AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND
APPROPRIATIONS IN THE GRANTS FUND IN THE AMOUNT OF $375,415.96,
SUBJECT TO RECEIPT OF A MOTOR CARRIER SAFETY ASSISTANCE
PROGRAM HIGH PRIORITY GRANT FROM THE UNITED STATES DEPARTMENT
OF TRANSPORTATION, FEDERAL MOTOR CARRIER SAFETY ASSISTANCE
PROGRAM, FOR THE PURPOSE OF CONDUCTING COMMERCIAL MOTOR
VEHICLE ENFORCEMENT AND PUBLIC OUTREACH; PROVIDING FOR A
SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR
ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND
PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That in addition to those amounts allocated to the various City departments for Fiscal Year 2011-2012 in the
Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Grants
C,
Fund in the amount of $375,415.96, subject to receipt of a Motor Carrier Safety Assistance Program High
Priority Grant from the United States Department of Transportation, Federal Motor Carrier Safety
Assistance Program� for the purpose of conducting commercial motor vehicle enforcement and public
outreach.
SECTION 2,
That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or
void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way
impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining
provisions shall be and remain in full force and effect.
SECTION 3
That this ordinance shall be cumulative of Ordinance No.1 991 1 -09 -20 1 1 and all other ordinances and
appropriations amending the same except in those instances where the provisions of this ordinance are in
direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions
of said prior ordinances and appropriations are hereby expressly repeated.
SECTION 4.
This ordinance shall take effect upon adoption.

the United States Department of Transportation, Federal Motor Carrier Safety Assistance Program in the
Amount Upto$29O.478.12toConduct Commercial Motor Vehicle Enforcement and Public Outreach,
Authorize Execution of the Grant Agreement for Acceptance of Grant Funds, Authorize Matching Funds in
the Amount Up to $84,939.84 and Adopt Appropriation Ordinance (ALL COUNCIL DISTRICTS)
RECOMMENDATION:
It is recommended that the City Council:
1. Ratify the application for and acceptance ofa Motor Carrier Safety Assistance Program High Priority
Grant from the United States Department nfTransportation, Federal Mob]/ Carrier Safety Assistance
Program in the amount upto$29O'470.12;
2. Authorize the execution of a grant Agreement with the United States Department of Transportation to
conduct Commercial Motor Vehicle Enforcement and Public Outreach;
3. Authorize the City to provide an in-kind match associated with the grant of twenty percent of the total
project cost in the amount up to $84,939.84; and
4. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the
Grants Fund in the amount of $375,415.96 upon receipt of the award.
For Fiscal Year 2012, the Federal Motor Carrier Safety Administration (FMCSA) offered local law
enforcement agencies grant funding for a High Priority Grant in support of safety initiatives to perform
Commercial Motor Vehicle (CMV) traffic enforcement and education. The City submitted a grant
application for funding to be used to conduct vehicle and driver inspections in high crash locations within
the City of Fort Worth. A major focus of the City's program will be to continue efforts that began with Fiscal
Year 2010 funding directed toward aggressive drivers in these high crash locations. The grant funding will
provide for overtime hours, equipment and training sessions of motor carrier inspectors, as well as funding
for enforcement and administrative duties related to the grant. Commercial vehicle enforcement hours will
be dedicated to three separate operations within the City. Approximately 1040 hours will fund 52, four-
hour commercial vehicle inspection details, 672 hours will be dedicated to 12, eight-hour commercial
vehicle inspection details and 832 hours are budgeted for 52, four-hour aggressive driving enforcement
Approximately Z32 overtime hours will be funded for the Police Department to provide safety education
related to proper driver-vehicle inspection procedures, load securement and hazardous driving behaviors
to owners and drivers of commercial vehicles, The total program budget amount will not exceed the
amount of$37S.415.90. The federal share of the total project cnu ia80 percent, inan amount up(n
$280.476,13. The City will provide the remaining 2O percent with in-kind matching funds in an amount up
to $84,939.84, which covers the salary of one inspection supervisor working full-time on the project.

The Financial Management Services Director certifies that upon approval of the above recommendations,
receipt of the grant and adoption of the attached appropriation ordinance, funds will be available in the
current operating budget, os appropriated, of the Grants Fund.
