ORDINANCE NO. 16783-01-2006 AN ORDINANCE AMENDING SECTTON 22-191, "ESTABLTSIIMENT OF RATE5 AND MAXIMUM PARHING TIME THERETN; ESTABLISHMENT OF FEES", OF CHAPTER 22 "MOTOR VEHICLES .AND TRAFFIC," OF THE CODE OF THE CTTY OF FORT WORTH, TEXAS (1964), AS AMENDED, BY ADDING A RATE FOR ASSIGNED PERMTT SPACES FOR MOBTLTTY TMPAIRED EMPLOYEES IN THE DOWNTOWN; MAKING THIS ORDTNANCE CUMULATTVE OF OTHER ORDINANCES; PROVIDING A SEVERABTLTTY CLAUSE; PROVIDING A PENALTY CLAUSE; PROVIDING FOR PUBLICATION AS REQUIRED BY LAW; AND PROVIDTNG AN EFFECTTVE DATE. BE IT ORDAINED BY THE CITY CO[JNCTL OF THE CITY OF FORT WORTH: SECTION 1. Section 22-191, "Establishment of Zones and Maximum Parking Time Therein; Establishment of Fees", of Article VI, "Stopping, Standing and Parking", oft Chapter 22, Motor Vehicles, of the Code of the City of Fort Worth, as amended, is hereby furthex amended to add language to Subsection (d) to establish a rate for assigned permit parking spaces far mobility impaired employees in the downtown to read as follows: Section 22.191 Establishment of Zones and Maximum Parking Time Therein; Establislunent of Fees (d) The fees for parking shall be paid in the coin of the United States of America and are established as follows: {1) Parking Meter Rate No. ~ -- One (1} Hour Parking: Two (2) minutes for each five cent ($0.05} coin deposited in the meter; four {4) minutes for each ten cent ($0.10) coin deposited in the meter; and ten (10} minutes far each twenty-five cent ($0.25) coin deposited in the meter. (2) Parking Meter Rate No..2 -Two (2} Hour Rate: Three {3) minutes far each five cent ($0.05) coin deposited in the meter; six (6) minutes for each ten cent ($0.10) coin deposited in the meter; anal fifteen (1S) minutes for each twenty-five cent ($0.25) coin deposited in the meter. {3} Parking Meter Rate No..~ -Four (4} Hour Rate: Four (4) minutes for each five cent ($0.05) coin depositing in the meter; eight (8) minutes for each ten cent ($0.10) coin deposited in the metering; and twenty (20) minutes for each twenty-five cent {$0.25} coin deposited in the meter. (4) Parking Meter Rate No. 4 -Ten (10 Hour Rate: Fifteen (15) minutes for each .five cent {$0.05} coin deposited in the meter; thirty (30) minutes for each ten cent ($0.10) coin deposited in the meter; and one (I) hour and fifteen {I5) rninrttes for each twenty-five cent ($0.25) coin deposited in the rrteter. This ordinance shall be cumulative of all provisions of all ordinances and of the Code of the City of Fort Worth, Texas (1986}, as amended, except where the provisions of this ordinance are in direct conflict with the provisions of such ordinances and such Cade, in which event conflicting provisions of such ordinances and such Code are hereby repealed. SECTION 3. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and, if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgz~:ent or decree of any court of cornpetent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. SECTION 4. Any person, firm or corporation.who violates, disobeys, omits, neglects or refuses to comply with or who resists the enforcement of any of the provisions of this ordinance shall 2 be fined not more than Two Hundred Dollars {$200.00) for each offense. Each day that a violation is permitted to exist shall constitute a separate offense. SECTION 5. The City Secretary of the City of Fort Worth, Texas, is hereby directed to publish the caption and penalty clause of this ordinance for two {2) days in the official newspaper of the City of Fort Worth, Texas, as authorized by Section 52.013, Texas Local Government Code. sECTI®IV ~. APPROVED AS TO FORM AND LEGALITY: ~; Grp-.. ~~-r~.~r~--~ti Assis ant City Attorney Adopted: January 24, 2006 Effective: ~_.. ~~ ~ ~ ~~ ~ 3 ~if~ of Fort ~I/ortf~, ~`~xas Mayor and Council Communication COUNCIL ACTION: Approved on 1/24/2046 -Ordinance No. 16783-1-2006 ®ATE: Tuesday, January 24, 2006 RECOMMEN©ATION; It is recommended that the City Council adopt the attached ordinance establishing a rate related to assigned permit spaces for mobility impaired employees at various locations for downtown. ©ISCUSSION; On October 7, 2003, (M&C G-14119) an ordinance was adopted to amend Chapter 22 to redefine Loading Zones and Establish Rates and Maximum Parking Time on Meters. This ordinance included elimination of "meter feeding" and also required the observance of time limits. On November 21, 2005, "meter feeding" enforcement began. The Transportation Code "Sec. 881-006. Parking Privileges: Persons with ©isabilities" details or establishes the law in regard to mobility impaired, which states "A governmental unit (city) may provide by ordinance that a payment of a fee or penalty be imposed by the governmental unit for parking in a space with a limitafiian on length of time for parking". In order to mitigate the impacts of the "meter feeding" ordinance as much as possible, while balancing the need for high parking turnover in our downtown core, City staff has worked with the downtown employees who are mobility impaired to identify a parking space within a reasonable distance from the work site. To accommodate their needs, we recommend removing the parking meter heads and assigning permifited spaces as necessary. The recommended parking fee for the mobility-impaired employees impacted by the "meter feeding" ordinance is $100.00 per space per month. Contingent on City Council approval, the new fee amount will go into effect beginning March 1, 2008. The City reserves the right to relocate the spaces when necessary due to construction, special events, etc. FISCAL INFORMATIONICERTIFICATION; The Finance Director certifies that the Revenue Division will be responsible for the collection and deposit of revenues into the Parking Fund.
