AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND
APPROPRIATIONS IN THE GRANTS OPERATING OTHER FUND SUBJECT TO
RECEIPT OF THE GRANT, IN THE AMOUNT OF $24,900.00, FOR THE
PURPOSE OF ADDITIONAL REIMBURSABLE FUNDS FOR THE UNITED
STATES MARSHALS SERVICE VIOLENT OFFENDER TASK FORCE;
PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE
CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN
CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That in addition to those amounts allocated to the various City departments for Fiscal Year 2020-2021 in the
Budget of the City Manager,there shall also be increased estimated receipts and appropriations in the Grants
Operating Other Fund, subject to the receipt of the grant, in the amount of$24,900.00, for the purpose of
additional reimbursable funds for the United States Marshals Service Violent Offender Task Force.
SECTION 2.
That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void
for any reason by a court of competent jurisdiction,such decision,opinion or judgment shall in no way impair
the remaining portions,sections,or parts of sections of this ordinance,which said remaining provisions shall
be and remain in full force and effect.
SECTION 3.
That this ordinance shall be cumulative of Ordinance 24446-09-2020 and all other ordinances and
appropriations amending the same except in those instances where the provisions of this ordinance are in
direct conflict with such other ordinances and appropriations,in which instance said conflicting provisions of
said prior ordinances and appropriations are hereby expressly repealed.
SECTION 4.
This ordinance shall take effect upon adoption.

RECOMMENDATION:
It is recommended that the City Council adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the
Grants Operating Other Fund in the amount of$24,900.00,subject to receipt of funds,for the purpose of receiving additional funds for the Fort
Worth Police Department Fugitive Units participation in the United States Marshals Service Violent Offender Task Force Project 101634 Fiscal
Year 2018-22 United States Marshals Service Task Force.
DISCUSSION:
The purpose of this Mayor and Council Communication(M&C)is to appropriate additional funds for the Police Department Fugitive Unit's
participation in the United States Marshals Service(USMS)Violent Offender Task Force(VOTF)project 101634 Fiscal Year(FY)2018-22 USMS
TF.On 2/16/2021,the City Council approved M&C 21-0123 to appropriate$130,000.00 for reimbursable funds for overtime expenses related to
VOTF participation. On 6/28/2021 a modification document was received from the USMS to increase funding for task force officer overtime.The
additional appropriation of$24,900.00 for project 101634 FY 2018-22 USMS TF,results in total reimbursable funds of$154,900.00 to the City of
Fort Worth. Adoption of the attached appropriation ordinance will provide capacity to account for the expenses to be reimbursed from the
additional funds.
The Fugitive Unit has participated in the USMS VOTF for many years,most recently with M&C 21-0123 and City Secretary Contract No.50153.
The program operates pursuant to the Presidential Threat Protection Act of 2000(Public L. 106544;28 U.S.C.§566 note),which provides for the
establishment of permanent Fugitive Apprehension Task Forces consisting of federal,state and local law enforcement authorities in designated
regions of the United States,to be directed and coordinated by the United States Marshals Service,for the purpose of locating and apprehending
fugitives.The primary mission of the USMS VOTF is to investigate and arrest,as a part of joint law enforcement operations,persons who have
active and federal warrants thereby improving public safety and reducing violent crime.
The City receives asset forfeiture funds from the USMS to reimburse a portion of the City's expenditures associated with participation in the VOTF.
Reimbursement is limited to overtime expenses related to the VOTF.The City of Fort Worth will be responsible for officer salaries and associated
fringe benefits.Indirect expenses are not eligible for reimbursement. There is no required match.
This Task Force serves ALL COUNCIL DISTRICTS.
A Form 1295 is not required because:This contract will be with a governmental entity,state agency or public institution of higher education: U.S.
Department of Justice
FISCAL INFORMATION/CERTIFICATION:
The Director of Finance certifies that upon approval of the above recommendation and adoption of the attached appropriation ordinance,funds will
be available in the current operating budget,as appropriated, in the Grants Operating Other Fund.The Police Department(and Financial
Management Services)will be responsible for the collection and deposit of funds due to the City. Prior to an expenditure being incurred,the Police
Department has the responsibility to validate the availability of funds.This is a reimbursement grant.
