HomeMy WebLinkAboutOrdinance 20368-09-2012Ordinance No. 20368-09-2012 AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE PUBLIC IMPROVEMENT DISTRICT I I FISCAL YEAR 2012-2013 PROJECT ACCOUNT OF THE SPECIAL ASSESSMENT DISTRICT FUND IN THE AMOUNT OF $65,105.00, FROM AVAILABLE FUNDS, CONTINGENT UPON THE ADOPTION OF THE ORDINANCE LEVYING SPECIAL ASSESSMENTS FOR THE 2012 TAX YEAR, FOR THE PURPOSE OF PROVIDING MANAGEMENT AND IMPROVEMENT SERVICES FOR THE STOCKYARDS PID DURING FISCAL YEAR 2012-2013; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1, That in addition to those amounts allocated to the various City departments for Fiscal Year 2012-2013 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Public Improvement District 11 Fiscal Year 2012-2013 Project Account of the Special Assessment District Fund in the amount of $65,105.00, from available funds, contingent upon the adoption of the ordinance levying special assessments for the 2012 Tax Year, for the purpose of providing management and improvement services for the Stockyards PID during Fiscal Year 2012-2013. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordimnee, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be incorporated into the ordinance effecting the budget of the municipal government of the City of Fort Worth for the ensuing Fiscal Year beginning October 1, 2012, and ending September 30, 2013, and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect upon adoption. Conduct a public benefit hearing concerning the proposed special assessments on property located in Public Improvement District 11, the Stockyards Public Improvement District, for the 2012 tax year; 2. Approve the attached Stockyards Public Improvement District budget and five -year service plan for Fiscal Year 2012 -2013; 3. Adopt the attached ordinance levying special assessments on property located in the Stockyards Public Improvement District subject to assessment for the 2012 tax year; 4. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Public Improvement District 11 Fiscal Year 2012 -2013 Project Account of the Special Assessment District Fund in the amount of $65,105.00 from available funds; 5. Authorize the transfer in the amount of $2,000.00 for administrative fees from the Special Assessment District Fund, Public Improvement District 11 Fiscal Year 2012 -2013 Project Account to the Special Trust Fund contingent upon the adoption of the proposed 2012 assessment roll; 6. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Special Trust Fund in the amount of $2,000.00 from available funds; and 7. Authorize the execution of an Agreement with the Fort Worth Stockyards Preservation Foundation, Inc., to provide management and improvement services for the Stockyards Public Improvement District during Fiscal Year 2012 -2013 for the sum in the amount of $13,021.00. DISCUSSION: On January 28, 2003, the City Council adopted Resolution No. 2925 establishing Fort Worth Public Improvement District 11 (Stockyards PID). Notice of this benefit hearing was published in the newspaper and mailed b> all record owners of property in the Stockyards P|[} /n accordance with state law. The improvements and services toba provided inthe P/[] during the 2012-2D13 Fiscal Year and the costs thereof are as follows: Improvements The total budgeted costs 0f the improvements and services are in the amount of$8O'285.UO.Cf this amount, $M5'105.00 will be funded bvassessments collected nn privately owned parcels located inthe district byapplying m rate of $0.12 cents toeach $10ODOOf property value.
