WHEREAS, The City of Fort Worth and Brinkley Sargent Wiginton Architects, Inc.,
(Consultant) made and entered into City Secretary Contract No. 52577 (The Contract)
which was administratively authorized, the 26th day of July, 2019, for Phase One,
Programming, Schematic Design and Cost Estimating of the Northwest Community
Center; and
WHEREAS, further amendment is necessary to reimburse the Consultant as part of the
design services agreement for additional design services for Drainage Study Models
and Report.
NOW THEREFORE, City and Consultant, acting herein by and through their duly
authorized representatives, enter into the following agreement which amends the
Contract:

Article I — Scope of Services, Paragraph (3) shall be added to read as follows:
(3) Provide additional design services for the Schematic Design, Design
Development, Construction Documents, Bidding/Negotiations and Construction
Administration Phases. The cost of this additional service is $32,594.00 including
reimbursable expenses. The scope of services is described more fully in Brinkley
Sargent Wiginton Architects, Inc. Amendment 4 - Proposal dated August 12,
2021 .

Article II — Compensation, first paragraph, is amended as follows:
"Consultant shall be compensated in accordance with the Fee Schedule shown
in Attachment "A". Payment shall be considered full compensation for all labor,
materials, supplies, and equipment necessary to complete the services
described in Attachment "A". However the total fee paid by the City shall not
exceed a total of $1 ,197,871 .00 unless the City and the Consultant mutually
agree upon a fee amount for additional services and amend this Agreement
accordingly."

Article III — Substitute the attached revised Section IV into the original Agreement.

Dear Mr. Springs:
INTRODUCTION
CMJ Engineering, Inc. (CMJ) is pleased to submit a proposal for providing geotechnical
engineering services in conjunction with the above-referenced project. We prepared this
proposal based on an email from you and on the preliminary scope submitted to this office.
The project, as currently planned, will consist of a single-story community center building with
an approximate footprint of 20,000 square feet. No basements or below-grade structures are
anticipated. Area parking and driveways are also planned. In addition, Hidden Lake Road will
be improved for facility access, in accordance with City of Fort Worth pavement design
standards. A prefabricated, single-span bridge is planned for the new roadway, near the
connection to N. Blue Mound Road.
For purposes of this proposal, it is assumed that all borings are accessible to truck-mounted
drilling equipment. In addition, it is assumed that no underground utilities exist at boring
locations.

SCOPE OF SERVICES
I. BASIC SERVICES
A. SUBSURFACE EXPLORATION
Based on past experience in the vicinity of the project, we anticipate subsurface conditions to
consist of soils and rock of the Fort Worth geological formation.
Experienced drillers and technicians will evaluate subsurface conditions with a total of nine (9)
sample borings. Six borings will be drilled to depths of 20 to 25 feet below existing grades for
the proposed building and bridge, depending on the depth to unweathered gray limestone. The
remaining borings will be drilled to a depth of 10 feet for area paving, in accordance with City of
Fort Worth standards. Proposed tentative boring locations are presented on the attached
exhibit.
The field personnel will drill the borings using truck-mounted equipment. Cohesive and non-
cohesive soil samples will be obtained using 3-inch diameter Shelby tube samplers and 2-inch
diameter standard split-spoon samplers, respectively. In addition, rock encountered will be
evaluated by use of Texas Department of Transportation (TXDOT) cone penetration tests. A
soils logger will extrude the samples in the field, check the samples for consistency with a hand
penetrometer, carefully wrap them to preserve their condition, and return them to the laboratory
for testing. A log of each boring will be prepared to document field activities and results.
CMJ's personnel will stake the boring locations using hand-held GPS equipment. Approximate
locations of the borings will be shown on the plan of borings. Precise surveying of boring
locations and elevations is not included in the cost estimate. These services may be provided
as Additional Services upon request. At the completion of drilling operations, boreholes will be
backfilled with drill cuttings and plugged at the surface by hand tamping.
B. LABORATORY SERVICES
Considering the planned facilities, anticipated soil conditions and geology, laboratory tests will
be required for classification purposes, and to determine strength characteristics. The following
types of tests are therefore recommended:
• moisture content and soil identification
• liquid and plastic limit determinations
• unconfined compression tests on soil
• unit weight determinations
• absorption pressure and/or one-point pressure swell tests
• soluble sulfate tests
• lime series tests

The specific types and quantities of tests will be determined based on geologic conditions
encountered in the borings.
C. ENGINEERING SERVICES
An engineering report will be prepared to present the results of the field and laboratory data
together with our analyses of the results and recommendations. We will provide two copies of
the report and an electronic copy. The report will address:
• general soil and ground-water conditions
• recommendations for building and bridge foundation type, depth and allowable
loading
• minimum penetration of piers to resist uplift (if required)
• foundation construction requirements
• recommendations for floor slab support, including an evaluation of the swell
characteristics of the subgrade soils
• earthwork recommendations
• guidelines for pavement design, including public roadway improvements in
accordance with city standards
Items other than those specified above, which are revealed by these studies or are necessitated
by a change in project scope, may require revised field, laboratory, and engineering services.
These services, if required and requested, will be performed as Additional Services. Additional
Services are described in Section II.
D. COMPENSATION FOR BASIC SERVICES
It is proposed that the Basic Services described above be performed on a unit price basis, in
accordance with the attached Basic Services Cost Estimate. Based on the anticipated scope
and the attached Basic Services Cost Estimate, the total cost of the Basic Services should be
on the order of $9,500 to $9,600. For budget purposes, a maximum cost of $9,600 is
recommended. This cost for Basic Services will not be exceeded without prior authorization.
The estimated costs shown in this proposal are based on the anticipated soil conditions. The
final invoice will be based on the specific quantities drilled and tested. If unanticipated
conditions are encountered during drilling, we will notify you accordingly.
E. SCHEDULE FOR BASIC SERVICES
Weather permitting, we plan to initiate these studies within seven days of receipt of notice to
proceed, and anticipate that one to two working days will be required to complete the

subsurface exploration for the site (weather conditions permitting). You will receive the final
report approximately three weeks following the completion of the field phase. We will make
preliminary design data available sooner if necessary.
II. ADDITIONAL SERVICES
A. AUTHORIZATION AND SCOPE
Additional Services will be performed only if specifically requested and authorized by Client.
Additional Services may consist of the following:
• Additional subsurface exploration, including quantities or items other than described in
Basic Services.
• Bulldozer or other equipment services required to achieve access to boring locations.
• Stand-by time or time in excess of one-half hour required for travel between boring
locations.
• Additional laboratory services, including quantities or items other than described in Basic
Services.
• Additional insurance coverage or limits (if available) other than CMJ's standard policies.
• Additional engineering services, including personnel time and expenses for items not
specifically described in Basic Services. This may include, but is not limited to,
additional meetings requested by Client or Client's other consultants, assistance to
Client in dealing with regulatory agencies, preparation and engineering assistance in
legal proceedings, and evaluation of alternative designs for the project or relocation of
structure, following initial submittal of the geotechnical report.
• Additional copies of the report, other than the number described in Basic Services.
• Any other required or requested services authorized by Client, other than those
specifically described in Basic Services.
B. COMPENSATION AND SCHEDULE FOR ADDITIONAL SERVICES
Additional Services, when authorized by Client, will be in accordance with our Schedule of Fees.
Additional Services will be performed at reasonable times and within reasonable schedules as
requested by Client. Authorized Additional Services will be billed as a separate item on invoices
and a description of the Additional Services will be provided.
III. TERMS AND CONDITIONS
The scope of services will be performed pursuant to the AIA Consulting Agreement with Brinkley
Sargent Wiginton Architects.

Article VI
Procedures for Providing Architectural Services
(1) The Architect agrees to commit the personnel to each assignment of the Project
as appropriate in order to complete the Project in an expeditious manner. The
Architect shall meet with the City's staff as required during the duration of the
project. The Architect may not change key personnel without the City's written
approval.
(2) Programming and Schematic Design Phase:
a. The Architect shall become familiar with the site and scope of the Project.
b. The Architect shall consult with the City to clarify and define the City's
requirements relative to the Project and review available data.
c. The Architect shall become familiar with the City's current document "Facilities
Division DESIGN GUIDELINES forNewand Existing Facilities"and incorporate
into all phases of the work.
d. The Architect shall prepare a written Program Design Manual defining project
goals, program, architectural concepts, site and floor plans, principal
equipment, finishes and area-based cost estimates.
e. The Architect shall assist the Owner with the selection of a CMAR Contractor.
f. The Architect shall pay for the printing of contract documents required for design
submittals and presentations as a part of the reimbursable allowance.
g. Architect shall not proceed to the Design Phase until the City has provided
written approved of the Program Design Manual.
(3) Design Phase:
a. The Architect shall perform all services necessary to complete the design and
secure a construction permit, including all services necessary to survey, plat,
prepare and vacate easements and address any other property issues.
b. The design shall include all site work, design and coordination of utilities,
landscaping and facility design required for a complete and functional project.
c. The Architect shall work through the Design Phase with the Owner and CMAR
Contractor to obtain a Guaranteed Maximum Price.
d. The Architect shall prepare presentation graphics (plans, elevations, etc.) and
present at two (2) City meetings (if required) during the design of the project.
e. The Architect shall prepare the design in two stages as follows:
i. Design Development Phase: Preparation of architectural, civil, iSWM,
structural, MEP plans, principal elevations, site plans, cartoon set,
selection of principal equipment and finishes, and discipline-based opinion

of probable construction costs. Upon written approval of this phase of the
work, the Architect may proceed to the Construction Document Phase.
ii. Construction Document Phase: Preparation of details, architectural,
structural, mechanical, electrical, and plumbing plans, finishes schedules,
detailed technical specifications, and detailed opinion of probable
construction costs.
f. Drawings at all stages of design will have the following characteristics: scale for
floor plans will be 1/8" or such other scale as may be agreed to in writing for all
disciplines, elevations will be at same scale as floor plans, area plans will have
same scale for all disciplines, site plans for all disciplines will be at same scale.
g. The Architect shall provide such service as may be necessary for the building
permits to be issued. The City shall pay any fees for such Building Permits. The
City or contractor shall apply for building permits.
h. The Architect, at the Architect's sole cost and expense, shall engage a Consultant
to prepare "Elimination of Architectural Barriers Registration" and submit the
applications to the Texas Department of Licensing and Regulation (TDLR). The
Architect (if required) will pay all fees required for TDLR reviews and inspections.
All designs shall be in conformance with the Elimination of Architectural Barriers
Act, State of Texas, and the City of Fort Worth Building Codes.
i. In the event the Project is constructed in accordance with the Architect's designs
and is subsequently determined to be in non-conformance with the above Act,
Codes or Texas Accessibility Standards, the City will bear the construction costs
associated with enhancements. The Architect will reimburse the City for additional
costs, charges or fees to replace or rework features that were constructed in
accordance with the design but fail to meet applicable accessibility requirements
or building codes in force at the time that the design was performed.
j. The Architect shall upload the electronic files in PDF format to the City's online
bidding site.
(4) Bidding Phase:
a. Bidding will be led by CMAR. The Architect shall assist and respond to
Contractors' inquiries, prepare necessary addenda, and conduct the Pre-
Proposal Conference, and participate in the General Contractor selection
process.
b. Following bidding, the Architect shall investigate the qualifications of up to five (5)
bidders and make recommendations concerning the capability of the bidder to
satisfactorily perform the Contract.
(5) Responsibility for Construction Cost
a. The Construction Budget for the Project shall be defined by the City.

b. The Architect shall provide to the City a review of the CMAR Contactor's opinion
of probable construction cost at the submission of each phase, and make
adjustments to the project to remain in budget. A final estimate will be presented
by the CMAR Contractor. Once the City, Architect and CMAR Contractor agree
on the final estimate, the contractor may initiate a bid process to obtain a
Guaranteed Maximum Price.
(6) Construction Phase:
a. The Architect shall assist the City with review and approval of submittals and
proposed change orders concerning the Contractor, and shall review and advise
the City with respect to the resolution of construction issues, including Contractor
Request for Information, Submittals, Change Orders, Contingency Allowance
Forms, Field Orders, etc. The Architect shall visit the site at interval appropriate
to the stage of construction to become generally familiar with the progress and
quality of the portion of the Work completed, and to determine, in general, if the
Work observed is being performed in a manner indicating that the Work, when
fully completed, will be in accordance with the Contract Documents. However,
the Architect shall not be required to make exhaustive of continuous on-site
inspection to check the quality or quantity of the Work. On the basis of the site
visits, the Architect will keep the city reasonably informed about the progress and
quality of the portion of the Work Completed and make written report to the City
(1) known deficiencies from the Contract Documents and from the most recent
construction schedule submitted by the Contractor, and (2) defects and
deficiencies observed in the Work.
b. The Architect shall attend progress meeting at the job site every other week.
c. At the completion of construction, the Architect shall conduct and document the
final inspection and assist the City on the resolution of construction or design
deficiencies.
d. The Architect will review contractor's pay requests.
e. The Architect will conduct final acceptance and end of warranty inspections with
representatives of the City and issue AIA G704 Certificate of Substantial
Completion with City approval.
f. The Architect shall provide electronic copies of the drawings and specifications in
a format acceptable to the Contractor for the Contractor's preparation of "Record
Drawings" for the City's archives.
g. At the end of the project,the Architect use field notes, contractor provided "Record
Drawings" and other data will provide "As Built Drawings" in AutoCAD format or
other format as determined by the City.

(7) All designs, drawings, specifications, documents, and other work products of the
Architect, whether in hard copy or in electronic form, are instruments of service for
this Project, whether the Project is completed or not. Reuse, change, or alteration
by the City or by others acting through or on behalf of the City of any such instruments
of service without the written permission of the Architect will be at the City's sole risk.
The City shall own the final designs, drawings, specifications and documents.
Transfer of ownership of the contract documents does not constitute sale of the
documents.

RECOMMENDATION:
It is recommended that the City Council authorize the execution of an amendment to the architectural
services agreement with Brinkley Sargent Wiginton Architects, Inc., in the amount of$803,750.00, for
a total contract value of$900,000.00 to provide architectural design and construction administration
services for the new Northwest Community Center located at Northwest Community Park (City
Project No. 101650).
DISCUSSION:
The 2018 Bond Program includes $10,000,000.00 to design and construct the Northwest Community
Center at the Northwest Community Park. A request for Statements of Qualifications (SOQ) was
advertised in the Fort Worth Star-Telegram on January 17, 2019 and January 24,
2019. Seventeen SOQs were received March 27, 2019. A selection team, comprised of members of
the Park & Recreation Department, Property Management Department and the Office of Business
Diversity, reviewed these proposals and met on April 25th, 2019 to create a short list for interviews on
March 30, 2019.
On May 6, 2019 a selection team composed of members of Park & Recreation Department, Property
Management Department and the M/WBE Office conducted final interviews created from the short
list. Following the interviews the four highly qualified design teams submittals were carefully reviewed
and after discussions scored and thier ranking was established.

After ranking the proposals and conducting interviews, the selection team recommends that City
Council authorize the execution of an amendment to architectural services agreement with Brinkley
Sargent Wiginton Architects, Inc.
In order to identify site opportunities and constriants, staff administratively executed a design
agreement with Brinkley Sargent Wiginton Architects, Inc. in the amount of$96,250.00 to provide
programming and schematic design services. This M&C will authorize an amendment to that contract
in the amount of$803,750.00, for a total contract amount of$900,000.00, to address storm water
issues, complete the balance of the design, and provide construction administration services.

Funds for this project are included in the 2018 Bond Program. Available resources within the General
Fund will be used to provide interim financing until debt is issued. Once debt associated with the
project is sold, bond proceeds will reimburse the General Fund in accordance with the statement
expressing official Intent to Reimburse that was adopted as part of the ordinance canvassing the
bond election (Ordinance No. 23209-05-2018) and subsequent actions taken by the Mayor and
Council.
The impact to maintenance cost associated with this project for the Property Management
Department, beginning in Fiscal Year 2021, is expected to be $56,000.00 annually.
In accordance with the City Code of Ordinances, Part II, Chapter 7-1 Fort Worth Building
Administrative Code, Section 109.2.1, Exception 2; "Work by non-City personnel on property under
the control of the City of Fort Worth shall be exempt from the permit fees only if the work is for action
under a contract that will be or has been approved by City Council with notes in the contract
packages stating the fee is waived."
The detailed design portion of this project is anticipated to start in the third quarter of 2020 and
construction is anticipated to be complete in the fourth quarter of 2021.
MWBE OFFICE - Brinkley Sargent Wiginton Architects, Inc. is in compliance with the City's BDE
Ordinance by committing to 20\% SBE participation on this project. The City's SBE goal on this
project is 20\%.
The Northwest Community Center is to be located in COUNCIL DISTRICT 7.
FISCAL INFORMATION/CERTIFICATION:
The Director of Finance certifies that funds are available in the current capital budget, as previously
appropriated, in the 2018 Bond Program Fund, Northwest Community Center project. Prior to
