(CD 2) Conduct Public Hearing and Authorize the Use of a Portion of Marine Creek Lake Park for a Permanent Sanitary Sewer Maintenance Area

RECOMMENDATION:
It is recommended that the City Council:
1. Conduct a public hearing under the guidelines set forth by the Texas Parks and Wildlife Code, Chapter 26, Protection of Public Parks and
Recreational Lands;
2. Find that no feasible or prudent alternative exists for the use of Marine Creek Lake Park for the installation for permanent sanitary sewer
lines M-279A & M-365 maintenance area;
3. Find that the proposed permanent sanitary sewer lines M-279A & M-365 maintenance area includes all reasonable planning to minimize
harm to the parkland, including that all infrastructure and equipment will be constructed in Marine Creek Lake Park as specified on the
attached exhibits and as noted in the discussion below; and
4. Close the public hearing and authorize the use of approximately 0.076 acres of dedicated parkland at Marine Creek Lake Park for the
permanent sanitary sewer lines M-279A & M-365 maintenance area and approximately 6.2 acres of temporary construction access and
workspace.
DISCUSSION:
The Park & Recreation Department (PARD) has been approached by the City of Fort Worth Water Department (Water Department) requesting a
conversion of approximately 0.076 acres of parkland within Marine Creek Lake Park for the installation of a permanent sanitary sewer
maintenance area. The maintenance area is necessary to service a 42" sanitary sewer line that will replace existing 18" and 30" lines that no
longer meet current demand, (lines M-279A & M-365).
The maintenance area is located south of the lake and park. It connects the existing easement on parkland to an existing easement on the
adjacent private property.
The project will require a temporary construction access and workspace equating to approximately 270,072 square feet or 6.2 acres and will be
restored to previous condition or better upon completion. The lake trail will remain open for the duration of the project, with three temporary detours
to route trail users around construction areas. The Water Department will be responsible for trail detour signage and public communication. The
Water Department will ensure that public communications will be conducted to adequately inform the general public and park users throughout the
project. The Contractor and Water Department will coordinate with the PARD on park access and other issues impacting the park and park users.
The City Forester has reviewed the plans and assessed a fee of $24,100.00 for the removal of sixteen trees which range in size from 4 caliper
inch to 21 caliper inch, located outside of the permanent easement. The existing trees to remain in proximity to the proposed construction will be
protected with fencing.
On June 23, 2021, the Park & Recreation Advisory Board endorsed Staffs recommendation to the City Council to authorize the use of parkland in
Marine Creek Lake Park for a permanent sanitary sewer maintenance area.
In accordance with state law, the conversion will be advertised in the Fort Worth Star -Telegram on July 27, August 3, and August 10, 2021. An
exhibit map was available for public review on the Park & Recreation Department website.
Signage was posted at the site noting the conversion and providing instructions for directing comments to PARD. An email announcing the
proposed conversion was sent to the presidents of the Parkview Hills NA, Marine Creek Hills NA, Trails of Marine Creek NA, Fort Worth Stone
Creek Ranch NA, Bowman Estates NA, Marine Creek Ranch NA, Remington Point Villas NA, Terrace Landing NA, Marine Creek Meadows NA,
and Trailwood Estates NA on July 15, 2021. Staff will note any public comment received during the public hearing Report of City Staff.
Marine Creek Lake Park is located in COUNCIL DISTRICT 2.
A Form 1295 is not required because: This M&C does not request approval of a contract with a business entity.
FISCAL INFORMATION / CERTIFICATION:
The Director of Finance certifies that funds are available in the current capital budget, as appropriated, in the WS Capital Project 2019 Fund for
the Marine Creek Parallel Phase II project to support the approval of the above recommendations, funds will be deposited into the Tree Mitigation
Fund for the removal of the trees. The Park & Recreation Department (and Financial Management Services) is responsible for the collection and
deposit of funds transferred from the Water Department.
