Adopt an Appropriation Ordinance Increasing Appropriations in the 2018 Safe Routes to School Project in the Amount of $340,000.00 from
Available Funds in the 2018 Bond Program - Sidewalks/Bicycle Lanes, Authorize Amendment No. 1 in the Amount of $170,000.00 to an
Engineering Agreement with Kimley-Horn and Associates, Inc., for a Revised Contract Amount of $820,000.00, and Authorize Amendment No. 1
in the Amount of $170,000.00 to an Engineering Agreement with Dunaway Associates, LP, for a Revised Contract Amount of $820,000.00, Each
for Additional Design Services and Preparation of Temporary Construction Easements for the 2018 Safe Routes to School Project (2018 Bond
Program) (COUNCIL DISTRICTS 2, 3, 4, 5 and 9)
RECOMMENDATION:
It is recommended that the City Council:
1. Adopt an Appropriation Ordinance increasing appropriations in the 2018 Safe Routes to School Project (CPN 101264) in the Amount of
$340,000.00 from Available Funds in the 2018 Bond Program Fund Sidewalks/Bicycle Lanes Programmable project (PB0002); and
2. Authorize the execution of Amendment No. 1 in the amount of $170,000.00 to City Secretary Contract No. 50090, an engineering agreement
with Kimley-Horn and Associates, Inc., for additional design services and preparation of temporary construction easements for the 2018
Safe Routes to School project (City Project No. 101264); and
3. Authorize the execution of Amendment No. 1 in the amount of $170,000.00 to City Secretary Contract No. 50092, an engineering agreement
with Dunaway Associates, LP, for additional design services and preparation of temporary construction easements for the 2018 Safe Routes
to School project (City Project No. 101264).
DISCUSSION:
This Mayor and Council Communication allocates funds for additional design services and preparation of temporary construction easements for
the 2018 Safe Routes to School project.
On December 12, 2017, (M&C C-28506), the City authorized an engineering agreement in the amount of $650,000.00 with Kimley-Horn and
Associates, Inc., and an engineering agreement in the amount of $650,000.00 with Dunaway Associates, LP, for the design of the 2018 Safe
Routes to School project. The funds were approved for design of sidewalks, crosswalks, curb ramps, signs and markings within a quarter mile
radius of each of the following seven elementary schools: Bonnie Brae, C. C. Moss, Daggett, Diamond Hill, D. McRae, M. L. Phillips and W. J.
Turner.
Funds for the initial design contracts came from 2014 Bond Program Grant Match Funds and 2014 Sidewalk Funds. Funds for construction of the
project will come from a $3.2 million Safe Routes to School Grant received through the North Central Texas Council of Governments along with City
of Fort Worth bond funds from the 2018 Neighborhood Safety Bond Fund and the 2018 Sidewalks Bond Fund. Funds for Amendment No. 1 to the
Kimley-Horn and Associates, Inc. contract and Amendment No. 1 to the Dunaway Associates, LP contract will come from the FY 2018
Sidewalks/Bicycle Lanes Bond Fund.
Funds for this project are included in the 2018 Bond Program. Available resources within the General Fund will be used to provide interim
financing until debt is issued. Once debt associated with the project is sold, bond proceeds will reimburse the General Fund in accordance with the
statement expressing official Intent to Reimburse that was adopted as part of the ordinance canvassing the bond election (Ordinance No. 23209-
05-2018).
Staff considers the proposed fees to be fair and reasonable for the scope of services proposed.
MWWBE Office:
Kimley-Horn and Associates, Inc.: Kimley-Horn and Associates, Inc. agrees to maintain its initial SBE commitment of 5% that it made on the
origianl agreement and extend and maintain that same SBE committment of 5% to this first amendment. Therefore Kimley-Horn and Associates,
Inc. remains in compliance with the City's BIDE ordinance and attests to its committment by its signature on the Acceptance of Previous SBE
Commitment form executed by an authorized representative of its company.
Dunaway Associates, LP: A waiver of the goal for MBE/SBE subcontracting requirements was requested by the Department and approved by the
MWBE Office, in accordance with the MWWBE or BIDE Ordinance, because the purchase of goods or services from sources(s) where
subcontracting or supplier opportunities are negligible.
The project is located in COUNCIL DISTRICTS 2, 3, 4, 5 and 9.
FISCAL INFORMATION / CERTIFICATION:
The Director of Finance certifies that upon approval of the above recommendations and adoption of the attached appropriation ordinance, funds
will be available in the current capital budget, as appropriated of the 2018 Bond Program Fund.
