HomeMy WebLinkAboutOrdinance 20419-09-2012Ordinance No. 20419 -09 -2012 AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE GRANTS FUND IN THE AMOUNT OF $86,011.25, UPON EXECUTION OF AN AGREEMENT BETWEEN THE UNITED STATES DEPARTMENT OF JUSTICE, DRUG ENFORCEMENT ADMINISTRATION AND THE CITY OF FORT WORTFI, FOR THE PURPOSE OF PAYMENT OF OVERTIME FOR PARTICIPATION IN THE NORTH TEXAS HIGH INTENSITY DRUG TRAFFICKING AREA TASK FORCE GROUP 2 FOR FISCAL YEAR 2013; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE, DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. "That m addition to those amounts allocated to the various City departments for Fiscal Year 2012 -2013 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Grants Fund in the amount of $86,011.25, upon execution of an agreement between the United States Department of Justice, Drug Enforcement Administration and the City of Fort Worth, for the purpose of payment of overtime for participation in the North Texas High Intensity Drug Trafficking Area Task Force Group 2 for Fiscal Year 2013. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remainng provisions shalt be and remain in full force and effect. SECTION 3 That this ordinance shall be incorporated into the ordinance approved by the Fort Worth City Council effecting the budget of the municipal government of the City of Fort Worth for the ensuing Fiscal Year beginning October 1, 2012, and ending September 30, 2013, and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Authorize the execution of an Agreement with the United States Department of Justice, Drug Enforcement Administration regarding the North Texas High Intensity Drug Trafficking Area Task Force Group 2 for Fiscal Year 2013; 2. Authorize the Agreement to begin on October 1.2O12 and end on September 3O.2U13 and provide that a thirty-day advance written notice be required for termination of the Agreement-, 3. Authorize the Police Department to accept the amount up to $86,011.25 for reimbursement of overtime payments made tothe five officers assigned to the North Texas High Intensity Drug Trafficking Area Task Force Group 2;and 4. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in Grants DISCUSSION: Fund in the amount of $86,011.25 upon execution of the Agreement. The City of Fort Worth has been an active participant in the North Texas High Intensity Drug Trafficking Area (North Texas HIDTA) since 1999. The Police Department will continue to assign up to five officers to this Task Force. The mission of the Task Force istoreduce the volume of narcotics and controlled substances being trafficked into and distributed from the North Texas HIDTA area of responsibility through aggressive detection, interdiction, enforcement and prosecution of those individuals and enterprises engaged in such illegal activities. In particular, the Task Force focuses on major drug trafficking organizations. The following entities also participate in this cooperative effort: Drug Enforcement Administration, Federal Bureau of Investigation, Arlington Police Oapartnlen<, White Settlement Police Department and Denton Police Department. The Fort Worth Police Department currently assigns five officers to the Task Force. When funds are available from the Department ofJustice, Drug Enforcement Administration /DOJ-0EA\ overtime will be reimbursed to the City of Fort Worth by North Texas HIDTA. Overtime is estimated not to exceed the amount Of$80.011.25. The Police Department is responsible for submitting request for reimbursement to off set the expenditures. Funds will be reimbursed by DOJ -DEA after expenditures are made.
