AN ORDINANCE VACATING AND EXTINGUISHING VARIABLE
WIDTH ALLEY RIGHTS -OF -WAY AND AN EMERGENCY ACCESS
EASEMENT CROSSING PORTIONS OF LOTS 13 -R, 17 -R AND 37 -R IN
THE J.A. LEE'S SUBDIVISION OF BLOCK 8, FIELDS -WELCH
ADDITION, AN ADDITIONTO THE CITY OF FORT WORTH,
TARRANT COUNTY, TEXAS, AS FILED IN VOLUME 106, PAGE 127
AND VOLUME 388 -98, PAGE 26 RESPECTIVELY OF THE PLAT
RECORDS OF TARI2ANT COUNTY, TEXAS; CONTAINING
APPROXIMATELY 9,107 SQUARE FEET OR 0.209 ACRE OF LAND;
PROVIDING FOR REVERSION OF FEE IN SAID LAND; THE
RETAINMENT OF EXISTING UTILITY EASEMENTS; REPEALING
ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That a portion of variable width alley rights -of -way and all of a pedestrian and emergency
access easement, situated in and being a portion of J.A. Lee's Subdivision of Block 8, Fields-
Welch Addition, an addition to the City of Fort Worth, Tarrant County, Texas as recorded in
Volume 106, Page 127 of the Plat Records of Tarrant County, Texas, and also being a portion of
J.A. Lee's Subdivision of Block 8, Fields -Welch Addition, an addition to the City of Fort Worth,
Tarrant County, Texas, as recorded in Volume 388 -98, Page 26 of the Plat Records of Tarrant
County, Texas; containing approximately 9,107 square feet or 0.209 acres of land more or less,
and as more specifically described in Exhibits "A" and "B" attached hereto and incorporated
herein by reference be and the same is vacated and extinguished.

SECTION 2.
That the fee to the lands in the above - described vacated alleys and easements are hereby
released and shall revert to the adjacent owner as provided by law.
SECTION 3.
That all existing utility easements shall be retained by the City until such time all utilities
located in the easements are relocated at the owner's expense.
SECTION 4.
That all ordinances or parts of ordinances in conflict herewith are hereby repealed.
SECTION 5.
That this ordinance shall take effect upon adoption.

Adopt Ordinance Vacating an Alley and a Pedestrian and Emergency Access Easement Near the
Intersection of West Terrell Avenue and South Lake Street (COUNCIL DISTRICT 9)
It is recommended that the City Council:
1. Adopt the attached ordinance vacating alley and a pedestrian and emergency access easement in
JA Lee's Subdivision of Block 8, Fields Welch Addition, which is near the intersection of West Terrell
Avenue and South Lake Street; and
2. Waive any and all purchase fee value of the vacated land in accordance with City Policy (M&C G-
15624).
DISCUSSION:
Teague | and Perkins, Inc., on behalf ofTexas Health Reaourceu, has requested the vacation of these
rights-of-way to vep|atthem with the adjoining property for a new emergency department building. The Qty
Plan Commission recommended approval of this request at its meeting un June 27,2012. An acceptable
rep|at(FS-011-182) has been received.
The City of Fort Worth (City) originally obtained the above mentioned rights-of-way through the platting
process. The City does not own land under or adjacent to the above referenced alley or pedestrian and
emergency access easement. Since no City funds have been expended to purchase property or
easement rights, collection of the fair market value or any portion thereof is recommended by Staff to be
