AN ORDINANCE VACATING AND EXTINGUISHING AN ALLEY,
SITUATED IN THE E.S. TERRELL SURVEY, ABSTRACT NO. 1644,
LOCATED IN THE J.N. BROOKERS SUBDIVSION OF BLOCK 11
FIELDS WELCH ADDITION, AN ADDITION TO THE CITY OF FORT
WORTH, TARRANT COUNTY, TEXAS, AS SHOWN IN THE PLAT
THEREOF RECORDED IN VOLUME 204, PAGE 38 OF THE DEED
RECORDS OF TARRANT COUNTY, TEXAS, CONTAINING
APPROXIMATELY 2,347 SQUARE FEET OR 0.054 ACRE OF LAND
MORE OR LESS; PROVIDING FOR REVERSION OF FEE IN SAID
LAND; PROVIDING THAT THE CITY SHALL RETAIN ALL EXISTING
UTILITIES EASEMENTS; REPEALING ALL ORDINANCES IN
CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That an alley, situated in E.S. Terrell Survey, Abstract No. 1644, located in J.N. Brookers
Subdivision of Block 11, Fields Welch Addition, an addition to the City of Fort Worth, Tarrant
County, Texas, as shown in the plat thereof recorded in Volume 204, Page 389 of the Deed
Records of Tarrant County, Texas, and containing 2,347 square feet or 0.054 of land more or
less, and as more specifically described in Exhibits A and B attached hereto and incorporated
herein by reference be and the same is vacated and extinguished.
SECTION 2.
That the easement to the land in the above-described vacated alley right-of-way is hereby
released and shall revert to the adjacent owner as provided by law.
SECTION 3.
All existing utility easements shall be retained by the City until such time all utilities
located in that easement are relocated at the owner's expense.

SECTION 4.
That all ordinances or parts of ordinances in conflict herewith are hereby repealed.
SECTION 5.
That this ordinance shall take effect upon adoption.

BEING a 2,347 square feet or 0.054 acre tract of land situated in the E.S.Terrell Survey,Abstract Number
1644 in the City of Fort Worth,Tarrant County,Texas,and being part of an Alley of the J.N. Brookers
Subdivision of Block 11 Fields Welch Addition,recorded in Volume 204, Page 38 of the Plat Records of
Tarrant County,Texas,and being more particularly described as follows:
BEGINNING at the northeast corner of Lot 7R,Block 3,same being the southeast corner of Lot 6 of said
J.N. Brookers Subdivision,and being in the west line of said Alley(8'R.O.W.);
THENCE N87°39'59"E,a distance of 7.84 feet,to a point for corner;
THENCE S00°36' 13"E,a distance of 125.00 feet,along the east line of said 8'Alley,also being the west
line of Lot 9R-A,Block 2,J.N. Brooker Subdivision of Block 11, Fields Welch Addition, as recorded in
Volume 388-182, Page 61,P.R.T.C.T.,to a point for corner;
THENCE S00°36' 18"E,a distance of 172.35 feet,along the east line of said 8'Alley,also being the west
line of Lot 9R, Block 2,of the J.N. Brooker Subdivision of Block 11, Fields Welch Addition,as recorded in
Volume 388-136, Page 3,P.R.T.C.T.,to a point for corner;
THENCE S890 23'42"W,a distance of 7.96 feet,to a point for corner;
THENCE N00°34'50"W,a distance of 184.61 feet,along the west line of said 8'Alley,also being the east
line of Lot 3R,Block 3,as recorded in Instrument Number D216236838,P.R.T.C.T.,to a point for corner;
THENCE N00°34'50"W,a distance of 112.50 feet,along the west line of said 8'Alley,also being the east
line of said Lot 7R,to the POINT OF BEGINNING,and containing 2,347 square feet or 0.054 acres of land,
more or less.
BASIS OF BEARING: NAD 1983 state plane coordinates, Texas North Central 4202 (2011). Geodetic bearing
established by GPS measurements taken on 6/19/17. Solutions have been calculated by the National Geodetic
Survey,Opus website.

Replatted with the Adjoining Property for Commercial DevelopmentJn the Near Southside
RECOMMENDATION:
It is recommended that the City Council:
1.Adopt the attached ordinance vacating a portion of an alley in Block 3,JN Brookers Subdivision of Block 11 Fields Welch Addition to be
replatted with the adjoining property for commercial development in the Near Southside;and
2.Waive any and all purchase fee value of the vacated land in accordance with City policy.
DISCUSSION:
Salcedo Group, Inc.,on behalf of Funkytown Development LLC,has requested vacation of this portion of the alley to be replatted with the adjoining
property for commercial developments in the Near Southside.The City Plan Commission recommended approval of this request at its meeting on
December 4,2020.Acceptable final plats(FS-21-087, FS-21-088 and FS-21-089)have been received in accordance with the Subdivision
Ordinance.
The City of Fort Worth(City)originally obtained the above mentioned right-of-way through plat dedication.The City does not own any fee interest in
the rights-of--way or own any property adjacent to the right-of--way and did not expend any City funds to purchase the right-of--way easement.In
accordance with the City's policy regarding street and alley vacation transactions approved by the City Council on March 6,2007,Mayor and
Council Communication(M&C G-15624),staff recommends waiving the fair market value or any portion thereof of purchase price of this right-of--
way easement for the alley.
This project is located in COUNCIL DISTRICT 9.
A Form 1295 is not required because:This M&C does not request approval of a contract with a business entity.
FISCAL INFORMATION I CERTIFICATION:
The Director of Finance certifies that approval of these recommendations will have no material effect on City funds.
