous lighting from proposed SH 121 to Granbury Rd.
2) Add relocation of~100 LF of 24-inch water line conflicting with proposed
Dirks Rd. improvements.
Dear Mr. Wilson:
This letter is written in response to your request for Kennedy Consulting, Ltd. to prepare
a contract amendment for additional engineering services to amend and/or develop
additional construction documents for Dirks Road (East) due to the addition of
continuous lighting from SH 121 to Cranbury Rd and relocation of—100 LF of 24-inch
water line conflicting with the proposed Dirks Road(East) improvements.
Kennedy Consulting, Ltd. will complete the following additional scope:
Additional Project Sco a--Continuous Liahtiny.
The contract amendment shall include the design a continuous lighting system for Dirks
Road East from proposed SH 121 to Cranbury Road in accordance with Texas
Department of Transportation (TxDOT) and City of Fort Worth standards.
Additional Protect Scope::Water Line Relocation
The contract amendment shall also include the relocation of City of Fort Worth's (City)
water facilities that are in conflict with the proposed storm drain improvements for the
Dirks Road East reconstruction. Approximately 100 LF of 24-inch water relocations are
planned due to these conflicts.

Authorize Execution of Amendment No. 3 to City Secretary Contract No. 38775, an Engineering Agreement
with Kennedy Consulting, Ltd., in the Amount of$64,409.00 for the Design of Dirks Road from Bryant Irvin
Road to Cranbury Road for a Total Contract Amount of$1,672,883.85 (COUNCIL DISTRICTS 3 and 6)
RECOMMENDA'T'ION:
It is recommended that the City Council authorize the execution of Amendment No. 3 to City Secretary
Contract No. 38775, an engineering Agreement, with Kennedy Consulting, Ltd., in the amount of
$64,400.00 for the design of Dirks Road from Bryant Irvin Road to Oranbury Road, thereby revising the
total contract amount of$1,672,883.85.
DISCUSSION:
This Agreement is for design services associated with the construction of Dirks Road as a six lane divided
principal arterial from Bryant Irvin Road to Oranbury Road. Phase I of the Project has been completed.
This Amendment applies to the design for Phase II.
The proposed Amendment is for additional design services associated with the relocation of an existing
24-inch waterline which is in conflict with proposed storm drainage box culverts and more efficient
construction sequencing as well as the design of streetlights which were not included in the original design
scope,
The City Council approved an Engineering Agreement for this project with Kennedy Consulting, Ltd., on
June 16, 2009, (M&C C-23596) in the amount of$1,465,379.00. Amendment No. 1 was administratively
approved on November 29, 2010 in the amount of$21,154.05. Amendment No. 2 was approved by the
City Council on December 13, 20117 (M&C C-25348) in the amount of$121,950.80. Funding for this
Amendment will be provided from the 2007 Critical Capital Projects Fund. Kennedy Consulting, Ltd.,
proposes to perform these design services for a lump sum fee of$64,400.00. Staff considers this fee to
be fair and reasonable for the scope of services proposed.
Kennedy Consulting, Ltd., is in compliance with the City's MNVBE Ordinance by committing to an
additional 23 percent MNVBE participation on this Amendment No. 3. The City's goal on this Amendment
is 23 percent.
This project is located in COUNCIL DISTRICTS 3 and 6, Mapsco 102B, 1020 and 102D.
FISCAL INFORMATION 1 CERTIFICATION:
wrhe Financial Management Services Director certifies that funds are available in the current capital
budget, as appropriated, of the 2007 Critical Capital Projects Fund.
