HomeMy WebLinkAboutOrdinance 20421-09-2012Ordinance No. 2042 1 -09 -20 1 2 AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE GRANTS FUND IN THE AMOUNT OF $121,870.45, SUBJECT TO RECEIPT OF A GRANT FROM THE UNITED STATES DEPARTMENT OF JUSTICE, DRUG ENFORCEMENT ADMINISTRATION, FOR THE PURPOSE OF REIMBURSEMENT OFOVERTTME WORKED BY ASSIGNED OFFICERS AND A CLERICAL EMPLOYEE TO CONTINUE OPERATION OF THE DRUG ENFORCEMENT ADMINISTRATION, FORT WORTH MULTI-AGENCY TASK FORCE; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2012-2013 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Grants Fund in the amount of $121,870.45, subject to receipt of a grant from the United States Department of Justice, Drug Enforcement Administration, for the purpose of reimbursement of overtime worked by assigned officers and a clerical employee to continue operation of the Drug Enforcement Administration, Fort Worth Multi-Agency Task Force. SECTION 2, That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain it) full force and effect. SECTION 3. That this ordinance shall be incorporated into the ordinance approved by the Fort Worth City Council effecting the budget of the municipal goverru-nent of the City of Fort Worth for the ensuing Fiscal Year beginning October 1, 2012, and ending September 30, 2013, and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Authorize the execution of a Task Force Agreement with the United States Department of Justice, Drug Enforcement Administration to continue operation of the Drug Enforcement Administration Fort Worth Multi- Agency Task Force; 2. Authorize the term of the Agreement to be September 30, 2012 through September 30, 2013; 3. Authorize the Police Department to accept up to the amount of $121,870.45 for reimbursement of overtime worked by the assigned officers and support provided by a clerical employee; and 4. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Grants Fund in the amount of $121,870.45. DISCUSSION: The Fort Worth Police Department has been an active partner in the Drug Enforcement Agency (DEA) Fort Worth Multi- Agency Task Force since the creation of the Task Force in 1985. The DEA Fort Worth Multi- Agency Task Force performs activities and duties to disrupt the illicit drug traffic in the Tarrant County area by immobilizing targeted violators and trafficking organizations, gathering and reporting intelligence data related to trafficking in narcotics and dangerous drugs, conducting undercover operations, where appropriate, and engaging in other traditional methods of investigation in order that the Task Force's activities will result in effective prosecution before the courts of the United States and the State of Texas. The Police Department has five officers assigned to the Task Force and the DEA reimburses the Police Department for overtime costs up to the amount of $17,202.25 per officer, per year. In addition, this Agreement will reimburse the City of Fort Worth the salary for one clerical support employee in the amount not to exceed $35,859.20. During the period of assignment of Fort Worth police officers to the Task Force, the City of Fort Worth will remain responsible for establishing the salaries and benefits, including overtime, of the officers assigned to the Task Force.
